If the Planning Commission denies the application, it is not subject to California
Environmental Quality Act (CEQA) under the rule that actions that are not approved are
exempt. If the Planning Commission approves the application, the project would be

LEGAL NOTIFICATION:
The legal notice of this hearing was published in the Seal Beach Sun Newspaper on
January 3, 2013 and mailed to 128 property owners and 230 occupants within a 500'
radius of the subject property on January 3, 2013,, in the with affidavits of publishing and
posting on file.
FACTS:
Based on records submitted by the applicant, the current property owner purchased
the property in 2007. Shortly thereafter, the property owner chose to utilize the
property as a short term vacation rental property, acquiring the necessary business
license and Transient Occupancy Tax registration with the City's Finance
department,
On October 9, 2013, Rose Hennings ("the applicant") filed an application with the
Department of Community Development for Conditional Use Permit 12-24 to permit
the use of the property at 1205 Seal Way as a short-term "vacation rental" (i.e.,
renting the property for periods less than 30 days. Property owners may apply for a
conditional use permit for a short-term vacation rental provided the application was
filed on or prior to October 22, 2012,
• The applicant originally intended to apply for and exemption/exception from the
requirements of Ordinance 1619-U, but after previous applicants for the
exemption/exception were denied by the City Council, the applicant chose to apply
for a conditional use permit to allow the short-term vacation rental to continue.
• The property has been licensed as a short-term vacation rental property since 2007.
• The property is nonconforming due to exceeding the allowable density- three
existing dwelling units on a lot where only one would be allowed under today's
zoning code.
• The property is presently developed with a three-story triplex structure (all units
are 3bd. 12ba.).
• As of January 8, 2013, planning staff has received nine (9) letters in support of
the project in response to the hearing notices that were mailed out and published
for the public hearing on January 16, 2013.

ANALYSIS:
Commencing with the adoption of Title 11 in 2010, the City has adopted a series of
regulations and requirements for vacation rentals designed to mitigate and eliminate any
adverse impacts upon neighboring properties and the City at large that might arise from the
use. Those regulations include check-in and check-out times as well as requirements that
renters provide valid government identification, that occupants may be cited or fined by the
City for any violation of any provision of the Municipal Code, that trash be stored within
proper trash containers, and that certain terms be included in each short term lease. In
addition, to ensure compatibility with the surrounding uses, the Commission may impose
reasonable conditions in connection with the issuance of a CUP.
For the first several years of the property's operation as a vacation rental, there were
numerous calls for police service to the subject address, primarily for disturbing the peace
and illegally parked vehicles. Staff has attached a summary (Attachment #5) of the police
calls for service dating back to January 2008.
In September 2012, the property owner hired an on-site property manager who lives in one
of the three units. The on-site manager checks in guests and addresses any building
problems, should they arise. Since September 2012, the number of police calls for service
has decreased, but there have still been two substantiated calls for service at the subject
address- one for disturbing the peace and one for an illegally parked vehicle.
During recent CUP hearings for other short-term vacation rental property requests, both the
Planning Commission and members of the public have expressed concern for certain
properties wishing to obtain such permits, where there was a lack of adequate on-site
parking, an over-concentration of vacation rental properties within a certain geographic
area, a unit density issue within an individual lot, or where those properties did not have an
on-site or nearby owner or property manager. While the subject property does have an on-
site owner (upstairs) and vehicle parking on the premises does meet the minimum code
requirements, the property does contain three, 3bd. dwelling units on a lot size of
approximately 3,660 square feet and there does appear to be a problem with continued
police calls for service regarding disturbing the peace and illegally parked vehicles.
Staff, therefore, does not believe that the physical layout and dwelling unit concentration of
the site is adequate for a vacation rental property, since, due to the lot density, issues
regarding noise from the premises and issue with illegally parked vehicles are likely to
continue.
CONCLUSION:
After conducting the public hearing and receiving testimony, staff recommends that the
Planning Commission adopt the attached Resolution recommending denial of CUP 12-24
to allow a short-term vacation rental property within the RHD-20 zone at 1400 Seal Way.

Section 1. On October 9, 2012, Rose Hennings ("the applicant") submitted an
application to the City of Seal Beach Department of Community Development for
Conditional Use Permit (CUP) 12-24 to allow a short term vacation rental at 1499
Seal Way (the "subject property").
Section 2. A duly noticed public hearing was held before the Planning
Commission on January 16, 2013 to consider the application for Conditional Use
Permit 12-24. At the Public Hearing, the Planning Commission received and
considered all evidence presented, both written and oral, regarding the subject
application. The record of the hearing includes the following facts, which the
Planning Commission finds to be true and correct:
a. The subject property is located in the Residential High Density
(RHD-20) zone area of Old Town Seal Beach, which is characterized by narrow
residential lots with narrow setbacks, which means that homes are very close
together. Additionally, Seal Way is a single lane, one-way street, with no on-
street parking and functions more as an alley than a residential street. This
makes the parking and circulation problems in the neighborhood of the subject
property particularly acute.
b. The subject property is an approximately 3,660-square foot lot
approximately 37' by 99', and is presently developed with a three-story
residential duplex. There are three dwelling units on the premises, consisting of
three bedrooms and two bathrooms. The property is nonconforming on the a
basis of: (1) density, because the Zoning Code permits only one dwelling unit on
the subject property; and (2) height limitations, because the Zoning Code only
permits a maximum two-story structure on the subject property.

d. The subject property is currently used for short-term vacation
rental, which has resulted in a regular turnover in short term residents and a
more intense level of use than that which typically occurs in residential
properties.
e. Neighboring residents have complained that the short term
residents of the subject property create excessive noise during their vacation
stays without regard to the concerns of neighboring long term residents, and that
the operation of multiple vacation units on the subject property negatively
impacts an already dense residential neighborhood and traffic circulation
environment; especially in light of the nonconforming status of the subject
property.
Section 3. Based upon the facts contained in the record, including but not
limited to those stated in the preceding Section of this Resolution, and pursuant
to Chapter 11.5.20 of the Seal Beach Municipal Code, the Planning Commission
makes the following findings:
a. Use of the subject property as a short term vacation rental is
inconsistent with the General Plan because the adverse noise, lot density, and
other impacts from the use of the subject property as a short term vacation rental
are incompatible with the residential designation of the neighborhood.
b. The subject property is not physically adequate for the type, density
and intensity of use proposed because the neighboring residences are so close
that there can be no effective buffer for the sort of noise and other use impacts
created by short term occupancy of a nonconforming duplex and the street is so
narrow that the addition of additional vehicle traffic for vacation renters at a
property that is already nonconforming will negatively impact an already deficient
situation.
C. The location, size, design, and operating characteristics of the
proposed use would not be compatible with and would adversely affect uses and
properties in the surrounding neighborhood because allowing vacation renters
increases the number and frequency of visitors and guests and therefore
exacerbates noise, traffic and other land use impacts.
d. The establishment, maintenance, or operation of a short term
vacation rental at the subject property is detrimental to the health, safety, or
welfare of persons residing in the vicinity because the addition vacation renters
increases the number and frequency of visitors and guests and therefore
exacerbates noise, traffic and other land use impacts.

Section 4. Based on the findings made in the preceding Section of this
Resolution, the Planning Commission hereby denies Conditional Use Permit 12-
24, and further finds and declares it would have denied the application based on
any one of the four findings made in the preceding Section, each of which is
considered by the Planning Commission to be sufficient alternative grounds for
denying the CUP.

the City of Seal Beach at a meeting thereof held on the 16th day of January,

AN URGENCY ORDINANCE OF THE CITY OF SEAL BEACH
APPROVING ZONE TEXT AMENDMENT 12'3 PROHIBITING
RENTAL OF RESIDENTIAL PROPERTY ON A SHORT-TERM
BASIS
THE CITY COUNCIL UFTHE CITY OF SEAL BEACH DUES ORDAIN AS
FOLLOWS: I
Section 1� On October 3, 2012. the Planning Commission conducted e
duly noticed public hearing to consider prohibiting the short-term rental of
residential properties (Zone Text Amendment 12-3), After receiving public
testimony, the Commission adopted Planning Commission Resolution Nn.12-32.
recommending that the Council prohibit renting residential property for periods
less than 3Udays,
Section 2. On October 22' 2012. the City Council conducted a duly
noticed public hearing nn Zone Text Amendment 12-3. Persons spoke in favor of
and against short-term rentals.
Section 3, The City Council hereby finds:
A, The City's location and proximity ho the coast makes hnpopular
destination for tourists and visitors, many of whom choose to stay ov hold events
in residential units such as, but not limited to, single-family and multiple-family
dwelling unha, apartment houaeo, oondmniniusmm, zoupemdkm apartments,
triplexes, and duplexes for fewer than 30days.
B. The City Council previously enacted Section 11'4.05135 of the
Municipal Code, which requires vacation rentals to obtain o conditional use
permit ("CUP") and meet certain minimum operational standards.
Notwithstanding enactment ofSection 11.4.05.135. some vacation rentals in the
City have continued ho negatively impact neighboring residents.
C, On April 0.2012. the City Council adopted Ordinance No. 1618-U,
imposing new interim regulations on new and existing catko rentals. On May
14. 2012. the City Council adopted Ordinance Nu. 1819-U amending and
extending the interim regulations for new and existing vacation nenta|s, including
the requirement that all previously nonconforming vacation nanbm|s obtain e
conditional use permit for such use.
D. Based on experience in the City and in other jurisdictions, it is
known that short term renting or leasing of residential properties have the
potential to create the negative land use impacts for neighboring residential uses.
These include but are not limited to noise disturbances due tu !eie night arrivals
and parties with numerous guests and amplified mumio, insufficient parking, and
unsanitary and unsightly trash accumulation, These problems are exacerbated
when multiple units unthe same parcel are rented on a short-term basis otthe
same time and/or to large groups. yNonaower, because short-term occupants do
not stay in the residence for longer periods, they and their guests have |aus
personal incentive to moderate their behavior to avoid negatively impacting
u�
neighboring residents.
E. A000ndingly, there is o current and immediate threat Vo the public
heakh, aafmty, and welfare presented by the expansion of the number ofvacation
enha|u in the City beyond the number ofsuch uses that the City has previously
approved and for which the City has previously received aoondbione| use permit
application. The approval of any additional conditional use permits for vacation
'anto|o beyond those previously approved or those for which the City has
previously received an application will result in that threat to the public welfare

unless this Ordinance is immediately effective. Due to the foregoing
circumstances, it is necessary for the preservation of the public heekh, auh»ty'
and welfare for this Ordinance to take effect immediately. This Ordinance is an
urgency ordinance for the immediate preservation of the public pomce, hnaKh,
and safety within the meaning of Government Code Section 38937(b) and
therefore shall be peaoad immediately upon its introduction and ahe|| become
effective immediately upon its adoption,
F. Approval of Zone Text Amendment 12-3 is categorically exempt
from review pursuant 8z the California Environmental Ouo|dy Act (CEDA)
pursuant to CEQA Guidelines Section 15305 (Minor Alterations in Land Use
Limi(eUnnm), because it consists of minor alterations in land use limitations in
areas with an average slope of less than 2O96 and does not result in any changes
in land use or density-, and Section 75061(b)(3). because it can be seen with
certainty that there is no possibility that the approval may have a significant effect
on the environment; and
G. Zone Text Amendment 12-3 is consistent with the City's General
Plan.
Section 4, The establishment of any new vacation rental is prohibited.
The City shall not accept any conditional use permit application for a vacation
nama| after October 22, 2012. Applications submitted on or before October 22,
2O12 shall bm processed and may ba approved in accordance with the provisions
of the Municipal Code and Ordinance No. 1619-U. Ordinance No. 1619-U is
superseded by this Ordinance and shall have no further effect except for the
limited purpose of processing and reviewing conditional use permit applications
for vacation rentals filed onor before October 22.2O12,
Section 5, The Municipal Code including but not limited to Table
11.2.05.010. is amended todelete any reference to"vacation rentals." Table
11205.010 of the Municipal Code is further amended to indicate that "Short
Tenn Rental of Residentially Zoned Property" is neither permitted nor
conditionally permitted in any zoning district of the City and to cross-reference
Section 11.4.05,135.
Section 6. Section 11.4.05.135 of the Municipal Code is emended to
read as follows:
^Short'Tann Rental ofRouidenhely Zoned Property.
A. Prohibited, No residentially zoned property, or any portion
thereof, shall be ]eased or rented for o term nf2A days or
less for any purpose, including but not limited to any
residential or commercial purpose such as vacation rentals,
weddings, or other event rentals,
B. Legal Nonconforming Vacation Rentals. Any vacation rental
granted a conditional use permit pursuant to Ordinance No.
1818'U shall be a legal nonconforming use permitted 10
continue subject to its conditions of approval and Chapter
114.4Oof the Zoning Code.^
Section 7. Pursuant to Ordinance Nu. 1019-U, the City issued
conditional use permits ("CUPa'')for o number ofvacation rentals, One of the
conditions of approval attached to each CUP is the requirement that the property
owner comply with the permit and operational requirements set forth in
Ordinance No, 1619-U. |n that Ordinance No. 1619-U will be superseded upon
the effective date of this Dndinunoe, such standards are restated below. Each
property owner who has m CUP for a vacation rental must comply with the
following permit and operational requirements:

K Business License Required. The property owner must obtain o
business license prior to operating or establishing a vacation rental,
8, Transient Occupancy Tax. The property owner must complete the
Transient Occupancy Tax Remittance form prior to operating or establishing a
vacation rental and shall pay the Transient Occupancy Tax in accordance with
the Seal Beach Municipal Code.
C. Visitor occupancy shall be limited to a
maximum of2O consecutive days.
D. Fire and Life Safety. Fire and |iha safety requirements as required
by the Fire Authority and the Building Department shall bmimplemented. These
requirements ino|ude, but are not limited to approved smoke detectors in each
lodging mnm, installation of an approved fire extinguisher in the atruotuoe, and
the inclusion ofan evacuation plan posted |n each lodging room.
E. Annual Insi3ection. Each vacation rental shall comply with the
annual fire and life safety certification procedures of the Orange County Fins
Authority.
F. First-day arrival at vacation rental is prohibited
after Q:3Op.m. All lease or rental agreements must include this prohibition.
G� Vacation renters must vacate the unit before
noon on the final day of their tenancy,
H. Renter Information and Acknowledgement. Prior to occupancy ofo
short-term vacation rental unit. the owner shall: 0 obtain the nume, addraoo,
and e copy ofa valid government identification of the primary adult occupant of
the short-term vacation rental; and (ii) require the primary adult occupant to
execute a formal acknowledgement that he or she is legally responsible for
compliance of all occupants of the short-term vacation rental or their guests with --
all applicable |uwm, rules and regulations pertaining to the use and occupancy of
the short-term vacation rental. The acknowledgement must include the text cf
Section 745.O1Oof the Municipal Code, which provides uufollows:
"Upon the initial response of the police department to any disturbance
involving loud, unnecessary and unusual noise, the chief uf police may,
in lieu of or in addition to baking other eodun authorized by !avv, give
notice 1othe person or persons in actual or apparent control of the
activity creating the disturbance, or to the person or persons in actual
or apparent control of the property or premises wherein the
disturbance has occurred, or both, that liability may be imposed upon
the person or persons receiving such notice for the costs to the city of
any subsequent response by the police department in connection with
any continuation or resumption of such disturbance. Such notification
mho|| be in such form as may be approved by the chief of police. The
costs of any subsequent response shall be ouoeoeod to the person or
persons receiving such notice and shall include all costa reasonably
incurred by the city in providing law enforcement services and
equipment at the scene of the disturbance, including the cost mrvalue
of the time expended by police department personnel in making any
subsequent response. The method of computing such costs shall be
established by the chief ofpolice and approved by the city council.
The finance deportment shall invoice such costs to the person or
persons |iob|o therefor under this ohapter, and such costs shall
constitute o debt to the city and be collectible by the city in the same
manner as in the case of an obligation under a contract; provided,
however, that in no event shall u person's liability hereunder exceed
*1.00O for any single subsequent reoponne.^

This information and acknowledgment shall be maintained by the owner
for a period of three years and shall be readily available upon request of any
police officer or employee of the City authorized to enforce this Ordinance or any
applicable |aw, m|o or regulation pertaining to the use and occupancy of the
short-term vacation rental.
i Trash, Trash and refuse must not be left stored within public view,
except in proper containers for the purpose of collection by the City's authorized
waste hauler on scheduled trash collection days. The owner or property
manager must provide sufficient trash collection containers and service to meet
the demand cf the occupants.
J. Lease Terms, Each new lease or rental agreement for oshort-term
vacation rental must have a copy of these Permit and Operational Requirements
attached to it and must include the following terms, notifications and disclosures,
which shall also be posted ina conspicuous location inside the unit:
1. The trash pick-up day and applicable rules and regulations
pertaining to leaving or storing trash or refuse on the exterior of the property.
2. Notification that the occupant may be cited or fined by the
City for violation of any provision of the Municipal Code, including but not limited
to amplified sound, including radios, televisions and other electronic devices, that
onymtao a noise disturbance in violation of Chapter 7.45 of the Sau| Beech
Municipal Code,
3. A recommendation that the occupant participate voluntarily
hn neighborhood quiet hours byavoiding parties and loud social events between
the hours of1O:O0p.m. and 7:DUa.m.
4. The name of the owner or property manager and o

telephone number at which that party may be reached at all times.
K. ' The property owner or manager must
provide the City with a phone number at which haor she can be contacted ono
24-hour basis regarding nuisance complaints arising at or from the use of the
property as avaoation rental. Upon receipt ofn nuisance complaint or upon
notification that any occupant or guest of the short-term vacation rental has
created unreasonable noise ordisturbances, engaged in disorderly conduct, or
committed violations of the Municipal Code or any state |mw, the owner or
property manager must respond within 45 minutes of receiving such notification
and must promptly take corrective action to immediately prevent a recurrence of
such conduct by those occupants orguests. Failure to timely respond to calls or
complaints as required or take timely corrective mo1inn regarding the nnndiUon,
openadon, or conduct ufoccupants of the short-term vacation rental shall be a
violation of this Ordinance. Nothing in this Ordinance shall be construed to
require or authorize an owner o/ property manager io act ooa peace offimaror0o
intervene in situations that pose a risk tu personal safety, The owner orproperty
manager must maintain records of the nome, vio|ation, date, and time of each
comp|aint, dis(urbanoe, and n*opunae and corrective action by owner, Such
records must be maintained for a\ least three years.
Section 8 If any aection, auboenhon, aubdiviuinn, paragraph, sentence,
clause or phrase of this Ordinance or any part thereof ia for any reason held hr
be invalid, such invalidity shall not affect the validity of the remaining portions of
this Ordinance nr any part hereof. The City Council of the City of Seal Beach
hereby declares that it would have passed each aeotkon, subaection, aubdiviaiun,
pamsgnaph, eentence, clause or phrase hereof, inoopodixe of the fact that any
one or more sections, subsections, subdivisions, paragraphs, sentences, clauses
or phrases be declared invalid.

1499 Seal Way Unit A and Unit B Conditional Use Permit Application
1. Ownership
In 2007, Martin Greenspun, the owner of The Beachfront Villas (1499 Seal Way), purchased
the property as the place he and his wife wish to retire. Mr. Greenspun was born and raised in
Long Beach, graduated from High School in Long Beach and attended Long Beach State prior
to transferring to USC. During the 1980's and 1990's, Mr. Greenspun lived in Sunset Beach
while an executive for the Anaheim Angels and the Mighty Ducks hockey team. His career
has taken him to New York as one of the highest ranking executives of the Yankees baseball
team but both Mr. Greenspun and his wife are looking forward to returning to Seal Beach--and
specifically the 1499 Seal Way Owner's Unit known as "Villa B"-- upon his retirement from the
Yankees.
11. 1499 Seal Way Has Been a Seal Beach Vacation Rental for 6 years
After purchasing the property in 2007, Mr. Greenspun chose to utilize The Beachfront Villas
as a Vacation-Rental and in so doing had Cal Vacation Homes and its owner obtain a City
of Seal Beach business license. We are informed that The Beachfront Villas is one of the
oldest "Grandfathered" designated vacation rental properties in Seal Beach and that it has
remitted the greatest amount of City occupancy tax (well over $100,000) to the City. In fact, in
some years the property accounted for one-third of all occupancy tax remitted by all Seat Beach
vacation rentals. Over $52,000 in occupancy tax has been remitted in the most recent two
years alone.
Ill. Parking
We are fortunate to have three separate 2-car garages at 1499 Seal Way to provide a total
of 6 enclosed garage spaces for the two units. So each of the two Vacation Rental units
can be assigned 3 indoor parking spaces. We also have one exterior parking space that is
permanently assigned to the Onsite Resident Manager, Rose Hennings, who lives in Villa C.
IV. Records of Noise Disturbance Calls--Not a Single Citation Ever Issued
We requested from the Seal Beach Police Department reports of all disturbance calls over
the past 6 years and have been provided with all 6 calls over the past 6 years. Apparently, all
the "Calls for Service" were from our neighbor, Mike. One of the 6 calls was concerning "youths
skateboarding on Dolphin" which we are informed by another neighbor were local high
schoolers, skateboarding and not guests of the building.
Mike's calls for the other 5 reports were noise disturbance calls. Here is a recap of the all Police
Department Calls for Service over the past 6 years:

playfulness. Since the subjects were conducting this activity on the beach it is unclear whether
they were actually staying in the Beachfront Villas units themselves--no citations issues (Call

2) July 30, 2011 -- Officer advised subjects to quiet down and was told by subjects that they
would comply--no citations issued. (Call made by Mike)
3) August 1, 2011 -- Officer responded to Call for Service report of a "noise" but upon arrival did
not find or hear a party or noise--no citations issued (Call made by Mike)
2012
1) January 16, 2012--Officer responded to a Call for Service noise disturbance and Officer
notes "Matter Solved"--no citations issued. (Call made by Mike)
It is worth noting that according to the records provided, in the 6 year history of the Beachfront
Villas there has never been a single Citation ever issued by the Seal Beach police to the guests
of the Beachfront Villas. It is also worth noting that since the May 14, 2012 Vacation Rental
Ordinance there have been no noise complaints due to the New Stringent 4-Page Rental
Agreement.
Our goal with our guests is to have absolutely no Police Calls for Service in the future. We have
.seen an average of one call per year but we will not be satisfied until we have 0 calls per year,
Our Stringent 4-Page Rental Agreement has been in place during the Summer of 2012 and
that combined with our On-Site Resident Manager, Rose Hennings, has resulted in all of our
neighbors telling us that Summer 2012 was the quietest in the 6 year history of the property.
IV. Recent History since Seal Beach's Vacation Rental Ordinance Enacted May 14, 2012
Prior to the City Council Meeting on May 14, 2012, the owner of the Beachfront Villas provided
the Seal Beach Planning and Development Department copies of all future Rental Agreements
and agreed to install a 12 month renter into the 3rd unit and only rent the remaining 2 units
once the existing Summer rental agreements had been fulfilled. On August 30, 2012, the 3rd
unit was taken out of service as a vacation rental and rented on a 12 month basis so that there
would only be 2 remaining units available as vacation rentals.
Among the Rental Agreements that were submitted to the City on May 14, 2012 were Rental
Agreements signed by Lessee's for all 3 units for dates that are after the August 30, 2012 date
that the Beachfront Villas was reduced to only 2 Vacation Rental units. We will take on the
responsibility to find those guests new accommodations.
V. All Guests Since May 14th Have Executed New 4-Page Rental Agreement
Since the Vacation Rental Ordinance was enacted on May 14, 2012, we have made all future
guests sign our new Stringent 4-Page Rental Agreement which addresses every issue of
Ordinance No. 1619-U. (A copy of our New 4-Page Rental Agreement is attached and we have
been told by prospective guests that it is the toughest, most stringent agreement that they have
come across). We have even gone so far as to require that every guest that had previously
booked with us re- execute the new 4 -Page Rental Agreement if they were to arrive after May
14, 2012. Some of these previous bookings were even made as far back as 2011 and they
were required to re- execute the new 4 -Page Rent (or they could not stay with us).
VI. Websites Updated to Reflect that only 2 Units of The Beachfront Villas are For Rent
Attached are the printouts of the description of the Beachfront Villas on our website,
www.calvacationhomes.com as well as the sites that we advertise on such as www.VRBO.com
www.Homeaway.com, The websites have been updated to reflect the fact that we are only
renting out 2 units - -Villa A and Villa B.
VII. Installation of Rose Hennings as On -Site Resident Manager of the Beachfront Villas
Upon the passage of the Vacation Rental Ordinance No. 1619 -U we immediately embarked
upon a search for the best possible Resident Manager for the building to provide on -site pro-
active management for the building. We contacted the neighbor closest to our building, Nlike
Vecchia, to find out who he thought would do the absolute best job and his recommendation
was Rose Hennings. We felt that as the closest neightbor, Mike Vecchia is the neighbor most
impacted by the vacation rentals, as evidenced by the fact that Mike Vecchia had been the
caller on all of the noise disturbance calls during the past 6 years. Rose Hennings and Mike
Vecchia have a good relationship and Rose is well aware that Mike's living room window looks
directly onto the Beachfront Villas and is a mere 20 feet from the building. There is no question
that Mike is the most effected by how the property is managed and that is why choosing the
onsite Property Manager that Mike Vecchia knows and trusts was so important.
Based upon Rose's long Seal Beach residency, her working as a property manager for the past
several years in Seal Beach and the respect and admiration that the neighbors have for Rose,
she was hired and she moved into the 3rd unit (Villa C) on a full -time basis on August 30, 2012 -
-which is the date the pre- existing Summer rental contracts were completed.
VIII. Property Manager Rose Hennings
Rose Hennings and her family have been residents of the Seal Beach/ Los Alamitos community
for over 50 years. She is a graduate of Los Alamitos High School and has enjoyed a wonderful
teaching career at Los Alamitos High School where she presently teaches. In the summer she
works at a friend's retail shop on Main Street in Seal Beach, in addition to working as a property
manager of Seal Beach Vacation rentals for the past 4 years. Rose is very much a part of the
heart and soul of Seal Beach, having lived, worked, raised her children as well as educated
(as a teacher at Los Alamitos High School) the town's children here. As a committed member
of this community, she will up hold the principles, ideals, integrity and neighborly spirit which
makes Seal Beach a wonderful place to live. All of the neighbors of the Beachfront Villas know
and respect Rose. Rose will insure that the guests of the Beachfront Villas enjoy all that Seal

706 Ocean Avenue and 248 17 TH Street. I am writing this letter regarding the Beachfront Villas (1499 Seal
Way) not being allowed tn continue in its grandfathened use as a vacation rental. When | purchased rny
homeon17 Ih Street it required extensive remodeling and I was commuting from my home in Scottsdale
Arizona. The Villas provided a perfect "home" to live in during the time when the house was
uninhabitable. I have rented it for my family who reside in Huntington Beach for our family reunions and
birthdays as my parents also lived here when they were first married. I have many friends here in Seal
Beach and renting the Villa allows me the opportunity to spend holidays and vacations with them and to
support the town of Seal Beach. I am back living in Arizona now and rented the Villas again this October
while looking for another home to purchase. Being able to stay at the Villas in the future will further
increase my chance of purchasing another home in Seal Beach. I urge you to please keep the Villas
available for rental, including for past residents like myself.

Way. I have iletin my home for Q_ years and during that time I have observed the vacation
rental located at 1499 Seal Way. I have always found the vacation rental guests at 1499 Seal
Way to be well-behaved, courteous and family oriented. The guests who stay at the property are
families and have all been friendly, careful not to create excessive noise and sensitive to the
residential nature of the neighborhood. The guests of 1499 Seal Way have enjoyed the rental in
respectful and courteous manner and have been friendly and respectful to the neighbors. I
strongly feel that 1499 Seal Way should be approved to be allowed to continue as a vacation
rental.
To my knowledge the only neighbor in our area that is constantly complaining to the police
about vacation rentals is Mike, who is known throughout the neighborhood as calling the police
on his fellow year round neighbors, local Seal Beach school age children and anyone or anything
else that Mike feels is disturbing him. Mike is well known for exaggerating the impact of noise
or activity in the neighborhood. My observations over the years I have lived next door to 1499
Seal Way is that it is not the "party house" that Mike constantly complains to the police about.
Far from being a "party house" the reality is that 1499 Seal Way is rented by family groups who
are better behaved and quieter than most of the year round renters in our neighborhood.

the immediate area. I have two apartment buildings located directly behind 1499 Seal Way. I do
not rent any of my units as vacation rentals so I do not have any bias in favor of vacation rental
units--my only interest is correcting the misinformation that one of my own year round tenants,
Mike, has generated around out neighborhood. The operation of 1499 Seal Way as a vacation
rental has a beneficial aspect on my business and the businesses of Main Street. To prohibit the
operation of 1499 Seal Way as a vacation rental would hurt local businesses and send the wrong
message to the two and three generation families that return year after year to Seal Beach. I have
always found the vacation rental guests at 1499 Seal Way to be well-behaved, courteous and
family oriented. Just as the Dolphin Market is a Seal Beach institution, so is the tradition of
hosting families on the oceanfront row of triplexes in Seal Beach. I own 5 properties in Seal
Beach and I am the landlor4 to 7 year round tenants that are all immediately adjacent to 1499
Seal Way and to my knowledge all tenants except for Mike have no issues with 1499 Seal Way
and find the short term renters to be well-behaved and respectful of the other neighbors.
Furthermore, I have no objections to continuing to allow 1499 Seal Way to operate as a vacation
rental to families from all over the world. They are an asset to the merchants of Seal Beach.

as crazy Mike (Mike Vereke).The only complaints or calls to authorities i know of have been charged by Mike.Mike has
called the police on every person that lives in eyes view of him often for frivolous reasons.lm sure if you check the
complaint log 90% of complaints came from Mike V.I have witnessed Mike dumping his cat litter from 2 cats in trash bins
belonging to 1499 sealway 50 times over 7 yrs which should tell you what kind of person he is because he filed a
complaint on said property for littering or excessive trash. I again express the fact that I have never had a problem with
any of the tenants for renters at 14 99 seal way.

Dear Sirs:
I'm writing in regard to the investigation to determine viability of revoking the permit allowing the property located
at 1499 Seal Way, Seal Beach to operate as a vacation rental. It has come to my attention that surrounding residents
have waged complaints and are requesting the property no longer be permitted to operate due to excessive noise,
parking abuse and other similarly related issues. I would like to express my desire not to have the permit revoked
and to allow the property to continue to operate.
During the period of August 2010 through November 20111 resided at 1424 Ocean Avenue, Unit B, Seal Beach.
My home was an upstairs unit facing Seal Way, directly across the alley from 1499 Seal Way vacation rental
property. I am a working mother with a young, school age daughter living in the home. As such, loud or disruptive
neighbors would not be acceptable or tolerated. During my residence at no time were the occupants of the rental
property loud, offensive or disrespectful to the neighboring families. Additionally, parking while always a struggle
in our city, does not seem to be significantly affected by vacationers.
I continue to live in Seal Beach, at 1413 Ocean Avenue and our family frequents the beach located at Ocean and
Dolphin year round. We often see and interact with the renters of 1499. The vast majority are families, usually with
young children, with no purpose other than to enjoy the lovely, small town atmosphere we are so lucky to call home.
There has never been an occasion that any tenant was rude, unfriendly or disruptive.
Seal Beach is a small seaside town. Tourism is a major contributor to the economy of our city. To eliminate
vacation rentals will have a negative impact on locally owned businesses. To treat these guests with anything other
than warm hospitality will serve no purpose but to gain a reputation of being an unfriendly, arrogant community that
people will not want to visit. This will have an equally negative impact on our businesses.
I strongly urge you to consider the source of the complaints. Mr. Mike Verrecchia has been one of the most vocal
and ardent supporters of shutting down this property. Over the years Mr. Verrecchia has had and continues to have
issues with a great many of his neighbors for issues quite similar to the complaints waged against 1499. While his
focus has not yet been on me I have witnessed his wrath of dissatisfaction with neighbors. He continually wages
unwarranted complaints to landlords and other neighbors, aggressively confronts those he feels affronted by through
malicious and public verbal attacks. He frequently calls out the police for frivolous grievances wasting valuable city
resources. Some people are more sounds sensitive than others. Perhaps living in a beach community, apartment
atmosphere, where neighbors are in very close proximity is not the most ideal living conditions for someone with
this type of sensitivity? Certainly neighboring residents and business should not be punished for one person's
unreasonable expectations.

owners hired an on-site manager the problems have diminished. | personally know Rose Hennings the manager. She

has assured moe the rental policy has changed. The owners will more intently screen their tenants and for the most part
only rent tnfamilies. Since Rose now lives on the premises she will control the amount of people in each unit plus the
parking issue. I believe this property should be allowed to continue renting based on reasonable restrictions such as
number of people in the units and on-site property managers. |f the owners to not comply then the permit should be
pulled. But they should be given a chance tu prove their sincerity.
I have lived at 1401 Seal Way for 17 years. There are summer rentals at # 1319, across the street from me, one in the
middle of the I4DO block and one at#1499. For the most part families with children rent these units and very few
problems have arisen.

problem, that one unit should be dealt with on an individual basis by increasing fines against that owner. If the owner of
the property does not comply, then the permit for that unit should bepulled. Not all rental properties should be
penalized nor should the number be limited because of the actions of a few.
Seal Beach has always been a small town that attracts tourists and has always had summer rental properties. Tourist
are good for the local economy plus the City ofS8 receives the hotel tax. With this economy all taxes should be
welcome.
