At this time members of the public may address the Council regarding any items within the
subject matter jurisdiction of the City Council. Pursuant to the Brown Act, the Council cannot
discuss or take action on any items not on the agenda unless authorized by law. Matters not on
the agenda may, at the Council's discretion, be referred to the City Manager and placed on a
future agenda.
Those members of the public wishing to speak are asked to come forward to the microphone and
state their name for the record. All speakers will be limited to a period of 5 minutes. Any
documents for review should be presented to the City Clerk for distribution.
COUNCIL ITEMS
A. November 6, 2012 — General Municipal Election — Adopt Ordinance
No. 1623 to cancel the General Municipal election scheduled for
November 6, 2012 and waive full reading of the ordinance; appoint David
W. Sloan as Member of the City Council — District 2; appoint Gary A. Miller
as Member of the City Council; and appoint Linda Devine as City Clerk ;.
ADJOURNMENT
Adjourn the City Council to Monday, September 10, 2012 at 5:30 p.m.
By previous action of the City Council the August 27, 2012 City Council meeting has
been cancelled.

SUBJECT: CANCEL NOVEMBER 6, 2012 GENERAL MUNICIPAL
ELECTION - APPOINTMENTS TO CITY COUNCIL AND
CITY CLERIC
SUMMARY OF REQUEST:
That the City Council adopt Ordinance No. 6123 to cancel the November 6, 2012
General Municipal election; appoint. David W. Sloan as Member of the City
Council — District 2; appoint Gary A. Miller as Member of the City Council; and
appoint Linda Devine as City Clerk.
As of the close of the nomination period on August 10, 2012 at 5:00 p.m., only
one candidate has been nominated for each office to be filled at the General
Municipal Election scheduled for Tuesday, November 6, 2012: David W. Sloan,
Member of the City Council - District 2; Gary A. Miller, Member of the City
Council — District 4; and Linda Devine, City Clerk. The nomination papers were
deemed to be complete and sufficient so that such candidates are the only
qualified candidates. In the situation where only one person has been nominated
for an office, the Council may take one of the following options pursuant to
Election Code §10229:
1. Appoint to the office the person who has been nominated.
2. Hold the election.
On Thursday, August 16, 2012, the City published a notice that the Council will
consider: (1) appointing.the nominated persons; or (2) holding the election.
If the Council chooses Option 1, the persons appointed shall qualify and take
office and serve exactly as if elected at a municipal election for the office (the
persons appointed will be sworn into office at the December City Council
meeting). If the City Council makes the appointments, the City Clerk shall not
accept for filing any statement of write -in candidacy which is submitted after the
appointments are made.

Attached is Ordinance No. 1623 repealing Ordinance No. 1621 and cancelling
the November 6, 2012 General Municipal election.
FINANCIAL IMPACT:
Cancellation of the November 6, 2012 election would result in a savings of the
$50,000 budgeted in the FY 2012 -2013.
That the City Council adopt Ordinance No. 1623 to cancel the November 6, 2012
General Municipal election; appoint David W. Sloan as Member of the City
Council — District 2; appoint Gary A. Miller as Member of the City Council; and
appoint Linda Devine as City Clerk.

AN ORDINANCE OF THE CITY OF SEAL BEACH REPEALING
ORDINANCE NO. 1621 TO CANCEL THE GENERAL
MUNICIPAL ELECTION SCHEDULED FOR NOVEMBER 6, 2012
WHEREAS, a General Municipal Election has been called by Ordinance No.
1621; and
WHEREAS, by certificate dated August 13, 2012, City Clerk Linda Devine
certified that as of the close of the nomination period on August 10, 2012, only
one person had been nominated for each of the offices to be filled at the General
Municipal Election scheduled for Tuesday, November 6, 2012; and
WHEREAS, the City Council wants to repeal Ordinance No. 1621 to cancel such
election.
NOW, THEREFORE, BASED UPON THE FOREGOING RECITALS, THE SEAL
BEACH CITY COUNCIL DOES ORDAIN AS FOLLOWS:
SECTION 1. The City Council, pursuant to its right and authority, does hereby
repeal Ordinance No. 1621 to cancel the general municipal election scheduled
for November 6, 2012.
SECTION 2. The City Clerk shall certify to the passage and adoption of this
Ordinance.
