HomeMy WebLinkAboutPC Min 2011-11-02City of Seal Beach - Planning Commission November 2, 2011 Chair Massa -Lavitt called the regular meeting of the Planning Commission to order at 7:30 p.m. on Wednesday, November 2, 2011. The meeting was held in the City Council Chambers and began with the Salute to the Flag led by Commissioner Cummings.' ROLL CALL Present: Chair Massa - Lavitt; Commissioners: Cummings, Everson, Goldberg Absent: Galbreath (excused) Staff Present: Department of Development Services Mark Persico, Director Jerry Olivera, Senior Planner Steven Flower, Assistant City Attorney Cummings moved, second by Everson, to excuse the absence of Commissioner Galbreath. AYES: Cummings, Everson, Goldberg, Massa -Lavitt NOES: None ABSENT: Galbreath Motion carried ORAL COMMUNICATIONS Chair Massa -Lavitt opened oral communications. There being no speakers, Chair Massa -Lavitt declared oral communications closed. AGENDA APPROVAL By motion of Chair Massa - Lavitt, the agenda was approved as presented. CONSENT CALENDAR Everson moved, second by Goldberg, to approve the Consent Calendar as presented. AYES: Cummings, Everson, Goldberg, Massa -Lavitt NOES: None ABSENT: Galbreath 1. Approved the Planning Commission Meeting Minutes of October 19, 2011. SCHEDULED MATTERS There were no matters for consideration at this time. 1 These Minutes were transcribed from audiotape of the meeting. Motion carried PUBLIC HEARING 2. Variance 11 -3 B -61 Surfside Avenue Applicant/Owner: William Bruton Request: Page 2 — Planning Commission 11/02/11 To allow an approximately 1,270 square foot, two - story detached accessory structure at the rear of the property within the Residential Low Density (RLD -9 — Surfside) zone. The proposed accessory structure does not comply with rear yard setback requirements and exceeds the allowable height limit for accessory structures by approximately 10' -6 ". Recommendation: Deny Variance 11 -3. The Senior Planner presented the staff report. Chair Massa -Lavitt opened the discussion for the commission. Everson: Questioned whether an interior stairway would be permissible. Response: Interior stairway is permissible Goldberg: Received clarification regarding side yard setback of proposed detached accessory structure. Chair Massa - Lavitt: Received clarification on whether proposed stairway encroached upon side yard setback. Chair Massa - Lavitt opened the public hearing. Mr. Bruton (applicant/owner) introduced himself and spoke briefly about his proposal. Chair Massa -Lavitt made suggestions regarding an open walkway and having the proposed structure connect to the main house, thereby eliminating the need for a variance. Mr. Bruton liked the suggestion of an open walkway to connect the proposed detached structure to the main residential structure, and agreed to revise plans accordingly. There being no additional speakers, Chair Massa -Lavitt declared the public hearing closed. Everson moved, second by Cummings, to deny Variance 11 -3. AYES: Cummings, Everson, Goldberg, Massa -Lavitt NOES: None ABSENT: Galbreath The Assistant City Attorney advised that the denial of Variance 11 -3 begins a 10- day calendar appeal period to the City Council. The Commission action tonight is final and the appeal period begins tomorrow morning. DIRECTOR'S REPORT The Director discussed the schedule for upcoming planning commission meetings; distributed Planning Commission Journal (quarterly publication) to the commissioners. COMMISSION CONCERNS Commissioner Cummings: Inquired whether staff has received any communications from the owner of Bay Theater. Response: None at this time. Commissioner Goldberg: Stated concerns regarding posting agendas and staff reports on the website prior to meeting — will continue to monitor and report back to commission. Response: Reduction in staff and extraordinary workloads have hindered placing staff reports online prior to this meeting; no legal requirements to post online at this time.
