Oopy of letter from Attorney General Robert W. Xenney, San rranoisco, address8d to Phflip Norton in answer to Mr. Norton's inquiry concerning'the Claim filed by J. O. Aldrioh to the publio beach at Seal Beach, and the1P~BP9sa~oto~pa, therefor with Valen- tine Script. The Attorney General stated that the regular practice of the rederal Land Office is to deny the ownership of any public la 'iands\"lupon which suoh Olaim could be filed; and that the State's position that tidelands beloni to the State as a pa~t of her sovereign rights, and are merely subject to laws passed by Oongress to regulate oommeroe, has been repeatedly recognized by the secretarl:: of the Interior. Letter ordered filed on the J4s.yor's motion. 2. Seal Beach Post - Announcing the publication on January 21st, and 28th, and February 4th, 1944, of special feature advertising to promots the Fourth War Loan Drive whioh starts January 18th and ends February 15th, 1944. $6.00 for the three issues. It was moved by Henkey, seconded by Bughes to receive and file the communication from the Seal Beaoh Post, and that the City subsoribe for advertising spaoe in the three issues at cost of $6.00. It was moved by Postal, seconded by Hughes to reoeive and file the communication from O. Z. Irvine, and that lIrs. Eva Wilkerson be appointed as Clerk to ass 1st the Secretary and Leader of Oivilian War Activities. P. .Butler, President Application on behalf of the Boys' Olub for a Oity license to conduct wrestling, boxing and sparring matohes or exhibitions at the Club Rooms, 141 Main Street. A police Officer, paid by the Olub, will be present at each exhibition. It was moved by Postal, seoonded by Henkey to receive and file the oommunication f~om.Mr. Butler, and that a permit be granted to the Boys' Olub for boxing, wrestling and sparring matches, and that the usual license fee be waived. Krenwinkel reported that the matters in connection with the Norton-Bailey building project, which ~ere .. disoussed at meeting of January 6th, 1944, have been taken care o~. On the ,matter of a new Federal oensus, Oity Attorney Dana R. Williams read a letter from the Oity Manager of Burbank with refer- ence to their recently completed census taken under the direction of the United States Oensus Bureau. The oost was .05 oents per name plus approximately $600.00 per diem expense for the Supervisor fur- nished by the Bureau of Census. Mr. Williams reported that he has received no reply from the League. Mayor Reed asked the Oity Attorney to continue his inyestigation. 'Ioircle cafe Danoe Permit. was The Oity Attorney reported that the Oircle Oafe dance permit issued in the name of Walter Smythe, the owner; therefor~, there is no violation of the Ordinanoe. Alamitos On the Alamitos Bay development, the Oity Attorney reported thE Bay develop- the present plan is to take out one of the bents in the Ocean Avenue ment. Bridge to allow room for the dredger to enter the Bay. The bridge will be reinforoed with steel plates. Dredging will oover an area oj approximately 200 feet wide. DB freas. Report-. The Oity Treasurer's report for the month of December, 1943 was read. It was moved by Hughes, seconded by.Postal that the Oity Treasurer's report be received and ordered filed. MOtion carried. On the matter of property damage insurance in connection with II sewer and water projeot in Traot 698, O. A. Miller reported that he has made application to the Oity's insurance oarrier"Pacifio Indem- nity Company, through the local Agent, Jessie M. Havens, for endorse- ment which will provide property damage coverage for this projeot. Additional premium, $50.00. AOOOUNTS AND BILLS Demands numbered from 639 to 666 inolusive were read. It w~s moved by Postal, seconded by Hughes that bills be allowed and warrants drawn on the treasury for same. AN ORDINANCE OF ri',:, THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING ORDINANCE NO. 276 BY kMENDING SUB-SECTION H; AMENDING ORDINANCE NO. 282 BY AMENDING SUB- SECTION G OF SEOTION 2 THEREOF; REPEALING ALL ORDINANOES OR PARTS OF ORDINANOES IN CONFLICT THEREWITH, AND PROVIDING FOR PUBL~OAT~ON THERJ:OF. It was moved by Postal, seconded by Henkey that sub-section (11):r:be . changed to read that the time element on Polioe Officers salaries I~ may be waived at the discretion of the Oouncil, and that the Ord- inanoe be amended accordingly. Raymond Smith addressed the Oouncil urging th"m to take im- mediate steps to appoint some person to inspect the houses so the owners will know as soon as possib1s whether they can be moved. :1 Gauntner. Ilr. W. D. Gauntner addressed the Oouncil stating that the problel dlllcing the ~inhabi tants of the Anaheim Bay area of finding homes is a' serious one, and should be given thoughtful consideration b, the Oity Oouncil. Mr~ Gauntner stated that reasonable conoessions should be made to allow the houses to be moved and used for the duration even though they do not meet the building standard. A ooncession was proposed, to allow buildings of 450 square footr-area to be p1aoed on the rear of lots, for the duration. Councilman Postal stated that every poss~b1e.effort must be made to determine what the major problems are for the City to solve in con- nection with the housing Question for residents of the Anaheim Bay arel The compensation for the Assistant Building Inspeotor was dis- oussed. Counoilman Felts suggested 88.00 per day. It was moved by Hughes, seconded by Felts that the Building Inspector be authorized to hire a temporary assistant at compensation not to excsed 810.00 per day, for the work in connection with the inspection of houses that are to be mo~ed from Anaheim Bay dis~riot. AYES: NOES: ABIENT: Oouncilmen Felts, Henkey, Hughes, Postal, Reed None None Motion carried. Mr. Raymond Smith raised the Question of whether or not the Navy project will be a benefit to Seal Beach. He called attention to the usual moral problems wh~ch follow suoh development. 00unoi1man Felts stated that the City will not condone any question of bad morals, and that the Council will go on reoord as opposed to any- thing so objectionable. Mr. Brunick addressed the Oouncil sagge@ting that a wire be sent to Washington, D.C., asking for information as to what the Navy pro- poses to do. F. W. D.C., namely: U.S. Distriot Attorney in Los Angeles, and the Commandant of the 11th Naval District in San Diego. It was moved by Henkey, seconded by Hughes that the Oity Attorney be instruoted to contact the Commandant of the lltb Naval Dist~ict the Attorney General's office, or any other Agency or persons in an effort to ascertain the exact nature of the Anaheim Bay projeot. ,Motion carried. Maintenance Foreman R. N. Thomas reported that the big truck is in constant use, and that the City should have another truok,- one or one and one-half ton capacity - in order to get the work done. Oounoilmen Hughes and Henkey were appointed as a Oommittee to in- vestigate the possibilities of buying a truck. Yr. John Flemming, representing the Honolulu Oil Oorporation appeared before the Council, submitting for the Oouncil's consider- ation, a form of Lease for drilling for oil on the City's tideiands. Offering $10,000 for the 'Lease , and 5 per cent royalty for all o~l produoed. Mr. Fleming stated that his Company will finance th~..oost I: of an eleotion if such is necessary. Upon suggestion be Oouncilman Henkey that the Honolulu Oil Oorp. make a direct written proposal to the Council, Mayor Reed requested,Mr. Fleming to present to the Oouncil, the.Oompany'~ proposal in writing. Raymond Smith, Ohairman of the Penineula Improvement Ass'n., asked the Council to give the oil pnopoeal very Qareful considera- tion. He stated that the attitude of the people on the Peninsula is definitely against oil drilling in Seal Beach. The,question was decided and settled by an overwhelming vote of the people at a Special Election in 19J9. It was moved by Felts, seoonde4 by Hughes to adjourn until Monday, January 24, 1944, at 7:30 P.M. Motion carried.
