The Oity Council of the Oity of Seal Beach met at the hour of 7:30 P.M. for the purpose of publio hearing on the application of Philip Norton to exempt Tract 698 from restrictions as to use of property established by Ordins.nce No. 199. The City Clerk-reported that 96 notioes of time and place for publio hearing, were mailed in accordance w~th Seetion:16; Ord. NO.199, to~the various owners of property within a radius of 300 feet fr~m the outer boundary of Tract 698. By invitation of Mayor Reed, Mr. Norton addressed the Council and the large delegation of property owners assembled in the Council Chamber, explaining details,of the proposed building program, and 'answering objections and questions which have come to his attention. At 8:00 o.olock Mayor Reed called the meeting to order in regular session, and continued the discussion of the matter of reclassification of Tract 698. Mrs. Naomi Wilimcre addressed the Council calling attention to a petition which was filed with the Council. Petition signed by 39 property owners within the boundary of the district affected by the proposed housing development, request- ing the Oity Oouncil and the Planning Commission to reject the ~pp~i- ~&~n of Philip Norton involving the rezoning of Tract 698 to per- mit the construction of multiple dwellings. Mr. Douglas, Mrs. Gilohrist, Mrs. MoKinney and Urs. Cundiff voiced objections to the Norton building program. Mr. T. A. Sloman answered a remark made by one of the speak- ers regarding the Plant of the Deplt pf Water and Power. It was moved by Felts, seconded by Hughes that the petition be received and filed for the Councills further consideration. Motion carried. I I Letter from E. B. Shallenberger, owner, of pr~perty ~n Block 2 - Protest against the reclassification of Tract 69! from single family to multiple. It was moved by Felts, seconded by Henkey to receive and file the I communication from Mr. Shallenberger. Motipn carried. Mayor Reed announoed that if there were no further protests or remarks on the proposed housing project, that the Council would proceed with the regular order of business, and that all who wished IBill- board. Burkhart, Secretary of the Planning Co~~ission, addressee the Council suggesting that the petition be referred to the Planning Commission. No action was taken on:the suggestion. The minutes of regular meeting of June 3rd, 1943 were read and approved. l. . . The following communications were read: Associated Outdoor Advertising Co., by Ralph P. Livenspire- Notifying the City that due to wartime conditions, they have been, \L~- . able to sell the advertising space on their sign board in Seal Beach; therefore, they will have to remove the boa,rd unless the City can put . it to some patriotic use by sponsoring an ad such as IIBuy more War Bonds", etc., The Ad.vertising Co., will furnish the ad and do the . painting free of charge provided the~Oity will not charge them the usual license fee for the sign board. It was moved by Henkey, seconded by Felts to receive and file the communication from the Associated Outdoor Advertising Co., and that . action on their offer be deferred for further consideration, and that investigation be made as to the exact location of the board. Motion carried. 2. American Legion, Post No. 300 - Asking for $12,00 to pay, the cost of transportation for one boy to Boys' State. It was moved by Henkey, seconded by Felts to receive and file the communication from the American Legion, and that the request for $12.0( . be granted. Mr. Jones made request for two weeks vaca- tion pay. It was moved by Henkey, seconded by Postal to receive and file the . communication from J. It was moved by Henkey, seconded by Hughes to receive and file the Resolution of the Board of Supervisors, ~nd that the .20 cts. for prisoners' meals be allowed. Orange County Board of Supervisors - Copy of Resolution adopted at meeting of June 1st, 19~3, ordering and directing the Oounty Auditor to canoel anv and all uncollected tax, penalties and costs heretofore levied by the Oounty of Orange on the follow- ing described rea~ property in the City of Seal Beach: . 1. Bay City, Lots 45 and 47, Blook 7. 2. A strip of land in Sectional}, 14 and 24, Township 5, Range 12, bound Northeasterly by Paoific Electric right-of-way, Southerly by the Pacific Ocean. - 3. 1.15 acres in Sections 13 and 14, Toymship 5, Range l2j bound Southwesterly by Pacifio Electric Railway and Tract 125, Northerly by the Bay. I The Resolution of the Board of Supervisors was received, and ordered filed on the Mayor's motion. OOMMITTEE REPORTS Fire Ohief W. S. Knighton reported that after investigating . the air-whistle at Signal Hill, he concluded that Seal Beach has no facilities for blowing suoh a whistle. Purchasing Agent B. F. Krenwinkel reported that the fire- hose adapters have been purchased. Report of Salvage Committee by C. A. Miller - that the old corrugated iron garage at }15 Main Street is now being used for storing salvage material. A. W. No action was taken on the matter. On the matter of financin8 the installation of sewer and water mains in Tract 698 as requested by Philip Norton, ~ayor Reed asked the City Attorney for an opinion on how the City hay legally finanoe the projeot. Mr. ~illiams pointed out that the City.has no authority to pledge the oredit of the Oity beyond the ourrent revenue, except by an election authorizing the Oity to incur the debt for a specific purpose. ~r. Williams stated that as a result of a Oourt Decision, an exception, known ae the "Special Fund Dootrinel! \vas allov:ed, whereby the City may enter into an agreement incurring an indebtedness which could be paid from a special fund, and not from the General or other budgted funds of the City. If ~:r. Norton were to advance the money for installation of seuer and water in Tract 698, the City could, undel the Special Fund Doctrine, enter into an agreement to reimburse Mr. Norton from funds received from consumers of water in this Tract, over and above the expense of maintenance of that portion of the water system. Mayor Reed asked that the Oouncil continue as a Committee for further oonsideration of matters which may arise in oonnection with the,probleI of finanoing the installation of utilities in Tract 698. CITY OFFICERS REPORTS Reports !lor the month of May, 1943, of the City Treasurer and the City Clerk were read. City At~orney Dana R. Williams reported that the Ord Land Co. case v will oome up for trial on J~~e 30th. He stated that the question has been aaked whether the City can enter into a bond with the Ord Land Co., to reimburse them for any damage which ~ight occur as a result of the proposed groin or rivetment if such protective wo~ks is con- structed by the Oity. Mr. Williams advised against the City enterin~~o such a bond. It was moved by Hughes, seconded by Felts to receive and file the City Officers reports. !.'.otion carried. AOCOUNTS AnD BILLS Demands numbered from l17b to 1215 inolusive were read. It was moved by Postal, seoonded by Hughes that bills be allowed and warrants dra~n on the treasury for same. Layor Reed presented request of Ellen Congrove, Chairman~6f of the Local Ration Board, that the City Council appoint a repre- sentative to meet with the Orange Oounty Board of Supervisors, requesting an appropriation from the County to pay the salary of an extra clerk for the OPA Office. The Local Board, in addition to Seal Beach, serves Oounty areas of Los Alamitos, Barber City, . . Surfside COlony and adjacent territory. . uayor Reed appointed Councilmen Henkey and Hughes to present to the Board of Supervisors at their first meeting in July, the request of the Local Ration Board. On the matter of Police car - Councilman Postal made the motion, seconded by Councilman Henkey that the Chief. of Police be informed that the rental for use of his car will be paid on a day to day basis until the City purchases a new car. . Motion carried. It was moved by postal, seconded by Felts that the Purchas- ing ABent be instructed to get pric~ on different makes of cars, also to arrange for the necessary priority for purchase of a car.
