ST1104 SUMMARY OF REQUEST: It is requested that the City Council adopt Resolution No. 6307: 1. Accepting 2012 Annual Concrete Repair Program Project No. ST1104 by Mora's Equipment & Construction, Inc. in the amount of $47,341.76; 2. Directing the City Clerk to file a "Notice of Completion" with the Orange County Clerk-Recorder within ten (10) days from the date of acceptance and to release retention in the amount of$2,367.09 in 35 days; and 3. Amending the contract with Mora's Equipment & Construction, Inc. to $47,341.76 and direct the City Manager to execute the contract amendment. BACKGROUND AND ANALYSIS: At the April 9, 2012 City Council meeting, the City Council awarded a contract to Mora's Equipment & Construction, Inc. for the 2012 Annual Concrete Repair Program Project No. ST1104 in the amount of$46,925.00. The 2012 Annual Concrete Repair Program Project No. ST1104 includes repairs identified within the 2009 Citywide Concrete Inspection Report (Report). This Report identified concrete rehabilitation needs throughout the City such as sidewalks, driveways, curb and gutter. In 2010, the City completed the first phase of the improvements beginning with the highest severity displacements and temporary asphalt repairs. This project is the second year of the program. The priorities of the concrete were modified since the plan was adopted, and the funding level has been reduced from $200,000 to $50,000 annually. The master plan will be amended and brought forward to the City Council with the FY 12-13 Annual Concrete Program. Agenda Item M A change order was encountered for mobilizing and demobilizing of sawcutting equipment at various times during the construction project. This change order was City initiated due to adding additional concrete repair locations. The project is now complete to the satisfaction of the City Engineer. The project was inspected and it meets all standards and requirements within the project specifications. It is required to formally accept the project and file a notice of completion with the Orange County Clerk. ENVIRONMENTAL IMPACT: This project has complied with the California Environmental Quality Act. LEGAL ANALYSIS: The City Attorney has review and approved this action. FINANCIAL IMPACT: In the approved FY 2011-12 Budget $50,000 is budgeted for the 2012 Annual Concrete Repair Program Project No. ST1104. Below is a summary and breakdown of expenses for the project: Estimated Amount Expenses Design (In House) $ 0 Construction $ 44,015.00 Change Orders $ 3,326.76 Inspection $ 2,470.00 Total $ 49,811.76 The total cost of amount paid to Mora's Equipment & Construction, Inc. for construction/change orders is $47,341.76. These expenditures will be paid out of the FY 2011/12 budget. RECOMMENDATION: It is recommended that the City Council adopt Resolution No. 6307: 1. Accepting 2012 Annual Concrete Repair Program Project No. ST1104 by Mora's Equipment & Construction, Inc. in the amount of $47,341.76; and Page 2 2. ST1104 WHEREAS, on April 9, 2012 the City of Seal Beach entered into a contract with Mora's Equipment&Construction, Inc.; and WHEREAS, the City Engineer has determined that the work has been substantially completed in accordance with the contract documents. NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE: Section 1. That the work required to be performed by Mora's Equipment & Construction, Inc. has been completed and accepted. Section 2. That the total cost of amount to be paid to Mora's Equipment & Construction, Inc. is$47,341.76 for the work performed. Section 3. That the City Council hereby amends the contract with Mora's Equipment & Construction, Inc. to $47,341.76 and direct the City Manager to execute the contract amendment. Section 4. That a "Notice of Completion" be filed on behalf of the City in the Office of the Orange County Recorder within 10 days of the date of this resolution.
