March 21, 2012
Chair Massa-Lavitt called the regular meeting of the Planning Commission to
order at 7:30 p.m. on Wednesday, March 21, 2012. The meeting was held in the
City Council Chambers and began with the Salute to the Flag led by
Commissioner Galbreath.
ROLL CALL

AGENDA APPROVAL
Cummings moved to approve the agenda as presented, all commissioners voted
in favor of the motion.

NOES: None Motion Carried
ORAL COMMUNICATIONS
Chair Massa-Lavitt opened oral communications. Speakers: Darlene Cahoon,
Surfside resident, questioned if her comments should be made during the public
hearing. There being no other speakers, Chair Massa-Lavitt declared oral
communications closed.
CONSENT CALENDAR
Galbreath moved, second by Everson, to approve the recommended action on
the consent calendar.

PUBLIC HEARING
3. Minor Use Permit 12-3
B-86 Surfside Avenue
Applicant/Owner: Art Patino/Renee Depeso
Request: To construct a Non-Habitable Architectural Feature in
excess of the 35-foot height limit. Specifically, the
applicants propose to construct an approximately 9'-
9" by 9'-10" Covered Roof Access Structure (CRAS)
to exceed the height limit by approximately 2'-0"; 7
feet is the maximum height allowed beyond the height
limit. Only a portion of the CRAS and patio cover will
exceed the height limit.
Recommendation: Approve Minor Use Permit 12-3, subject to conditions,
through the adoption of Resolution 12-4.
The Senior Planner delivered the staff report —due to the sloping of the roof, the
square footage that exceeds the height limit would be less than the 9'-9" by 9'-
10" footprint at the roof deck level — the applicant has previously applied for a
CRAS and covered roof patio (Minor Use Permit denied without prejudice).
Commission Inquiries:
• Commissioner Cummings: inquired whether Surfside Architectural Review
Committee has approved these plans as submitted — committee has
approved; inquired about correspondence received for this matter — no
correspondence has been received regarding this matter.
Chair Massa-Lavitt opened the public hearing. Speakers: Arthur Patino,
applicant/owner, explained that his revised plans were approved by the Colony
and those plans were then forwarded to the City for approval tonight; Darlene
Cahoon, Surfside resident and former Surfside Colony board member, reiterated
the notion that the residents who are opposed to a CRAS is primarily because of
view obstruction — is personally in favor of the aesthetics of applicant's proposed
CRAS, opposes the size/square footage of CRAS, and would like same
consideration in the future; Arthur Patino provided his rebuttal that he did not
complain when his neighbors built their homes and his views were lost. There
being no other speakers, Chair Massa-Lavitt closed the public hearing.
Commission discussion/comments:
• Commissioner Goldberg: received clarification regarding the stairway
landing — additional footage needed to provide clearance for doorway due
to slope of roof; questioned whether footprint was minimal for the slope

roof design — it is minimal based on this type of roof, alternatives may
diminish architectural aesthetics.
• Commissioner Galbreath: received clarification regarding 35 feet height
limit in Surfside — height limit is by right, but through a Minor Use Permit,
limit may be exceeded by up to 7 feet for non-habitable architectural
features.
• Commissioner Everson: commented that these plans are an improvement
from ones previously submitted; believes square footage of CRAS is
minimum required for this design, and views alternative of a flat roof
design as obscuring more views.
Motion by Everson, second by Cummings, to Approve Minor Use Permit 12-3,
subject to conditions, through the adoption of Resolution 12-4.

The Assistant City Attorney stated the Planning Commission decision to approve
Minor Use Permit 12-3 through adoption of Resolution 12-4 is a final decision of
the Planning Commission - there is a 10 day period to appeal this decision to the
City Council —the appeal period will begin tomorrow morning (03/22/12).
DIRECTOR'S REPORT
The Senior Planner announced that the City Council will consider the Draft
Housing Element on April 10th; reported on plan submittals received by
Development Services department — former Shorehouse Cafe (demolition permit
is in the process, will be converted into additional parking spaces), Sofa U Love
building (plans to remodel to an eye clinic); there are no items currently
forecasted for the April meetings.
Commissioner Cummings inquired about Fresh & Easy settling in — Lynda
Krueger, 8th Street, provided an update regarding the new grocery store and
commented on concerns.
COMMISSION CONCERNS
Commissioner Goldberg questioned whether the EIR for the DWP is still
scheduled for April 2"d (Final EIR is scheduled to be released on April 2nd) ;
Commissioner Cummings stated concerns regarding the vegetation along the
entry road at In-N-Out; Commissioner Galbreath inquired if there were any
updates regarding the STATS and Rite-Aid buildings (no updates to provide);
Commissioner Massa-Lavitt remarked that, in regards to In-N-Out, she believes
Commission should be clearer in the future when discussing vegetation meant to
obscure line of sight.
