DRAFT RESOLUTION ADOPTING GENERAL PLAN
AMENDMENT 11-1
RESOLUTION NUMBER 6274
A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
ADOPTING GENERAL PLAN AMENDMENT 11-1 TO
DESIGNATE A PORTION OF THE DWP SPECIFIC PLAN AREA
AS RESIDENTIAL AND DIRECTING THE CITY CLERK TO
MAKE CORRESPONDING CHANGES TO THE GENERAL PLAN
IN CONNECTION THEREWITH
THE SEAL BEACH CITY COUNCIL HEREBY FINDS, DETERMINES
AND RESOLVES:
Section 1. Bay City Partners ("Applicant") has submitted an application
to amend the Department of Water and Power Specific Plan ("Specific Plan") to
allow residential uses on the property commonly known as the DWP site ("site")
in the City of Seal Beach ("City") on the northerly 4.5 acres of the site. The
existing Specific Plan designation of open space for the southerly portion of the
site would remain unchanged for 6.4 acres of the site. In order to ensure
consistency between the Specific Plan and the City's General Plan, certain
amendments to the General Plan are required.
Section 2. On June 6, 2012, the Planning Commission recommended
that the City Council approve General Plan Amendment 11-1.
Section 3. On June 25, 2012, the City Council held a public hearing to
review the project pursuant to the California Environmental Quality Act, Cal. Pub.
Res. Code § 21000 et seq. ("CEQA"), the State CEQA Guidelines, 14 C.C.R. §
15000 et seq. and Seal Beach Municipal Code ("SBMC") Chapters 11.5.35 and
11.5.15.
Section 4. Upon the close of the public hearing, the City Council
adopted Resolution No. 6273, certifying an Environmental Impact Report ("EIR")
and making findings in connection therewith. Resolution No. 6273 and the
findings therein are hereby incorporated by this reference as though set forth in
full.
Section 5. The General Plan Land Use Map currently depicts the site
as Open Space and the text of the General Plan states that the property can be
developed in accordance with the DWP Specific Plan with a visitor serving hotel
on the northerly portion of the DWP site and open space on the southerly portion
of the site. The General Plan would therefore have to be amended to ensure that
the project is consistent with the General Plan.
Section 6. Based on the foregoing, the City Council hereby adopts
General Plan Amendment 11-1 to amend the Land Use Element of the Seal
Beach General Plan as follows:
a. The three paragraphs following the heading, "Los Angeles
Department of Water and Power Specific Plan," on page LU-13 of the Land Use
Element are amended to read as follows:
"Formerly the location of a large power plant for the Los Angeles
Gas and Electric Company (now the Department of Water and
Power or DWP), this site has an excellent view of the Long Beach
Marina and northern coastline as far north as Palos Verdes.
Considering these positive factors in combination with high land
value (attributed to location and access), this site has potential for
visitor-serving open space and residential use.
"Access for pedestrians and cyclists to the river's edge and along
the entire length of the San Gabriel River from Westminster Avenue
to the beach, including this site, will be maintained.
Resolution Number 6274
"To provide a comprehensive plan for this area, in 2012, the City
revised the Department of Water and Power Specific Plan, which
establishes the land uses and general development standards for
this area. Residential uses are limited to the northerly portion of the
DWP site with permitted uses including single unit residential
subject to the same development standards as the rest of Old Town
Seal Beach. The lower portion of the site is designated for open
space uses such as public parks, greenbelts, bike, and nature
trails, and other passive recreational uses. The boundary of the
Los Angeles Department of Water and Power Specific Plan is
depicted in Land Use — Figure 9 on page LU79 at the end of this
element."
b. The bulleted paragraphs following the heading, "Los Angeles
Department of Water and Power Specific Plan," on page LU-40 of the Land Use
Element are amended to read as follows:
• Provide a comprehensive plan for this area by providing for a
mix of visitor-serving open space and residential use.
• Limit residential uses to the northern portion of the DWP site
with permitted uses including single unit residential.
• Designate the southern portion of the site for open space
uses such as public parks, greenbelts, bike, and nature
trails, and other passive recreational uses."
c. "Land Use— Figure 1 — Planning Area 1 Land Use Map" in
the Land Use Element of the Seal Beach General Plan is amended to reflect the
changes to the Specific Plan area boundaries set forth in DWP Specific Plan
Amendment 11-1 and Zoning Map Amendment 11-1, and to designate as
Residential High Density that area of the DWP Specific Plan approved for
residential use. The City Clerk is hereby authorized and directed to take all steps
necessary to implement these amendments.
d. "Land Use — Figure 9 — Los Angeles Department of Water
and Power Specific Plan" in the Land Use Element of the Seal Beach General
Plan is amended to correspond to DWP Specific Plan Amendment 11-1 and
Zoning Map Amendment 11-1. The City Clerk is hereby authorized and directed
to take all steps necessary to implement this amendment.
e. Tables 2 and 3 on pages LU-50, LU-51 and LU-53 of the
Land Use Element, which set forth the overall land use acreage for the City, are
amended to reflect the open space and residential portions of the Project.
Section 7. The Land Use Element of the General Plan, as amended by •
General Plan Amendment No. 11-1, is consistent with the other Elements of the
General Plan. Insofar as other portions of the General Plan need to be revised to
effectuate General Plan Amendment 11-1, the City Clerk is hereby authorized
and directed to make all necessary revisions to effectuate this amendment.
Section 8. This Resolution shall not go into effect unless and until the
City Council also approves Specific Plan Amendment 11-1, Zoning Map
Amendment 11-1, and TTM 17425 and those approvals become effective.
Section 9. The City Clerk shall certify to the passage and adoption of
this Resolution.
