Crumby, Assistant City Manager/Public Works SUBJECT: NOTICE OF COMPLETION FOR COLLEGE PARK EAST SEWER REHABILITATION PROJECT NO. SS0901 SUMMARY OF REQUEST: It is requested that the City Council: 1. Adopt Resolution No. 6241 accepting the completed project by Charles King Company for $2,950,961.17 to rehabilitate sewer lines in College park East, CIP No. SS0901. 2. Direct the City Clerk to file a "Notice of Completion" with the Orange County Clerk-Recorder within ten (10) days from the date of acceptance and to release retention in the amount of$295,096.12 in 35 days. BACKGROUND AND ANALYSIS: On August 8, 2005, the City adopted the 2005 Sewer System Master Plan Update, which identified over $15 million in required Capital Improvement Projects. At the June 27, 2011 City Council Meeting, Council awarded a construction contract for the College Park East Sewer Rehabilitation project No. SS0901 to the lowest bidder, Charles King Company, Inc. for $2,424,356.00. This project was to increase the capacity on Elder Avenue from Heather Street to Ironwood Avenue, on Aster Street from Birchwood Avenue to Basswood Avenue, and on Basswood Avenue from Aster Street to Lampson Avenue. The project would also repair various sewer pipes and manholes as identified in the 2005 Sewer System Master Plan Update. These repairs consist of replacing Vitrified Clay Pipe (VCP), sewer lateral reconnections, manhole modifications and repairs, lining of existing 8-inch and 6-inch sewer mains, bypass pumping, traffic control, and extensive dewatering. After the sewer pipe work is completed, the project would also resurface effected streets with new asphalt pavement. Agenda Item H Several change orders were encountered on the project; most were requested by the City during construction. Most change orders came from finding unmarked utilities while installing the sewer lines or from modifying the sewer lining and manhole lining sections of the contract. One large change order is detailed in the Financial Impact section of this staff report. This change order is for the repaving of Elder Avenue. The original plans called for a modified grind and cap of Elder. However, during construction, the conditions of the subgrade of Elder Avenue were much worse than the original samples indicated, and a full reconstruction had to be performed. The change order reflects the cost to reconstruct Elder Avenue minus the cost to grind and cap Elder as originally bid. The work is now complete to the satisfaction of the City Engineer. The contractor, Charles King Company Inc. did a remarkable job performing the work while seamlessly working with the local residents in order to minimize the impacts during the construction. ENVIRONMENTAL IMPACT: On March 26, 2009, the Initial Study/Mitigated Negative Declaration was approved. This project complies with all requirements of the California Environmental Quality Act (CEQA). LEGAL ANALYSIS: No legal analysis is required for this item. FINANCIAL IMPACT: This project is funded through a loan from the State Revolving Fund Financing program and will not impact the General Fund. The City has the ability to borrow up to $10,000,000. To date, to agreements have been secured against the $10,000,000. They are: Finance Agreement No. 10-838-550 "College Park East" for $2,650,000 and Finance Agreement No. 10-842-550 "Southern City" for $1,100,000. These loans are "soft" and give the City the ability to modify them should the cost of these projects vary significantly. The loan financing will be paid off by the Sewer Capital Fund. The Sewer Capital Fund will be drawn down over a period of years and as needed to support the various sewer projects. SS0901 WHEREAS, on June 27, 2011 the City of Seal Beach entered into a contract with Charles King Company, Inc.; and WHEREAS, the City Engineer has determined that the work has been substantially completed in accordance with the contract documents. NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE: Section 1. That the work required to be performed by Charles King Company, Inc. has been completed. Section 2. That the total cost of amount to be paid to Charles King Company, Inc. is$2,950,961.17 for the work performed. Section 4. That the work is hereby accepted and approved. Section 5. It is further ordered that a"Notice of Completion" be filed on behalf of the City in the Office of the Orange County Recorder within 10 days of the date of this resolution.
