The City Council of the,City of Seal Beach. California met in regular session at 8:00 P.M. with Mayor Shufelt presiding. -Meeting was called to order with the salute to the Flag. Present: Mayor Shufelt Councilmen:' Bowen. Lawhead. Leonard. Webster Absent: ,~ " None The first order of business was the opening of sealed bids as advertised for a four door sedan to be used by the Police Depart- ment. Bids from Campbell Buick COMpany. Long Beach. and Main Street Garage. Huntington Beach. were received and 6~enad. It was moved by Leonard. seconded by Webster that the bid of Hain Street Garage for one (1) 1954 Hudson '~HornetIt6. 4 Door Sedan (165 H.P.) at t3.187.03 less $l.L~OO.OO trade in allowance for 1951 Hudson. for a net tot81l of $1.787.03 be accepted. AYES: NOES: Bowen. Lawhead. Leonard. Webster, Shufelt None Hotion carried. The minutes of the regular meeting of August 18. 1953. were read and approved as corrected on the ~~yorls motion. Survey Fund Committee. held August 10. 1953 at Hun~ington Beach were read and ordered received and filed. The request of the Pacific Electric Railway Co. for the renewal of lease No. 9043 for use of their right-of-way for sewer lines at $16.75 per y.ear for the period of Oct. 1. 1953 to Sept.30. 19$8 inclusive. was presented. It was Moved by Bowen. seconded by Lawhead that the Mayor and City Clerk be instructed to execute the lease and that the annual rental fee be allowed. AYES: NOES: Bowen. Lawhead. Leonard. Webster. Shufelt None Motion carried. A protest signed by David H. Connell and 19 other residents against the erection of a billboard at Central and Bolsa waB~ read. City Administrator Harry Logans' letter to the United Outdoor Adver- tising Co. ordering the removal of the billboard Was also read. Both letters were ordered received and filed. Reports of the Police. Tax. Water and Building Departments for the month of August. 1953 were presented. It was moved by Bowen ~ 3C8 Reso. 817 Police Dept 5 day Dept Head chg. Demands No. 340 to 442 inclusive. totaling $10.807.99 as approved by the Finance Committee were presented. Resolution No. 817 (Adjusting Certain Salaries) was presented by the City Attorney. It was moved by Webster. second- ed by Bowen that Resolution No. Bli7 be adopted. AYES: NOES: Bowen. Lawhead. Harry Logan, City Administrator. requested that auth- ority be granted the Police DepartMent for a five (5) day work . week and presented a work schedule for the Department. Dana Williams. special legal counsel for Seal Beach. in the matter of the Honterey Oil Co~ (Island Drilling) gave a COMplete report on the case. The decision as rendered by th& District Court of Appeals deprives Seal Beach of jurisdiction over submerged lands. tide lands a nd the surface of the ocean I within'-.the city limits. which are vested in the State of Calif- ornia. Mr. Williams also stated that the court did not decide on the validity of Ord. No. 2)0 with respect to oil drilling in . other upland areas of the City. He advised the COlmcll that III petition for rehearing could be filed in the District Court of Appeals and if denied. the City could then petition the Supreme Court for a hearing. I Eros- ion I I 3G9 After considerable discussion with Mr. Williams by both the Council and members of the audience. it was ~oved by Bowen. seconded by Leo~a~d. that Mr. Williams and Mr. Stratton be author- ized to do all things necessary to petition the.District Court of Appeals for a rehearing and also petition the Suprem~ Court for a hearing~~f necessary. AYES: NOES: Bowen. Lawhead. Leonard. Webster. Shufelt None Motion carried. Mayor Shufelt told of a Meeting in Santa Ana. August 24th with Congressman James Utt. Willis Warner. Jack Woolley and Captain J. R. McKinney to discuss the erosion problem and to hear from Mr. Utt in regard to legislation relative to the erosion problem. Mr. Utt s~ated the economy drive in Washington kept the bill from being acted upon. At the request of the City of Seal Beach and the Cotmty of . Orange. the County Board of Supervisors have Made a direct appeal to the ~avy Department for emergency relief. The sug~ested plan is the placing of additional rock along the jetties. which tend to break up the damaging wave effects. PreliMinary estiMate of'cost to be about $52.000.00. It is believed this plan will not only protect our beaches but also will protect the naval installations.
