SUMMARY OF REQUEST:
BACKGROUND AND ANALYSIS:
SUBJECT: NOTICE OF COMPLETION FOR ENERGY EFFICIENCY
UPGRADES PROJECT NO. BG1103
That the City Council adopt Resolution No. 6226 accepting the Energy Efficiency
Upgrades Project No. BG1103 by Express Energy Services, Inc. for $101,105.19
and direct the City Clerk to record the attached Notice of Completion 35 days
after the day of acceptance.
In August of 2009 the California Energy Commission announced a grant
opportunity to small cities and counties. On December 12, 2009 the City Council
approved a Professional Services Agreement with Energy Innovations Group,
LLC to assist with capitalizing on this grant opportunity.
On June 30, 2010 the City of Seal Beach was awarded $131,827.00 from the
State to upgrade interior and exterior lighting, replacement of Heating Ventilation
and Air Conditioning ( "HVAC ") units, install variable fan drives and ultraviolet
(UV) emitters on HVAC units, and window film at various City facilities. The
consultant fee of $26,320.00 will be paid from the grant funds, leaving a
remaining balance of $105,507 for construction.
On December 13, 2010 the City Council approved a bid package of plans and
specifications. The anticipated cost of this project was difficult to predict, and
therefore the bid package was divided into two groups of improvements to allow
the City to award construction and not exceed the grant amount. Those two
components are 1) lighting and 2) HVAC.
On March 3, 2011, bids were received, opened, and the combined bid results
(HVAC and lighting work) exceeded the grant allocation for construction. On
March 28, 2011, City Council awarded a contract to contractor for the project for
$78,752.00 which included the lighting scope of work only.

In order to utilize all of the grant funds, the City submitted a request for
amendment to the State. This amendment included reducing the work within the
HVAC component to allow all of the grant funds to be expended. On January 12,
2012 the State approved the grant amendment, resulting in expenditure total of
$128,008.00. The City initiated a change order with the contractor after this
approval to install the additional HVAC work. The final project scope involved
upgrading interior, exterior lighting and a portion of the HVAC work.
The project is now complete to the satisfaction of the City Engineer and was
inspected to meet all standards and requirements within the project
specifications. It is required to formally accept the project and file a notice of
completion with the Orange County Clerk.
ENVIRONMENTAL IMPACT:
This project complies with all requirements of the California Environmental
Quality Act (CEQA) and is categorically exempt under section 15301.
LEGAL ANALYSIS:
No legal analysis is required for this item.
FINANCIAL IMPACT:
This Project grant is funded through the State. The City was initially awarded
$131,827.00 of grant funds. However, after the grant amendment the amount is
$128,008.00. The grant fund covers the cost of grant administration,
construction, and inspection, and there is no City match requirement. Below is a
summary and breakdown of expenses for the project:

RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. 6226 accepting the
Energy Efficiency Upgrades Project No. BG1103 by Express Energy Services,
Inc. for $101,105.19 and direct the City Clerk to record the attached Notice of
Completion 35 days after the day of acceptance.

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
DECLARING WORK TO BE COMPLETED PER CONTRACT
DOCUMENTS FOR THE ENERGY EFFICIENCY UPGRADES
PROJECT NO. BG1103
WHEREAS, on March 28, 2011 the City of Seal Beach entered into a contract
with Express Energy Services, Inc.; and
WHEREAS, the City Engineer has determined that the work has been
substantially completed in accordance with the contract documents.
THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE:
Section 1. The work required and performed by Express Energy Services, Inc.
has been completed.
Section 2. That the total cost of amount to be paid to Express Energy
Services, Inc. is $101,105.19 for the work performed.
Section 3. That the work is hereby accepted and approved.

It is further ordered that a "Notice of Completion" be filed on behalf
of the City in the Office of the Orange County Recorder within 10
days of the date of this resolution.
