The Oity Oouncil of the Oity of Seal Beach met 1n regular sessioI at 8:00 O'clock,P.M., and was called to order with salute to the flag. ROLL CALL - Present: Mayor Reed Oouncilmen Felts, Henkey, Hughes, Postal Absent: None II Minutes. The minutes ,of regular meeting of July 15th, 19~3 were read and approved. NortoR- Out of the regular order of business, Philip Norton addressed the Bldg Project.Oouncil stating that the War Production Board has. granted the Appeal of F.H.A. for authority to use critical material for construction of single family dwellings. Mr. Norton stated that he will file his application for Seal Beach's share of the quota immediately. The various Banks andoBuilding-Loan Companies are eager to finance this building program which will consist of approximately 143 houses. A. L. Oorriveau asked how many houses will be built in Tract 698 where the Oity will spend approximately $10,000 for installation of sewer and water lines. I Mr. Norton stated that 78 houses; and possibly ~6 more will be built in this tract. OOMMUNIOATIONS I War 1. League of Calif. Councilman Henkey raised the question of whether the Pier, whio~ is being used as a roadway for transportation of supplies to the Army Post at the end of the Pier, can be included as a road for the purpose of filing a claim for damages. It was moved by Henkey, seconded by Felts to receiv.e and file the communication from the League, and that the Oity obtain further infor- mation as to whether our Pier by reason of its present use by the U.S. Army, can be considered asrafroad, and that the Oity Engineer be authorized to estimate the cost of the damage to the pier; and that " 36 Edison Co. - Bills. ,/ Post- war road con- struc- tion. Communication received and ordered filed on the Mayor's motion. 3. A. A. Beard, Sup1t of Highways, Orange County Road Dep~t - Oaaling attention to Chapter 656 - State Legislatur~ ~ppropriation of funds for making surveys and,prsp~ring plans and specifications for post-war County tlighway conetruotion projects, including County highways of major importance within Cities. Mr. Beard asked that the City make suggestions as to particular streets within the Oity which may be included in the County budget for the P?st-war program of oonstruction. I It was moved by Felts, seconded by Hen~ey to reoeive and file the communication from Mr. Beard, and that tne matter b~ referred to the City Engineerfof investigation as t~ the City's partioipation I in this post-war program of construction. Motion carrd!ed. 4. Burr A. Brown - Olaim of Fred W. H~ghes in amount of, $350.00 for damages against the Oity of Seal Beach for removing garage building from Lot 34, Blook 3, Traot 125, together with further damages in the sum of $l5.00 per month from date of demolition of the garage to replacement thereof, as loss of use and reasonable rental value thereof. In answer to the Mayorls inquiry regarding the garage, Build- ing Inspeotor B. r. Krenwinkel stated that the g.a~age was in a dilapi~ated condition - siding off and no doors - and had not been used for years. After expiration of time allowed by the legal notices which were served on the owner, the City demolished the building, which was nothing b~t framework, and stored the lumber I at the City Yard. It was moved by Henkey, seconded by Hughes that the Claim of Fred W. Hughes for damages for loss of garage and rent, be rejected. AYES: NOES: ABSENT: Oouncilmen Felts, Henkey, Hughes, Postal, Reed None None Motion carrie~. ;)7 COMMITTEE REPORTS S~leSaIe of On the matter of sale of tax deeded lots City Tax Collector - ~~. x tax.;. lots. reported on his conference with C. W. Hyde, Jr., Tax Land Redemption Specialist - The County must deed to the City its interest in the lots' before the City oan offer them for sale. Under the new law, the Count] must participate in the proceeds of the sale in proportion to their interest in the property. The agency that handles the proceedings is entitled to 5 %, and the City and County receives their proportionate I share of the rema1nder of amount realized from the sale. City Attorney Dana R. Williams ,reported that Mr. Hyde will p~e- pare the proceedings to submit to the Board of Supervisors, for .5.00 per lot. It was suggested that the City start with the sale of 11 lots to which the Oity holds absolute title. The matter was referred to the Committee previously appointed to handle the matter (Oounoilmen Postal and Hughes, ,Oity Attorney Dana R. Williams and Tax Collector ,0. A. Miller) who will meet and deoide the date and manner of offering these lots for sale. IPolice Car. On the matter of new police car, it was moved by.Postal, secondec by Felts to defer action on the purchase of a car until the matter of the budget is aett~ed. Motion carried.," Ord Land Co. Comp- romise. On the Condemnation Action which is pending against the Ord Land Company for 'a portion of Lot 9, Block 1, Tract 125, City Attorney Dana Reports - R. Williams reported that a compromise has been agreed ,upon whereby' the City will pay $800.00 for the triangular portion of the West end of Lot 9i and the Ord Land Co. has agreed to waive all claims in the future for damages which might occur to their prope~ty. CITY OFFIOERS REPORTS Reports ,for the month of July, 1943, of the Oity Judge, Chief of Police, Building, Water and Tax Departments were read. It was moved by Felts, seconded by Henkey to receive and file tha City II Sfficers reports. Bills. ACCOUNTS AND BILLS Motion carried. Demands numbered from III to l77 inclusive were read. It was moved by Postal, seconded by Hughes that bills be allowed and warrants drawn on the treasury for same. August 5, 1943 (Cont1d) On the matter of meeting a possible deficit in the General Fund which the City may have before the first half of taxes are. due, it was moved by Postal, seconded by Felts to authorize the Oity Attorney to look into the matter of financing City warrants on a similiar procedure as was followed last year. A RESOLUTION OF THE CITY COUNOIL ADOPTING MEMORANDUM OF AGREEMENT FOR EXPENDI- TURE OF GAS TAX FUNDS FOR IMPROVEMENT OF STATE HIGHWAYS WITHIN THE CITY OF SEAL BEACH. It was moved by Felts, seconded by Hughes that Resolution No. 486 be adopted. AYES: NOES: ABSENT: Oouncilmen Felts, Henkey, Hughes, Postal, Reed None None Motion carried. ORDINANCE NO. 277 was read. AN ORDINANCE REGULATING THE DISTRIBUTION OF HAND-BILLS WITHIN THE OITY.OF SEAL BEACH, CALI- FORNIA, AND PROVIDING A PENALTY THEREFOR. Aotion It was moved by Felts, seconded by Henkey that action on Ordinance deferred. Beach warning signs. Sewer and water. ,_ . t-' . . .- No. 278 be deferred for further consideration. Motion carried. .On the matter of beach warning signs for protection of bathers, it was moved by Felts, seconded by Henkey to instruct the Chief of Police to have appropriate signs printed and posted at street ends and other points of entrance to the beach, warning bathers to be cautious, and to stay close to where lifeguards are stationed. On the matter of installation of sewer and water in Tract 69g, it was moved by Councilman Postal to reconsider the former 39 action of the Council authorizing the sale of Pier Bonds to finance the installation of euch utilities, for the reason that he considers the sale of these bonds an unsound business prOoedure. Motion lost for want of a second. ' I Mr. postal stated that some other means should be worked out to finance this project. The Oity should not deplete its only reserve. He asked-that some one else be appointed to serve on the Finance Com- mittee should the Oouncil proceed to use the revenue from sale of the- Pier bonds. Mayor Reed requested Mr. Postal to continue on the Finance Com- mittee until next meeting allowing time for the Council to give the matter further th0ught. She called attention to the fact that Mr. Norton ~ent ahead with arrangements for his building,program on the supposition that the Council would proceed with the installation of the utilities in Tract 698. Pier rent. On the matter of rent from the U.S. Army for use of the Pier, C. A. Miller reported that an Army Lease Agent called at his office to discuss the matter with him. He proposed 820.00 per month, and suggested that the Council give an expression as to a fair rental for , I the use of the Pier. After much discussion around the Council table' regarding rent, and the electric bills which the City has assumed each month, Mr. Miller suggested $35.00 as a basis for negotioat10ns with the Army. Y On the Mayor's motion, Mr. Miller was authorized to nsgotiate a lease ,:\ agree~ent with the U.S. Army for use of the Pier. Ohlor- C. A. Miller reported that the Sewage Plant has outgrown the inator. chlorinator, and that the situation has been met by renting a chlorina- tor from Wallace & Tiernan Co., which machine may be purchased for $1600.00. I Budget. It was moved by Hughes, seconded by Felts to instruct ths Purchasing Agent to make out a purchase-order for rental agreement for the chlorinator at $50.00 per month. Motion carried. Harold J. Frank, representing Diehl & Edwards, Auditors, pre- sented the tentative Budget for the fiscal year 1943-44.
