The meeting was caLled to order with the ~ledge or Allegiance. Present: Mayor Calvo Councilmen: Tancre, Ross, Flanagan, Spencer Absent: " " None I Mayor Calvo announced that the first order of business ill . would be the opening of bids for oil driLling on the water prop- erty. Mr. Buck read a copy of a teLegram received by the City Clerk, dated August 7, 1';1,56 from Lloyd Dinklespeil, Attorney ,t'or the Hellman Heirs stating tbat if any attempt to use the water 011 property for other than water purposes will cause a reverter to . the grantors. Mr. Buck also addressed a letter to the City Council relative to reversionary rigbts and opinions of the . attorneys. for both bidders. It was moved by Flanagan and seconded by Ross that the teLegram, letter 1'rom Mr. Buck and the opinions of the bidder's attorneys be received and filed. AYES. NOES. Tancre. Ross, Flanagan, Spencer, Calvo None I Motion carried. 011 A discussion folLowed relative to the probable length of a law suit, nolding check of successful bidder, special account for the check etc. Mr.'Webster speaking for Mr. Cunning- ham stated that nis people would be willing to await the decision of the Courts. Mr. WiLliam E. McFadden, representing Signal Oil, stated his company was wiLling to go along with the Council. It was moved by Ross and seconded by Spencer that the agreement will be amended to provide that there will be no entry for 'oil or gas on the property until a final decree by a court of competant jurisdiction to the effect that the lease is not a breech of the deed restrictions or until a period of twelve II months from and after the date of the execution of the agree- ment which ever event or time shall occur first. 011 AYES: NOES: Tancre, Ross, Flanagan, Spencer, Calvo None Motion car'ried. 011 Bids Oil Drilling - Signal Oil and Gas Company and Freeman Fairfield - check enclosed for $112,753.58 cash bonus, I I I r .. .1., ; 295 and signed agreement. At this point Mr. Webster asked that the bid of C. D. Cunningham be withdrawn unopened. Mayor Calvo called a ten minute recess to discuss the bid of the Signal Oil and Gas Company and to await the arrival.of officials of the Signal Oil and Gas Company. Upon reconvening the minutes of the regular meeting of July 17th and the regular adjourned meeting of July 31st were read and approved on the Mayors' motion. As no bids have been reoeived for the purohase of a police car, Mr. Marron explained that since most companies were in the process of getting ready for 1957 models, it would be better to wait and readvertise for bids. .Qll... Polic Car R~ports of the POlice, Building, License, Water and Tax Departments for the month of July 1956 were presented. It was moved by Spencer and seconded by Tancre that the City Officers reports be received and filed. AYES I NOES: Tancre, Ross, Flanagan, Spencer, Calvo None Motion carried. In reference to the oil bid, Mr. Buck stated that he had talked to officers of Signal Oil and Gas Company during the recess and that, they had stated that the bid and letter is what their intentions are and that they are willing to execute the agreement unconditionally and that the execution be in accord- ance with the notice inviting bids, the agreement and their letter of August 7, 1956. Mr. Marshall, ~ice ~resident of Signal Oil and Gas Company also addressed the Council stating Oil the same. It was moved by Spencer and seconded by Tancre to recind former motion relative to entry on the property and the .Qll... disposit~on of the check received in favor of an amended motion. AYES: NOES: Tancre, Ross, Flanagan, Spencer, Calvo None Motion carried. It was moved by Tancre and seconded by Spencer that the City accept the bid of the Signal Oil and Gas Company, and Free~n E. Fairfield in the sum of #112,753.58 in accordance with the notice inviting bids, the agreement, and the bid of Signal ~il and Gas Company and Freeman E. Fairfield, dated ,August 7, 1956, addressed to the City Council of the City of 0: O,!L 2U6 Police Dept. Ord. 495 Tax Dept. Police Dept. Seal Beach and to authorize the Mayor and City Clerk to execute the agreement in behalf of the City. and to deliver an exeouted copy, sne each to Signal Oil and Gas Company and Freeman E. Fairfield. AYES: NOES: Tancre, Ross, Flanagan, Spencer, Calvo None Motion carried. Relative to the final appointment of the new police sergeants. Harbour and Holeman, a letter of approval of the permanent appointment addressed to the City Council from the Chief of Police was read. It was moved by Flanagan and seconded by Tancre that the request of the. Chief be granted and that the sergeants be paid the new salary retroactive to I July lb, 195b. AYES: NOES: Tancre, Ross, Flanagan, Spencer, Calvo None Motion oarried. Demands numbering 4112 to 4209 inclusive, totaling $11,982.38 as approved by the Finance Committee were presented. It was moved by Tancre and seconded by Flanagan that. the demand~ be allowed and warrants drawn on the Treasury for the same. AYES. NOES: Tancre, Ross, Flan~gan, Spencer, Calvo None I Motion carried. Ordinance No. 495 (Amending Ord. 377 and Ord. 475- Traffic) was read in full by the City Attorney. It was moved by Tanore and seconded by Spencer that Ordinance No. 495 be deemed as having had its first reading and be passed to the second reading. AYES: NOES: Tancre, Ross, Flanagan, Spencer, Calvo None Motion carried. The Clerk read his certification of the petitions requesting the collection of taxes by the County. The petition was not signed by the requisite number of voters. Letter from Chief of Police Howard requesting the approv&l of the permanent appointment of Alfred Chafe and James Bradford as patrolmen. It was moved by Ross and seconded , by Tancre that the appointment of Chafe and Bradford be permanent I under Civil Service rules subject to physical examinations. AYES: NOES: Tancre, Ross, Flanagan, Spencer, Calvo None Motion carried. Letter from the Mayor of the City of Long Beach, relative to the appointment of D. M. Callis to the Long Beach Marina Advisory Committee, stating that they could not make the appointment, but that he would be welcome to attend their Meetings to keep the City Advised. Mayor Calvo will contact Mr. Callis. I City En~ineers Agenda Lions Club Fish Fry - Mr. Marron stated that he had just received a phone call requesting the use of the Sun rtoom and east parking lot on Sept. 1, 19~6 for their annual event. It was moved by Flanagan and seconded by noss to grant the request. AYES: N0ES t Tancre, Ross, Flanagan, Spencer, Calvo None Motion carried. Truck Ordinance - Several proposed ordinances were presented which the Council wished further time to study. Electric Avenue - In reference to the beautification of Electric Avenue, the Engineer stated that before any work ; 2n7 Majlina Lions Club tz'uck ord. li:lec. should be done, more planning was needed relative to a future water Ave. A line in the area. Beach - Mr. Marron stated that they were continuing I the leveling off work on the beach. It was moved by Tancre and seconded by Ross to instruct the City Attorney to contaot the Navy relative to ingress and egress to the water property for oil drilling. AYES. NOES: Tanore, Ross, Flanagan, ~pencer, Calvo None Motion carried. The adoption of the budget was discussed. Final adoption to be made next meeting. Fred Flanagan was granted a leave of absense. I Mr. Marron stated that plans for a Telephone Company Dial Station to be built south of Garden Grove Blvd., and east of County line, were in prepa~ation. Under our annexation and until otherwise notified by the S,tate or County we will issue the building permit. We will also police the area etc. Mrs. Bigelow asked the annual amount of.revenue to be derived from the Monterey Oil Co. The Clerk stated that it would be in excess of $le,OOO. I Absent I II It Flanagan Mayor Calvo appointed Tancre to serve on the Finance Committee. The minutes of the regular meeting of August 7. 1956 were read and approved on the Mayor's motion. Reports of the City Clerk and City ~reasurer for the month of JUly. 1956 were presented. It was moved by Spencer and seconded by Tancre to receive and file the City Officers reports. AYES: NOES: ABSENT: Tancre. Ross, Spencer, Calvo None Flanagan Motion carried. I Demands numbering 4210 to 4270 inClusive, totaling $12,075.04 as approved by the Finance Committee were presented.
