MULLER INTERNATIONAL Bridge Consulting Engineers 2295 Gateway Oaks Drive, #140 Sacramento CA 95833 (hereinafter "Consultant") for MARINA DRIVE BRIDGE, 040-49676-044 Contract No. 98003 • • PROFESSIONAL SERVICES AGREEMENT THIS AGREEMENT, is made and entered into this a day oft,aj ,/991by and between., the CIT OV SEAL BEACH (hereinafter cal d' "City"), and aziet_aei o40tereinafter called"Consultant"). RECITALS WHEREAS, City is a municipal corporation duly organized and validly existing under the laws of the State of California as a Charter City, with the power to carry on its business as it is now being conducted under the Statues of the State of California and the Charter of the City; and WHEREAS, the City requires the services of a Consultant to provide the professional services as described in the Scope of Services; WHEREAS, the Consultant is able and willing to perform the required services under the terms and conditions of this Contract; NOW, THEREFORE, the parties do mutually agree as follows: SECTION 101 101.1 CONSULTANT SERVICES. Consultant, as an independent contractor, agrees to perform during the term of this Agreement, each and every service set forth on the "Scope of Services" attached to this Agreement as Exhibit "A". The initiation of service by the Consultant will commence upon receipt of a written notice from the Designated Official authorizing Consultant to proceed, and only to the extent of such authorization. The services of the consultant shall include the making of all investigations, studies, and analysis required by the conditions involved in each request of the Designated Official. 101.2 TIME OF PERFORMANCE. Consultant shall complete all services set forth in "Schedule", Exhibit C, Schedule. The foregoing time schedule may be modified by the mutual written consent of the parties hereto. 101.3 COMPENSATION. The City will pay for the services of Consultant as indicated on the "Schedule of Compensation" which is set forth in Exhibit `B". No payment for expenses or labor shall be paid by City unless it is related to a service which is referred to in the "Schedule of Compensation". The total cost to the City shall not exceed the amount designated in Exhibit `B", without the written approval and authorization of the City Council. 101.4 PAYMENT. The City will pay for services of the Consultant according to the progress payments schedule established in the Schedule of Compensation. City's payment to Consultant 1 da shall be made within thirty (30) days of the date of completion of each phase as set forth in the progress schedule. 101.5 INDEPENDENT CONTRACTOR. Consultant and its subcontractor(s) shall act hereunder as independent contractors, and shall have no power to incur any debt or obligation for City. Neither City or any of its officers or employees shall have any control over the conduct of Consultant, or any of Consultant's employees or subcontractor, except as herein set forth, and Consultant expressly warrants no to, at any time or in any manner, represent that it, or any of its agents, servants, subcontractors or employees, are in any manner agents, servants or employees of City, it being distinctly understood that Consultant is and shall at all times remain to City a wholly independent contractor and Consultant's obligations to City are solely such as are prescribed by this Agreement. 101.6 ASSIGNMENT. This Agreement may not be assigned in whole or in part, without the prior written consent of City. 101.7 DOCUMENT OWNERSHIP. Each and every report, draft, instrument of service, map, record, and other document reproduced, prepared, or caused to be prepared by the Consultant pursuant to or in connection with this Agreement shall be the exclusive property of the City. City acknowledges and agrees that all reports, drafts, instruments of service, maps, records, and other documents prepared by Consultant pursuant to this Agreement shall be used exclusively on this project and shall not be used for any other work without the written consent of Consultant. In the event City and Consultant consent permit the reuse or other use of the reports, drafts, instruments of service, maps, records, and other documents, City shall require the party using them to indemnify and hold harmless City and Consultant regarding such reuse or other use, and City shall require the party using them to eliminate any and all references to Consultant from the reports, drafts, instruments of service, maps, records, and other documents. This paragraph shall not restrict the duties of the City under the public records act. 101.8 CITY LIASON. Consultant shall perform under the general supervision of the Director of Public Works of City or his designee, and all communications, instructions and directions on the part of the City shall be communicated exclusively through the Director of Public Works or his designee. 101.9 PERSONNEL. Consultant represents that it has, or shall secure at its own expense, all personnel required to perform Consultant's services under this Agreement. Consultant may associate or employ associates or subcontractors in the performance of it services under this agreement, but all times shall be responsible for their services. 101.10 INSURANCE. Consultant shall procure at its sole expense and maintain in force throughout the entire term of the Agreement insurance as indicated below. Consultant shall submit to City certificates indicating compliance with the following minimum insurance requirements not less than one day prior to the beginning of performance of this Agreement. 2 • Statutory Workers' Compensation Insurance with Employer's Liability in an amount not less than $1,000,000 covering all employees of Consultant performing services under this Agreement. Comprehensive Commercial Liability Insurance including Blanket Contractual Liability and Broad Form Property Damage coverage in an amount not less than $1,000,000 combined single limit of liability. Business Auto Liability Insurance including coverage for Hired and Non-owned Autos in an amount not less than $1,000,000 combined single limit of liability. Professional Liability Insurance in an amount not less than $1,000,000 each occurrence and annual aggregate covering any negligent act, error or omission of the Contractor for services performed under this Agreement. 101.11 MISCELLANEOUS INSURANCE REOUIREMENTS. 101.11.1 Contractor's Insurance Primary. In the event of claim or loss, any insurance purchased by the Contractor shall be primary. The City's insurance shall not contribute with Contractor's in the settlement or payment of any loss or claim. 101.11.2 Policy Requirements. Each policy of insurance shall: 1. Be issued by an insurance company which is an admitted insurer in the State of California. 2. Specify that it acts as primary insurance. 3. Name and list as additional insured the City, its officers, agents, and employees except for the Professional Liability Insurance and Worker's Compensation Insurance. 4. Contain a clause substantially in the following words, "It is hereby understood and agreed that this policy shall not be canceled or materially changed except upon thirty (30) day's prior written notice to the City of Seal Beach of such cancellation or material change a evidenced by a return receipt for a registered letter." 101.11.3 Evidence of Insurance. The Contractor shall provide the City with Certificates of Insurance evidencing each of the coverage's procured to satisfy the requirements of this Agreement. 101.11.4 Failure to Secure. If the Consultant at any time during the term hereof should fail to secure or maintain the foregoing insurance, City shall be permitted to obtain such insurance in the Consultant's name or as an agent of the Consultant and shall be compensated by the Consultant for the costs of the insurance premiums at the maximum 3 rate permitted by law computed from the date written notice is received that the premiums have been paid. 101.11.5 Subrogation Waiver. Consultant agrees that in the event of loss due to any of the perils for which it has agreed to provide insurance, that the Consultant shall look solely to its insurance for recovery. Consultant hereby grant to City, on behalf of any insurer providing insurance to either Consultant or City with respect to services of Consultant herein, a waiver of any right of subrogation which any such insurer of said Consultant may acquire against City by virtue of the payment of any loss under such insurance. 101.12 INDEMNIFICATION. Consultant shall indemnify the City and its officers, employees and agents against, and will hold and save them and each of them harmless from, any and all actions, claims, damages to persons or property, penalties, obligations or liabilities that may be asserted or claimed by any person, firm, entity, corporation, political subdivision or other organization arising out of the negligent or intentional tortious acts, errors or omissions of Consultant, its agents, employees, subcontractors, or invitees. Consultant will defend the City, its officers, agents and employees from and against any action or actions filed in connection with any of said claims, damages, penalties, obligations or liabilities and will pay all costs and expenses, including attorney's fees for counsel of City's choice incurred in connection herewith; Consultant will promptly pay any judgment rendered against the City, its officers, employees or agents for any such claims, damages, penalties, obligations or liabilities: In the event , its officers, employees or agents is made a party to any action or proceeding to any action or proceeding filed or prosectued against Consultant for such damages or other claims arising out of or in connection with the sole negligence of Consultant hereunder, Consultant agrees to pay City, its officers, employees or agents, any and all costs and expenses incurred by City, its officers, employees or agents in such action or proceeding, including but not limited to, reasonable attorney's fees. 101.13 TERMINATION OF AGREEMENT. This Agreement may be terminated without cause by City upon ten (10) days' written notice to the Consultant without further action by the City. This Agreement may be terminated by the Consultant upon thirty (30) days' written notice to the City. In the event the City terminates this Agreement as provided above, Consultant shall terminate work at the earliest possible point, and complete all attendant reports and/or graphic representations, conceptual plans, construction plan, or construction specifications. The City shall compensate the Consultant proportionately for work, provided such work is in a form useable to the City. Notice. Any notice required to be given to the Consulant shall be deemed duly and properly given upon mailing, postage prepaid, to: (Insert Address) 4 • or personally delivered to Consultant at such address or other address specified to the City in writing by Consultant. Any notice required to be given to the City shall be deemed duly and properly given upon mailing, postage prepaid, to: Attn: Director of Public Works City of Seal Beach 211 Eighth Street Seal Beach CA 90740 or personally delivered to City at such address or address specified to the Consultant in writing by the City. 101.14 STANDARD OF PERFORMANCE. The Consultant shall perform and require its Subcontractors to perform the Services in accordance with the requirements of this Agreement and in accordance with professional standards of skill, care and diligence adhered to by firms recognized for their expertise, experience and knowledge in performing services of a similar nature. The Consultant shall be responsible for the professional quality, technical accuracy, completeness, and coordination of the Services, it being understood that the City will be relying upon such professional quality, accuracy, completeness, and coordination in utilizing the Services. The foregoing obligations and standards shall constitute the "Standards of Performance" for the purposes of this Contract. The Consultant shall carefully study this Contract, shall verify all figures in these Contract Documents before performing the Services; shall promptly notify the City of all errors, inconsistencies, and/or omissions that it discovers; and, in instances where such non-conformities are discovered, shall obtain specific instructions in writing from the City before Consultant's proceeding with the Services. My Services affected which are performed prior to the City's decision shall be at the Consultant's risk. The Consultant shall not take advantage of any apparent non-conformity that may be found in this Contract. The City shall be entitled to make such corrections therein and interpretations thereof as it may deem necessary for the fulfillment of the intent of this Contract. Omissions or misdescriptions of any Services that are manifestly necessary to carry out the intent of this Contract, or that are customarily performed, shall not relieve the Consultant from performing such Services at no additional expense and/or delay, and such Services shall be performed as if fully and correctly set forth in this Contract. 101.15 WARRANTY. The Consultant warrants that all Services shall be in accordance with this Contract and shall comply with the Standard of Performance for a period of one year from final acceptance of the Services. In the event of breach of this warranty, the Consultant shall take the necessary actions to correct the breach and the consequences thereof, at the Consultant's sole expense, in the most expeditious manner as permitted by existing circumstances. If the Consultant 5 • does not promptly take steps to correct the breach upon notification thereof by the City, the City without waiving any other rights or remedies it may have at law or otherwise, may do or cause others to do so, and the Consultant shall promptly reimburse the City for all expenses and costs incurred in connection therewith. 101.16 DATA AND SERVICES TO BE FURNISHED BY CITY. Consultant shall deliver to the City the studies, plans, specifications, or other documents as are identified in the Scope of Services; and Consultant shall upon completion of all work, submit to the City all information developed in the course of the Consultant's services. Consultant shall, in such time and in such form as the City may require, furnish reports concerning the status of services required under this Agreement. Consultant shall, upon request by City and upon completion or termination of this Agreement, deliver to the City all material furnished to Consultant by the City. 101.17 CONFIDENTIALITY. Consultant shall not disclose, publish, or authorize others to disclose or publish, design data, drawings, specifications, reports, or other information pertaining to the projects assigned to consultant by the City or other information to which the consultant has had access during the term of this agreement without the prior written approval of the designated Official during the term of this Agreement and for a period of two (2) years after the termination of this agreement. 101.18 RECORDS. Consultant shall maintain complete and accurate records with respect to sales, costs, expenses, receipts, and other such information required by the City or the Designated Official. The Consultant shall maintain adequate records on services provided in sufficient detail to permit an evaluation of services. All such records shall be maintained in accordance with generally accepted accounting principles and shall be clearly identified and readily accessible. Consultant shall provide access to the Designated Official or his designees at all proper times to such books and records, and gives the Designated Official or his designees the right to examine and audit such books and records and to make transcripts as necessary, and to allow inspection of all work, data, documents, proceedings, and activities related to this Agreement. 101.19 ASSIGNMENT. This agreement is personal to the Consultant and the Consultant's Representative. Any attempt at assignment by the Consultant shall be void unless approved in writing by the Designated Official. Consultant's services pursuant to this Agreement shall be provided by the Consultant's Representative or directly under the supervision of the Consultant's Representative and Consultant shall not assign another to supervise the Consultant's performance of this Agreement without the prior written approval of the City, by and through the designated Official. 101.20 SAFETY REQUIREMENT. All work performed under this Agreement shall be performed in such a manner as to provide safety to the public and to meet or exceed the safety standards outlined by CAL-OSHA. The City reserves the right to issue restraint or cease and desist orders to the Consultant when unsafe or harmful acts are observed or reported relative to the performance of the work under this agreement. The Consultant shall maintain the work sites free of hazards to persons and property resulting from its operations. Any hazardous condition 6 • • noted by the Consultant which is not the result of his operations shall be immediately reported to the City. 101.21 NUISANCE. Consultant shall not maintain, commit, or permit the maintenance or commission of any nuisance in connection with the performance of services under this Agreement. 101.22 PERMITS AND LICENSES. Consultant, at its sole expense, shall obtain and maintain during the term of this Agreement, all appropriate permits, licenses, and certificates that may be required in connection with the performance of services under this Agreement. 101.23 CONFLICT OF INTEREST. Consultant covenants that neither consultant, nor any officer thereof, has any interest, nor shall they acquire any interest, directly or indirectly which will conflict with in any manner or degree with the performance of the Consultant services under this Agreement. Consultant further covenants that in the performance of this Agreement, no person having any such interest shall be employed by Consultant. Consultant further covenants that Consultant has not contracted with nor is the Consultant performing any services directly or indirectly, with any developer and/or property owners and/or firms, and/or partnerships owning property in the City, and further covenants and agrees that Consultant and/or its subcontractors shall provide no service or enter into any contact with the Developer and/or property owner and/or firms, and/or partnerships owning property in the City prior to the completion of this Agreement. 101.24 WAIVER. A waiver by the City of any breach of any term, covenant, or condition contained in this Agreement shall not be deemed to be a waiver of any subsequent breach of the same or any other term, covenant, or condition contained in this Agreement whether of the same or different character. 101.25 COST OF LITIGATION. If any legal action is necessary to enforce any provision of this Agreement or for damages by reason of any alleged breach of any provisions of this Agreement, the prevailing party shall be entitled to receive from the losing party all costs and expenses in such amount as the court may determine to be reasonable. In awarding the cost of litigation, the court shall not be bound by any court fee schedule, but shall, if it is in the interest of justice to do so, award the full amount of costs, expenses, and attorneys' fees paid or incurred in good faith. 101.26 SEVERABILITY. If any part, term, or provision of this Agreement shall be held illegal, unenforceable, or in conflict with any law of a federal, state, or local government having jurisdiction over this Agreement, the validity of the reminding portions or provisions shall not be affected by such holding. 101.27 INTEGRATED CONTRACT. This Agreement represents the entire Agreement between the City and the Consultant and all preliminary negotiations and agreements are deemed a part of this Agreement. No verbal agreement or implied covenant shall be held to vary the provisions of this Agreement. This Agreement shall bind and inure to the benefit of the parties to this Agreement and any subsequent successors and assigns. 7 • • 101.28 CHOICE OF LAW . The terms of this Agreement shall be interpreted according to the laws of the State of California. 8 • • • Contract Amendments The following Contract Amendments shall be incorporated as part of the Consultant Agreement. 1. The performance period in the agreement, "Section 101.2, Time of Performance", Section 101.2 shall be deleted and replaced with: "This contract shall begin on May 18, 1998, contingent upon approval by the City of Seal Beach, and the contractor shall commence work after notification to proceed by the City's Contract Administer. The contract shall terminate on May 18, 2001, unless extended by contract amendment. " 2. The method of payment in the agreement, "Section 101.3 Compensation" shall be deleted and replaced with: a. "The City of Seal Beach shall reimburse the consultant based on the hourly rates specified in the Contractors Cost Proposal(Exhibit B) not to exceed the contract amount of$481,204.00. The hourly rates are all inclusive for the prime contractor and the subconsultants; direct labor, fringe benefits; overhead and profit are built into the firm fixed hourly rate. For other direct costs, these costs will be based on actual costs. " b. "Any contract in excess of$25,000 entered into as a result of this contract, shall contain all the provisions stipulated in this contract to be applicable to subcontractors. " c. "Code of Federal Regulations (CFR) 48 Chapter 1, Part 31 shall be used to determine the allowahility of the individual items of cost". d. "The contractor agrees to comply with federal procedures in accordance with CFR 49, Part 18, Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments. " e. "Any costs for which payments have been made to the contractor, which are determined by subsequent audit to be unallowable under CFR 48, Chapter 1 Part 31 or CFR 49, Part 18, are subject to repayment by the contractor to the City of Seal Beach, the State, and the Federal Government. " f. "Any contract in excess of$25,000 entered into as a result of this contract, shall contain all the provisions stipulated in this contract to be applicable to subcontractors. " 3. The records retention and audit provisions "Section 101.18, Records", shall be replaced with the following • • a. "For the purpose of determining compliance with the Public Contract Code Section 10115, et seq. and Title 21, California Code of Regulations, Chapter 21 Section 2500 et seq., when applicable, and other matters connected with the performance of the contract pursuant to Government Code 8546.7, the contractor, the subcontractors, the City of Seal Beach and the State shall maintain all books; documents, paper, accounting records, and other evidence pertaining to the performance of the contract, including but limited to, the costs of administrating the contract. All parties shall make such materials available at their respective offices at all reasonable times during the contract period and for three years from the date of the final payment under the contract. The City of Seal Beach, the State, FHWA, or any duly authorize representative of the federal government shall have access to any books, records and documents of the contractor that pertinent to the contractor for audit examination, excerpts, and transactions, and copies thereof shall be furnished, if requested " b. "Any contract in excess of 825,000 entered into as a result of this contract, shall contain all provisions stipulated in this contract to be applicable to subcontractors. " The Contractor acknowledges and accepts these Contract Amendments as legally binding and inclusive of Agreement Number 98003 between the City of Seal Beach and J. Muller International. The following duly J. Muller International authorized representative's signature, acknowledges and accepts these terms and conditions. • • In recognition of the obligations stated in this Agreement, the parties have executed this Agreement on the date indicated above. The Consultant's project manager shall supervise and direct the services, and have overall responsibility for the services in accordance with the Consultant agreement and Scope of Work. The Consultant shall be solely responsible for implementation of all services, means, methods, techniques, sequences, and procedures and for coordination of all portions of the services. All workers shall have sufficient skill and experience to perform the work assigned to them. The City shall have the right, in its absolute discretion to require the removal of the Consultant's personnel at any level assigned to the performance of the Services at no additional fee to the City, if the City considers such removal necessary and in its best interest and request such removal in writing. Further, an employee who is dismissed for any of the above reasons shall not be re-employed on this Contract. 200.7 UNAUTHORIZED WORK: Any services not required by the terms of the final scope of work or proposal that are performed without written authority from the City, will be considered as unauthorized and at the sole expense of the Consultant. Services so performed will not be paid for, and no extension in the period of performance shall be granted on account thereof. 200.8 AUDITS: The Consultant shall keep and maintain full and complete records and books of account of its costs and expenses relating to the performance of the Services, in accordance with generally accepted accounting practices. Such records and accounts shall permit the Consultant to furnish the City, upon written notice, an accurate written allocation of the costs to the various elements of the Services, as may be required by the Authority. Upon reasonable advance written notice the City or its representatives shall have the right to examine, any books, records, accounts, and other documents of the Contractor directly pertaining to costs when such costs are the basis of a claim or of reimbursement to the Consultant hereunder. The Consultant will make reasonable efforts to assure that the any such representative is not a competitor of the Contractor to which the disclosure of such cost information would have a detrimental effect on the Consultant's business. The Consultant shall keep and preserve all such books, records, accounts, and other documents for a period of at least three years from after completion of the Services after Final Payment or if this Contract is terminated in whole or in part after the final termination agreement. 200.9 CONSULTANTS INTERACTION WITH MEDIA AND THE PUBLIC: The Consultant shall refer all inquiries from the news media to the City. If the Consultant receives a complaint from a citizen or the community, the Consultant shall inform the City what action was taken to alleviate the situation. 200.10 SUBCONTRACTORS/SUBCONSULTANT: The City reserves the right of prior approval of all subcontractors and retains the right to request the Consultant to 12 terminate any subcontractor, for any reason appropriate by the City, by so notifying the Consultant in writing. Should said notification be submitted to the Consultant, it shall terminate said subcontractor immediately. The City shall have no liability to any subcontractor(s) for payment for services under this Contract or other work performed for Contractor. My subcontract entered into by Consultant under the contract shall duly note that the responsibility for payment for the technical services or any other services performed shall be the sole responsibility of the Consultant. 200.11 DIRECT EXPENSES: It is expected that the Consultant has extensive knowledge and experience performing this type of work. The Consultant shall prepare a not to exceed budget for direct expenses and breakdown costs for services such as copying, blue prints, computer time, reproduction, delivery, and any other foreseeable expense not covered in the Consultant's hourly rates. Therefore, the Consultant shall receive no additional compensation beyond that which is detailed in their budget. The City will not pay for mileage charges from the Consultant's office to the City. 200.12 INSURANCE: The Consultant shall obtain a minimum of $1,000,000 worth of professional error and omissions insurance prior to entering into an agreement with the City. The insurance requirement is non-negotiable. 13 WEXHIBIT A—SCOPE OF SERVICES •\ MARINA DRIVE BRIDGE- SCOPE OF WORK PHASE I - Type Selection TASK 1: ADMINISTRATION AND MANAGEMENT 1.1 PROJECT KICK-OFF MEETING: Within one week after the Notice to Proceed, the Consultant shall meet with City Engineering Staff to initiate the Project. The purpose of this meeting will be to establish clear lines of communications, review and revise, if needed, the proposed project schedules and scope, discuss project parameters and constraints, and obtain background data. 1.2 QUALITY ASSURANCE MAUNUAL: The Consultant will provide a detailed plan for management coordination and quality control to ensure successful and timely completion of the studies. 1.3 STATUS MEETINGS: The Consultant and the Cities Engineering Staff will hold monthly progress meetings to review the cost and schedule status and progress of the work, as well as anticipated problems and potential solutions. Additionally, the Consultant shall submit Bi-Monthly Status Reports. 1.4 SCHEDULE AND MILESTONES: The Consultant shall establish a project schedule, including review milestones in the project schedule. The Consultant shall submit working and final drafts on all work products in a timely manner to allow for adequate City review and revision. 1.5 PUBLIC MEETINGS: The City may ask the Consultant to attend various public meetings. For budgetary purposes, the Consultant shall expect to attend the following meetings: Two Public Meetings — Input from residents/public hearings, three Council Meetings, and three Planning Commission Meetings (total of eight public meetings). The Consultant's role will be to answer questions and assist staff as necessary. 1.6 PROJECT MANAGEMENT: The project manager shall manage and coordinate all aspects of the project. This item also includes Project Administration functions. TASK 2: BRIDGE ASSESSMENT 2.1 DATA COLLECTION: The Consultant shall be responsible for the researching, gathering and reviewing of all available information, including studies, plans, maps, and other data. Sources may include the cities of Seal Beach and Long Beach, Caltrans, Los Angeles County Public Works Dept., Orange County, and the Los Angeles Flood Control District. This information shall include: • Any available As-Built Plans. • Caltrans Supplementary Bridge Inspection Reports. • Any existing Environmental or Right of Way Data. • Available Utility information. • Hydrologic/Hydraulic data. Marina Drive Bridge Project Page 1 EXHIBIT A—SCOPE OF SERVICES • • Any relevant information in the Cities files. 2.2 FIELD REVIEW: The project team will conduct a site field review to assess the project and the project effects on the surrounding area. 2.3 PREPARE & SUBMIT FIELD REVIEW REPORT: The Consultant will prepare and submit a field review report of the existing bridge condition, complete with a project description. The field review report shall contain the field review form, PES form, and site photos. A field review checklist shall accompany the report. 2.4 TRAFFIC ANALYSIS: The Consultant shall conduct a traffic analysis of the existing and future traffic conditions. The traffic forecasting shall include the proposed future developments of a Home Depot on 2nd Street and PCH and 1" Street and Marina Drive. TASK 3: ENVIRONMENTAL COORDINATION The Consultant shall determine the required environmental studies and perform all necessary environmental studies required to obtain approval from CEQA and NEPA. A more detailed description is included as Attachment A of this scope of work. TASK 4: GEOTECHNICAL INVESTIGATION The Consultant shall provide the necessary Geotechnical Data and produce a report sufficient for design and construction of the Marina Drive Bridge. The geotechnical investigation will include the following: • 4.1 COLLECT AVAILABLE DATA AND REPORTS: The Consultant shall collect all available geotechnical data and reports, including any geotechnical data or information available from the Army Corp of Engineers, Cities archives, and Caltrans records. 4.2 OBTAIN PERMITS: The Consultant shall obtain all necessary local permits required to perform the on site field investigation. 4.3 FIELD EXPLORATION: A total of five borings are proposed to provide an evaluation of the materials at the abutments and each pier. The boring locations will depend upon the access control, utility clearances and the permit requirements. The fieldwork shall be coordinated with the Cities. 4.4 LIQUEFACTION ANALYSIS: If it is discovered that there is a high potential for liquefaction at the site, the geotechnical engineer shall perform the necessary tests to validate these findings and propose mitigation measures. This item is included as a separate task in the event that the liquefaction potential is considered low. 4.5 PREPARE GEOTECHNICAL REPORT: The Consultant shall prepare and submit four copies of both a draft geotechnical report and final report. All comments from the Cities, Caltrans, and Local Jurisdictions included in the final report. The Geotechnical report shall be prepared in Caltrans format and in accordance with the Local Programs Manual and Procedures. Marina Drive Bridge Project - Page 2 atr EXHIBIT A-SCOPE OF SERVICES TASK 5: HYDRAULIC STUDY 5.1 PREPARE HYDRAULIC INVESTIGATION AND REPORT: Psomas will provide hydraulic study report for the engineering team. The scope of services will include the following tasks: • Review and summarize the hydrologic data for both 50-year and 100-year flow. • Field investigation and site visit. • Determine the flood plain upstream and downstream of the bridge for both 50-year and 100- year flow. • Review grain size distribution provided by the geotechnical study. • Prepare data for scour analysis and run the HEC-RAS program. • Prepare a draft and final hydrology study report in accordance with the Caltrans Local Programs Manual and Procedures and provide this to the engineering team. TASK 6: BOUNDARY AND TOPOGRAPHIC SURVEY 6.1 PERFORM DESIGN SURVEYS AND PHOTOGRAMMETRIC MAPPING: Psomas will provide the following scope of services to provide topographic mapping, design surveys and right-of-way surveys to support the engineering team: • Prepare a topographic map at a scale of 1:500 with 0.5-meter contour interval for the project site in conformance with Caltrans mapping specifications. • Recover horizontal and vertical survey control monuments and provide survey control for the project area using Global Positioning System (GPS) and terrestrial survey methods in conformance with Caltrans Survey Manual (Draft 1997) specifications. The horizontal datum for this survey shall be NAD83 datum as published by NGS and the positional values will be published as California Coordinate System 1983 (CCS83), Zone 5. The vertical datum for this survey shall be NAVD88 vertical datum as published by NGS. • Establish two survey control monuments within the site to be used during construction of the new bridge. • Complete research of record maps and utility maps for the project area within the applicable Cities, County and public utility agencies. • Recover cadastral monuments and tie these to the survey control. • Locate all visible public utilities within the proposed bridge site and record pertinent detail information for these utilities. • Obtain cross sections across San Gabriel River; one cross section along both sides of the existing bridge; one cross section approximately 50 meters upstream and one 100 meters upstream; and the same downstream of the bridge. • Verify design details of the existing bridge by comparing the as-built plans and noting all differences. • Calculate record boundaries for the subject area using recovered survey monumentation and record mapping information. • Provide a complete Microstation CADD file showing all survey, utility and right-of-way information with topographic mapping. Marina Drive Bridge Project Page 3 • EXHIBIT A—SCOPE OF SERVICES TASK 7: UTILITY COORDINATION 7.1 PERFORM PRELIMINARY COORDINATION: The consultant shall provide all utility coordination necessary to complete the project. This shall include: • Locating all existing utilities within the construction area. • Providing coordination with the utility companies and/or agencies to resolve any potential conflicts. • Providing the Utility Relocation PS&E necessary to rehabilitate or replace the bridge. • Prepare Conflict Maps. • Providing the Cities with a description of the necessary utility relocations, utility relocation requirements and permit requirements. • Obtaining all requirements relating to design and construction, including shutdown period restrictions, and notification and review requirements from the affected utility companies. 7.2 PREPARE UTILITY RELOCATION PLANS: The Consultant shall prepare the Plans, Specifications, and Estimate for any and all required utility relocations. TASK 8: RIGHT OF WAY ENGINEERING 8.1 PERFORM ROW INVESTIGATION: The consultant shall coordinate all right of way work with the Cities, local jurisdictions, and Caltrans. This shall include: • Determine status of existing right of way. • Prepare plans showing the existing right of way and/or temporary easement necessary for construction. • Obtain the right of way certification form Caltrans. This scope assumes that all lands affected by the project are in "public" ownership and the permitting process is administrative only. Right of Way acquisition is not anticipated and is not included in this scope of work. If the title reports show that there is private ownership of affected property/lands and/or property rights or acquisition is necessary, the fee shall be re-negotiated to the satisfaction of both the City and the Consultant. TASK 9: PREPARE SEISMIC ANALYSIS & REPORT OF EXISTING STRUCTURE These tasks are needed to establish the eligibility for the Seismic Retrofit funding, and to evaluate the rehabilitation alternative costs. 9.1 PERFORM SEISMIC EVALUATION: A seismic Analysis of the As-Built Condition will be performed in order to identify whether or not the existing structure will potentially collapse under the maximum credible earthquake. . 9.2 PREPARE STRATEGY REPORT: A strategy report shall be prepared summarizing the seismic deficiencies, potential retrofit measures, and estimated retrofit costs. This report shall be forwarded to the Cities, Caltrans, and Los Angeles County for review and concurrence. 9.3 ATTEND STRATEGY MEETING: The consultant shall schedule and attend a strategy meeting with Caltrans, Division of structures to present and obtain approval of the selected strategy. All Marina Drive Bridge Project Page 4 EXHIBIT A SCOPE OF SERVICES • comments and or revisions by Caltrans shall be incorporated in a revised strategy report, and re- submit to the Cities and Caltrans. TASK 10: REHABILITATION VS REPLACEMENT STUDY 10.1 PREPARE REHAB. VS. REPLACEMENT STUDY: The costs of rehabilitation vs. replacement shall be compared to identify the most cost-effective solution (the costs to retrofit the structure will be included in the rehabilitation costs). A report will be prepared recommending the preferred alternative. Three copies of this report shall be submitted to the Cities for approval. TASK 11: TYPE SELECTION REPORT 11.1 PREPARE TYPE SELECTION REPORT: Once the project is defined, a Type Selection Report will be prepared to identify the span configuration and structure type of the replacement structure or, suitable rehabilitation measures. The type selection report shall be submitted to the Cities and Caltrans for review and approval. This shall include one meeting to present ideas to the Public Works Directors. If necessary, all comments from the Cities and Caltrans shall be incorporated and re-submitted for approval. PHASE II — Preliminary Design TASK 1: ADMINISTRATION AND MANAGEMENT 1.1 PROJECT MANAGEMENT: The project manager shall manage and coordinate all aspects of the project. This item also includes Project Administration functions. TASK 2: 65% DESIGN (UNCHECKED DETAILS) SUBMITTAL 2.1 PREPARE 65% PS&E: Develop Plans, Specifications, and Estimate for the approved strategy/type selection. These plans will have the design complete, ready for the independent check. 2.2 SUBMIT 65% PS&E: Eight copies of the PS&E will be submitted to the Cities for review and approval. After review, the City's comments will be incorporated in the PS&E and thee copies will be re-submitted for approval. Marina Drive Bridge Project Page 5 • • EXHIBIT A—SCOPE OF SERVICES PHASE III — Final Design TASK 1: PROJECT MANAGEMENT 1.1 PROJECT MANAGEMENT: The project manager shall manage and coordinate all aspects of the project. This item also includes Project Administration functions. TASK 2: 95% DESIGN SUBMITTAL • 2.1 PREPARE 95% PS&E: Develop Plans, Specifications, and Estimate for the approved strategy/type selection. The 95% Submittal will include the following: • Plans, Specifications, and construction cost estimates. • Incorporate the Cities comments on the 65% submittal. 2.2 SUBMIT 95% PS&E: Eight copies of the PS&E will be submitted to the Cities for review and approval. Three copies (including specifications) will be submitted to the Cities for review. After review by the Cities, the Cities' comments will be incorporated in the PS&E and three copies will be re-submitted (within two weeks). Upon approval, two additional copies will be submitted to each utility company and permitting agency. TASK 3: EXPEDITE / FINAL DESIGN 3.1 PREPARE 100% PS&E: Develop Plans, Specifications, and Estimate for the approved strategy/type selection. The 1000/0 PS&E will include the following: • Complete Plans, Specifications and construction cost estimate in accordance with Cities and Caltrans procedures. • Incorporate the Cities comments on the 95% submittal. • Incorporate Utility Companies and Permitting Agency's comments. 3.2 SUBMIT 100% PS&E: Five copies of the PS&E will be submitted to the Cities for review and approval. The final submittal will include the following: • The final Plans, Specifications and construction cost estimate in accordance with the Cities procedures. • One set of 24" x 36" plans. The plans will be in City approved format with the Project Engineers original signature on each sheet. • Plans in digital format, readable by the current release of MicroStation or AutoCAD, if requested. • Specifications in digital format readable in the current release of Microsoft Word. • The Resident Engineers File, Structure & Quantity Calculations. Marina Drive Bridge Project Page 6 • EXHIBIT A—SCOPE OF SERVICES PHASE IV Optional Services — Construction Support At the request of the City, the Project Engineer will attend the construction pre-bid conference meeting, project kick-off meeting, and provide construction support services. This item is not part of the scope of work and is not included in this fee estimate. Marina Drive Bridge Project Page 7 •HAEL BRANDMAN ASSOCIATE• ATTACHMENT A ENVIRONMENTAL SCOPE OF WORK TASK 3: ENVIRONMENTAL COORDINATION MBA shall coordinate with the cities of Seal Beach and Long Beach and Caltrans in processing a joint National Environmental Protection Act/California Environmental Quality Act (NEPA/CEQA) environmental document. Caltrans will be the liaison for the Federal Highway Administration (FHWA). Subsequent to the initial field visit, a determination of the type of environmental document to be prepared has not yet been made. Caltrans will make the determination. For the purpose of this scope of work, MBA has conservatively assumed that an Environmental Assessment/Initial Study(EA/IS)will be prepared for the proposed improvement to the Marina Drive Bridge. Based on the preliminary description of the proposed project, an EA/IS is considered a"worst-case" for the environmental document. MBA's intent is to provide sufficient information for the lead agencies(FHWA for NEPA and City of Seal Beach for CEQA) to issue a finding of no significant impact(FONSI)and negative declaration (ND). 3.1 ADMINISTRATIVE DRAFT EA/IS MBA shall prepare an EA/FONSI and IS/ND as a joint document in accordance with FHWA regulations and CEQA. An environmental checklist shall be prepared and a brief narrative discussion of each environmental topic shall be provided. The narrative discussion shall identify the significance of the project's effect on each environmental topic. Based on the initial field visit with the project team and Caltrans, more detailed analysis in the form of separate studies shall be prepared and summarized in the EA and IS. The individual studies are listed in Task 3.2. Fifteen copies of the Administrative Draft EA and IS shall be reproduced and submitted to the City of Seal Beach for review and comment. 3.2 ENVIRONMENTAL STUDIES The following environmental studies shall be prepared for the proposed improvements to the Marina Drive Bridge. Noise Potential short-term construction noise impacts on the adjacent noise-sensitive residential land uses at the northeast corner of Marina Drive Bridge shall be assessed. The remaining uses adjacent to Marina Drive Bridge include non-noise-sensitive commercial uses. Ambient noise measurements at the existing residences shall be conducted to establish the baseline for the noise study. To establish a worst-case scenario,the existing noise levels shall be measured during peak traffic hours. The noise analysis shall assess project-related construction activities such as grading, pile driving(if applicable), and from stationary and mobile construction equipment. Noise standards in the City of Seal Beach Noise Ordinance shall be used for compliance of the project construction. If pile driving activities occur during construction, a vibration impact analysis shall also be conducted to determine the potential for structural damage at the adjacent residences. •H , AEL BRANDMAN ASSOCIATE \ ATTACHMENT A Long-term operational noise is not expected to increase as a result of the proposed project because the current four-lane bridge will include approximately the same width with the same or less travel lanes. Therefore, long-term noise will not be assessed. Water Quality Study MBA shall prepare a Water Quality Study Report that describes jurisdictional wetlands in the project area as well as impacts to those jurisdictional areas from the implementation of the proposed project. Impacts on jurisdictional areas will occur from the proposed dredge/fill material, construction in navigable waters, or alteration of the bed or bank of the San Gabriel River. The report shall include the necessary documentation for developing and processing the Section 401 certification and Section 404 of the Clean Water Act permit, and a Section 1601 Streambed Alteration Agreement. The water quality study report shall include the USACE Section 404 permit application, the Regional Water Quality Control Board 401 certification application, and the CDFG 1601 Streambed Alteration Agreement. A preliminary draft Water Quality Study Report shall be submitted to the City of Seal Beach and Caltrans. Based on one set of review comments from the City and Caltrans, a draft Water Quality Study Report shall be prepared. The permit applications and agreement shall be submitted to the appropriate resource agency. After both permits and the agreement are approved, they shall be included into the Final Water Quality Study Report. This scope assumes attendance at: one meeting with USACE and one meeting with CDFG in developing the Section 404 permit and 1601 agreement; and two meetings with the project team in developing the permit packages. Coastal Zone MBA shall coordinate with the California Coastal Commission and the cities of Seal Beach and Long Beach during review and documentation of the state and local coastal policies that are applicable to the proposed improvements. MBA shall address consistency with the coastal policies and provide design mitigation measures to ensure consistency, if applicable. Floodplain Risk Assessment Based on hydrological information to be provided by J. Muller International, MBA shall prepare a floodplain risk assessment. MBA shall identify the impacts of the proposed project on the existing floodplain of the San Gabriel River. MBA anticipates that the proposed project would not significantly impact the existing floodplain. Biology Study MBA shall prepare a biology study for the proposed project. The biological study report shall describe biological resources of the project site, including plant communities,wildlife habitats, a characterization of the marine environment, and the occurrence of special status species on the project site. The biology report shall also describe potential impacts to biological resources, the 2 •HAEL BRANDMAN ASSOCIATE. ATTACHMENT A significance of potential impacts, and recommended mitigation measures. Following is a detailed scope of the biological study report. Review Existing Information -Existing documents, information, and maps shall be reviewed and analyzed. Information to be reviewed includes (1) existing documentation and studies of the biological resources in the vicinity of the project site; (2) the Federal Register listing package for each federally listed endangered or threatened species potentially occurring on the project site; (3) literature pertaining to habitat requirements of sensitive species potentially occurring on the project site; (4)the California Department of Fish and Game(CDFG) Annual Report on the status of California's listed threatened and endangered plants and animals; (5) California Natural Diversity Data Base (CNDDB) (RareFind) information regarding special status species potentially occurring on the project site; and (6) the CDFG's Wildlife Habitat Relationships System for specific information on habitats occurring on the project site. Site Survey -The project site shall be surveyed on foot to characterize general biological resources. Existing plant communities shall be mapped. Plant species identified on the site and animal and fish species identified or potentially occurring on the site shall be documented. Plant communities and wildlife habitats shall be mapped. The potential presence on the site of any special status plant, animal, fish, or sensitive habitat shall be determined and mapped. Habitat linkages (wildlife corridors) shall also be identified and addressed as a sensitive resource. The need for focused surveys for special status plant, animal, and fish species on the site cannot be determined until the habitat is evaluated. Focused surveys are not included in this scope of work. Report Preparation - Based on the review of existing information and field surveys, a Biological Study Report shall be prepared. The report shall include a description of existing biological resources of the project site, descriptions of plant communities and wildlife habitats on the site, an evaluation of the potential for the site to support special status species. A map describing the locations of sensitive habitat and sensitive areas within the project site shall also be developed. The biology report shall also describe potential impacts to biological resources, the significance of potential impacts, and recommended mitigation measures. The biology report shall include recommendations, if appropriate for further studies to meet the requirements of agency regulations. A preliminary draft Biological Study Report shall be submitted to the City of Seal Beach and Caltrans. Based on one set of review comments from the City and one set from Caltrans, a draft Biological Study Report shall be prepared and submitted to the U.S. Fish and Wildlife Service (USFWS)and the California Department of Fish and Game(CDFG). Based on one set of comments from USFWS and CDFG, a final Biological Study Report shall be prepared. Wetland Study Jurisdictional Delineation - The jurisdiction of the U.S. Army Corps of Engineers(ACOE)and the CDFG shall be delineated at the project site. The ACOE wetland delineation shall be performed using the methodology in the ACOE 1987 wetland delineation manual. The boundaries of these jurisdictions shall be mapped on maps of an appropriate scale. Civil surveys of any delineated wetlands are not covered in this scope of work. 3 111HAEL BRANDMAN ASSOCIATE,\ ATTACHMENT A Report Preparation - A wetlands study report shall be prepared following fieldwork. The report shall include methods, results, and a graphic depicting the approximate size and location of any jurisdictional wetlands. The report shall be consistent with the requirements of USACE and CDFG. Copies of field data sheets shall be included. A draft Wetlands Study Report shall be submitted to the City of Seal Beach and Caltrans. Based on one set of review comments from the City and Caltrans, a final Wetlands Study Report shall be prepared for inclusion into the Section 404 permit and Section 1601 application. Section 4(f)Evaluation MBA shall prepare a Section 4(f)evaluation that focuses on the proposed removal of the existing fishing pier on the Marina Drive Bridge. The potential impacts of the proposed project and the recommended design features for replacement of the fishing pier shall be discussed. A preliminary draft version of the 4(f)evaluation shall be submitted to the City of Seal Beach for review and comment. Based on one set of review comments from the City, a draft version of the 4(f) evaluation shall be submitted to the City of Long Beach and Caltrans for review and comment. Based on one set of review comments, a revised draft 4(f)evaluation shall be prepared for inclusion into the IS/EA. A final 4(f)evaluation shall be completed after the public review of the IS/EA and 4(f)evaluation. Socioeconomic Evaluation MBA shall prepare a socioeconomic evaluation for the proposed project. MBA anticipates that the evaluation will be focused on social, economic, public services, and fiscal impacts. A brief discussion of these impacts is expected to adequately assess the impacts. No detailed evaluation of socioeconomic impacts is assumed as part of this scope of work. 3.3 PROPOSED FONSI/ND All City of Seal Beach and Caltrans comments shall be incorporated into the proposed FONSI/ND. Eight copies of a"proof check"proposed FONSI/ND shall be submitted to the City and Caltrans for distribution approval. Caltrans is assumed to obtain distribution approval from FHWA. 3.4 DISTRIBUTE PROPOSED FONSI/ND MBA shall distribute 50 copies of the proposed FONSI and ND for public review in compliance with NEPA and CEQA, with input on the distribution list from the City of Seal Beach and Caltrans. Each copy shall be sent by certified mail. 3.5 DRAFT RESPONSES TO COMMENTS MBA shall be responsible for preparing responses to comments received during the comment period. Ten copies of the draft responses to comments shall be submitted to the City of Seal Beach and Caltrans for review and comment. 4 1SHAEL BRANDMAN ASSOCIATE• ATTACHMENT A 3.6 MITIGATION MONITORING PROGRAM AND FINAL EA/FONSI AND IS/ND MBA shall prepare a mitigation monitoring program, if mitigation measures are required, in compliance with CEQA requirements for monitoring measures to prevent possible adverse impacts from project implementation. The program shall include the mitigation to be monitored, the responsible agency, and the procedure or process. MBA shall incorporate City of Seal Beach and Caltrans comments to the responses in the final FONS1 /EA. Forty copies of the Final FONSI/ND with incorporation of the mitigation monitoring program shall be submitted to the City of Seal Beach for distribution to Caltrans, FHWA, and City of Long Beach. 5 EARTH MECHANICS Jul 1998 SCOPE OF WORK AND COST ESTIMATE MARINA DRIVE BRIDGE Geotechnical input will be required to support the following work performed by JMI: (1) As-built seismic analysis for strategy determination (2) Type Selection for replacement structure (3) PS&E for replacement structure Details of the geotechnical input are given below. As-Built Seismic Analysis for Strategy Determination Field Review. A field visit will be conducted to observe the existing site condition and to compare these conditions with the as-built plans. Photographs will be taken and field notes will be prepared to document the findings. Potential boring locations will be identified. Prior to the site visit, we will review all relevant geotechnical information provided by JMI and from published reports prepared by CDMG and USGS. Seismic Parameters. We will provide the peak bedrock acceleration and response spectrum for the seismic vulnerability analysis of the existing bridge. The peak bedrock acceleration will be based on the 1996 version of the Seismic Hazard Map adopted by Caltrans. The response spectrum will be taken from the ATC-32 report. We will also assess the liquefaction potential of the onsite soils using published maps and available subsurface data. As-Built Foundation Capacity. Using assumed soil stratigraphy and strength parameters, we will provide estimates of pile capacity under axial and lateral loading. For lateral loading, we will estimate the point-of-fixity or conduct LPILE-type solution to produce pile-head shear and maximum bending moment versus pile-head deflection curves. Strategy Determination and Final Strategy Report. We will input geotechnical and foundation constructability input in your Strategy determination. Results of all the above analyses will be documented in a Geologic, Seismic, and Foundation Information Report. This report will be incorporated in a Final Strategy Report prepared by JMI. We will also participate in a Strategy meeting in Caltrans (Sacramento). Type Selection for Replacement Structure Depending on the schedule and approval of the encroachment permits for drilling,this phase of work can be performed prior to the field exploration using the same assumed soil data as those used in the as-built analysis or after the field exploration using more representative subsurface information. To support JMI in Bridge Type Selection, we will provide preliminary deep foundation type suitable for this site and pile length for preliminary cost estimate. This information will be provided in a letter report format. EARTH MECHANICS Jul 1998 • PS&E for Replacement Structure This phase of work includes field exploration (drilling and soil sampling), soil laboratory testing, foundation design and preparation of a foundation report. Field Exploration. We propose drilling a maximum of 5 soil borings, one at each support location (for a 4-span structure). The borings at the abutments will be drilled to a maximum depth of 90 feet below existing grade and the borings at the piers will be drilled to a maximum depth of 70 feet below the mudline. Borings at the abutments will be conducted at the approaches. Borings at the pier locations will be conducted from the existing bridge deck. For the pier borings, we will require assistance from the City maintenance department to core a 10-inch diameter hole through the existing bridge deck (at each boring location) and also perform the necessary repair work after completion of the soil borings. We intend to use a hollow-stem auger drilling rig and traffic control will be necessary. Prior to the field exploration, we will prepare a boring location map. This map will also be used to secure all the necessary encroachment permits. We anticipate most or all of the following agencies will be involved in the permitting process: • City of Seal Beach • City of Long Beach • LA County Flood Control • US Army Corps of Engineers • California Department of Fish and Game We will require strong support from JMI to secure all the encroachment permits. Soil Laboratory Testing. We anticipate the following soil tests: • In-situ moisture content and density • Atterberg Limits • Grain-size analysis and Hydrometer test • Consolidation • Direct shear • Unconsolidated-undrained triaxial • R-value • Maximum density • Corrosivity Depending on the findings of the soil borings, other soil tests may be necessary. Foundation Design. Deep foundation will be used to support the replacement structure. We will provide recommendations for foundation type and design including specified pile-tip elevations. We will assess the site liquefaction potential and incorporate the effects of liquefaction in foundation design, if necessary. • • • EARTH MECHANICS Jul 1998 Foundation Report. We will present our findings and recommendations in a draft foundation report in accordance with Caltrans format. A log-of-test-borings (LOTB) sheet will be included in the foundation report. This draft report will be submitted to you for distribution and review. All review comments will be incorporated in a final report. Cost Estimate The estimated costs are based on the above scope of work and the following assumptions: (1) No investigation of lead and other hazardous materials, if hazardous materials are encountered during our field exploration, we will temporarily suspend our work and inform you immediately. (2) No permit fees. (3) JMI will core and repair the bridge deck for the field exploration. (4) One meeting in Sacramento and one project kick-off meeting either at Caltrans district office or at the City. A more detailed cost breakdown is presented in Table 1. A summary is given below. Task Cost (I) As-built seismic analysis for strategy determination $8,140.00 (2) Type Selection for replacement structure $1,750.00 (3) PS&E for replacement structure $46,542.00 TOTAL COST $56,432.00 Schedule We estimate the following duration for completion of our work: (1) As-built seismic analysis for strategy determination: 4 weeks (2) Type Selection for replacement structure: I week (assume no drilling) (3) PS&E for replacement structure (with drilling): 8 weeks after receiving encroachment permits. • • • Proposal for Traffic Engineering Design for the Marina Drive Bridge Rehabilitation Project TRAFFIC ENGINEERING SERVICES PROPOSED SCOPE OF SERVICES FOR THE MARINA BRIDGE REHABILITATION PROJECT BACKGROUND The City of Seal Beach is seeking professional services to improve the Marina Bridge, located on Marina Drive between the Cities of Long Beach and Seal Beach at the San Gabriel River. The project is primarily a bridge reconstruction project. However, the project will have substantial requirements for the services of a specialty traffic engineering firm. The project will require traffic control plans, decorative street lighting plans, and signing and striping plans. The project will also require a traffic study to verify the proposed geometrics for the bridge, its approaches and nearby intersections. Metric System This project will require use of the metric system for all plans. Katz, Okitsu & Associates has already done numerous design projects using the metric system as the primary unit of measurement for Caltrans and other agencies. This project will be designed using metric measurements. SCOPE OF WORK Task 1: Project Initiation and Field Review Katz, Okitsu & Associates would assemble base plan information from appropriate records and sources, including City plans, surveys, and Engineers progress drawings. All information obtained would be verified in the field for accuracy and completeness. We would also confer with the City regarding the desired approach to the proposed construction project and follow-up with the city to discuss any traffic handling issues. Katz, Okitsu & Associates will also attend the project kick-off meeting, if requested, in conjunction with field review activities. Task 2: Traffic Analysis Katz, Okitsu & Associates will conduct a traffic study of existing and future conditions for the proposed bridge replacement and approaches. The purpose of the study will be to determine whether planned geometrics will be adequate or excessive for anticipated future traffic loads. The study will analyze existing traffic conditions on the bridge,its approaches,and nearby intersections, and prepare a traffic forecast of future conditions on these facilities. The study will include existing traffic counts taken during the PM peak hour and on a weekend afternoon at two locations in the bridge vicinity, as required to evaluate bridge and approach geometrics. The traffic study will consider anticipated traffic increases in the bridge vicinity that may be related to construction of a Home Depot Center on Pacific Coast Highway at 2n0 Street and for a hotel that is proposed in the project vicinity. Traffic generation for additional potential developments in the area will also be considered in preparation of the future traffic forecast. Forecasts indicated in Katz, Okitsu & Associates Page 1 • • • Proposal for Traffic Engineering Design for the Marina Drive Bridge Rehabilitation Project existing regional traffic models will also be examined to determine if any information is available from SCAG, OCTA, the City of Long Beach or other agencies with area traffic models. The report will include a recommendation regarding bridge geometrics and traffic management issues. The recommendation will balance the cost of bridge construction with traffic demands in an appropriate manner. Task 3: Detour Concept Plan Katz, Okitsu & Associates will review the complete project scope and detour options to determine an overall traffic management strategy that will be suitable for maintaining access and circulation in the project area. We will develop a preliminary detour or traffic control plan for the type selection report. Task 4: Work Area Traffic Control Plans Two options are available under this task, as follows: a. Assuming that the bridge structure will be completely closed to traffic during construction, we will prepare a detour routing plan, typically at a scale of 1:2000 or higher, showing the alternate routes to guide traffic around the closed area. Also, 1:500 scale intersection details will be shown at closure points of both ends of the nearest intersections. OR b. If the City of Seal Beach determines that the bridge must remain open to traffic during construction,we will prepare 1:500 scale staged construction plans showing the work area, proper lane transitions,delineators,barricades, construction signs and any other necessary traffic controls around the work area. We anticipate that there will be only two stages of construction, with one lane in each direction during each stage. The design, legend, and location of all work area signs, barricades,and necessary additional traffic controls will be designated and placed on the plan sheets. In addition, general notes applying to construction traffic control, a plan legend, and City plan border information are placed on each project sheet per City standards. The plans would be prepared to conform to the general requirements of the City of Seal Beach, with consideration for the needs of the Contractors's construction operations. Task 5: Signing and Striping Plans Signing and Striping Plans will be prepared showing all work on Marina Drive Bridge and affected approaches for all intersecting streets. Plans will be drawn beyond the work area, as needed to properly transition to and join existing markings. The plans will show the location of all proposed traffic signs, traffic stripes, and markings. The final plans would be prepared for final plotting at the standard scale, 1:500, as appropriate for the City or Caltrans. Task 6: Decorative Street Lighting Plans Katz,-Okitsu & Associates will prepare street lighting plans at 1:500 scale to provide a lighting system on the bridge and affected approaches. The street lighting is expected to employ decorative architectural theme lighting fixtures. The desired fixture and pole will be selected from existing manufacturer's catalogs, such as Ameron or Antique Street Lamps. We will propose an appropriate fixture or several options, or we will utilize a fixture catalog item identified for use by others, as appropriate. The street lighting plans will include conduit plans, fixture foundation plans, coordination with the serving utility for electrical service, and all other work required to provide design for a complete and functional agency owned street lighting system. Illumination studies can also be performed upon request to assure that any illumination standards established by the agency are maintained. Task 7: Special Provisions Katz, Okitsu & Associates will furnish typewritten or word processor files of special provisions for all facilities designed by our firm. Specifications will be furnished in the format required by the RFP. JMI will be responsible for including our special provisions in the final contract documents. We will furnish complete special provisions for any items designed by Katz, Okitsu & Associates that do not have currently approved Caltrans Standard Special Provisions, as required. Task 8: Construction Cost Estimates A construction cost estimate will be furnished for our work when required. Detailed take-off costs will be shown for signing and striping. Also lump sum costs will be provided for items that are traditionally bid as lump sum, including construction traffic control items. Task 9: Submittal and Processing of Plans The completed plans would be signed by a registered Civil Engineer,Traffic Engineer, or Electrical Engineer as appropriate. Reproducible copies would be prepared and transmitted by Katz, Okitsu & Associates to JMI for inclusion with other drawing sheets. JMI would be responsible for reproduction of plan check sets for distribution to the City, or other agencies. Any requested revisions would be fully addressed and incorporated properly into the plans, until they are ready for final approval. Final plans will be provided on standard Mylar sheets and as AutoCAD or Intergraph drawing files meeting the requirements of the Cities. We would not be responsible for reproduction of any plans sets of plans following approval. K/i Katz, Okitsu & Associates Page 3 Proposal for Traffic Engineering Design for the Marina Drive Bridge Rehabilitation Project PERSONNEL ASSIGNED/QUALIFICATIONS Mr. Rock Miller will be the Principal in Charge of this project. Mr. Miller is a Registered Civil Engineer and Registered Traffic Engineer in the State of California and he will be responsible for development of detour concepts and an overall traffic management strategy. He will attend the project kick-off meeting and provide quality control for plans prepared by Katz, Okitsu&Associates Mr. Bernard Li, P.E. will be the project manager for this project. Mr. Li is a Senior Engineer for Katz, Okitsu&Associates with extensive experience in projects of this type. He is a Registered Electrical Engineer and Registered Traffic Engineer in the State of California. He will be responsible for coordination with the City, details of plan design, and processing. Katz, Okitsu & Associates is highly experienced at preparing traffic control plans for Cities, utilities, and contractors under tight schedules. We prepare these plans regularly and on schedule for many well-known paving and pipeline contractors. Mr John Kerenyi, P.E.will be responsible for the traffic impact study to evaluate bridge geometrics. Mr. Kerenyi has extensive experience in evaluation of existing and future traffic conditions. SCHEDULE The detour concept plan and the traffic study will be available approximately four weeks following authorization. We will work to insure that all work products by Katz, Okitsu & Associates will be available for submittal to the City for checking on any reasonable schedule established by JMI. Any comments received would be fully addressed and the plans would be returned to the City or JMI within approximately seven days following receipt until the plans are approved. COST The estimated fee for the proposed scope of work was calculated as follows: • Traffic Analysis $4,500 • Detour Concept Plan: $1,200 • Detour Routing Plan OR Staged Construction Plan: $1,600 • Signing and Striping Plan: $2,500 • Street Lighting $1,700 TOTAL: $11,500 This fee includes a reduction in the cost of the signing and striping task since the overall size of our design effort is increased, reducing administrative costs, and there is cost savings from duplication of tasks involving street lighting and signing and striping. All activities will be performed under a not-to-exceed fee of$11,500. Invoices will be submitted monthly, based upon the billing rate for personnel used on the project and direct expenses, including plotting, blueprinting, and freight, with consideration for project progress. �i I Katz. Mr. Miller is a Registered Civil Engineer and Registered Traffic Engineer in the State of California and he will be responsible for development of detour concepts and an overall traffic management strategy. He will attend the project kick-off meeting and provide quality control for plans prepared by Katz, Okitsu &Associates Mr. Bernard Li, P.E. will be the project manager for this project. Mr. Li is a Senior Engineer for Katz, Okitsu&Associates with extensive experience in projects of this type. He is a Registered Electrical Engineer and Registered Traffic Engineer in the State of California. He will be responsible for coordination with the City, details of plan design, and processing. Katz, Okitsu & Associates is highly experienced at preparing traffic control plans for Cities, utilities, and contractors under tight schedules. We prepare these plans regularly and on schedule for many well-known paving and pipeline contractors. Mr John Kerenyi, P.E. will be responsible for the traffic impact study to evaluate bridge geometrics. Mr. Kerenyi has extensive experience in evaluation of existing and future traffic conditions. SCHEDULE The detour concept plan and the traffic study will be available approximately four weeks following authorization. We will work to insure that all work products by Katz, Okitsu & Associates will be available for submittal to the City for checking on any reasonable schedule established by JMI. Any comments received would be fully addressed and the plans would be returned to the City or JMI within approximately seven days following receipt until the plans are approved. COST The estimated fee for the proposed scope of work was calculated as follows: • Traffic Analysis $4,500 • Detour Concept Plan: $1,200 • Detour Routing Plan OR Staged Construction Plan: $1,600 • Signing and Striping Plan: $2,500 • Street Lighting $1.700 TOTAL: $11,500 This fee includes a reduction in the cost of the signing and striping task since the overall size of our design effort is increased, reducing administrative costs, and there is cost savings from duplication of tasks involving street lighting and signing and striping. All activities will be performed under a not-to-exceed fee of $11,500.
