Crumby P.E., Assistant City Manager/Public Works SUBJECT: NOTICE OF COMPLETION - NAVY DRAINAGE EASEMENTS IMPROVEMENTS PROJECT NO. SD1202 SUMMARY OF REQUEST: It is requested that the City Council adopt Resolution No. 6335 accepting the Navy Drainage Easements Improvements Project No. SD1202 by CopperTop Enterprises, Inc. in the amount of $161,190.21; direct the City Clerk to file a "Notice of Completion" with the Orange County Clerk-Recorder within ten (10) days from the date of acceptance; and release retention in the amount of $16,119.02 in 35 days. BACKGROUND AND ANALYSIS: At the June 25, 2012 City Council meeting, the City Council awarded a contract to CopperTop Enterprises, Inc. for the Navy Drainage Easements Improvements Project No. SD1202 in the amount of $159,620.29. The project involved clearing and grubbing over 350 feet of earthen drainage channel, repairing headwalls and adding fall protection at the outlets of these channels, restoring and replacing flap gate valves at drainage pipe outlets, and cleaning over 650 feet of existing underground drainage piping. During construction one change order was required, consisting of the removal of unusable concrete. The change necessitated additional costs to the construction contractor, CopperTop Enterprises, Inc. in the amount of $1,412.92 (less than 1% of the original construction cost). The project is completed to the satisfaction of the City Engineer. The project was inspected and it meets all standards and requirements within the project specifications. It is required to formally accept the project and file a notice of completion with the Orange County Clerk. Agenda Item— Q ENVIRONMENTAL IMPACT: This project has complied with the California Environmental Quality Act (CEQA) and is categorically exempt under Section 15301(d), Class 1. LEGAL ANALYSIS: This action has been reviewed and approved by the City Attorney. FINANCIAL IMPACT: In the approved FY 2011-12 Budget, $200,000 is budgeted for the Navy Drainage Easements Improvements Project No. SD1202. In FY 2012-13, $182,400 was carried over and earmarked for this project. Below is a summary and breakdown of the total expenses for the project: Description Amount Design/Planning $ 27,598.00 Construction $ 159,620.29 Change Orders $ 1,412.92 Inspection $ 3,962.50 Total $ 192,593.71 The total amount paid to CopperTop Enterprises, Inc. for construction/change orders is $161,190.21. SD1202 WHEREAS, on June 25, 2012 the City of Seal Beach entered into a contract with CopperTop Enterprises, Inc.;and WHEREAS, the City Engineer has determined that the work has been substantially completed in accordance with the contract documents. THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE: SECTION 1. The City Council finds that the work required to be performed by CopperTop Enterprises, Inc. has been completed and accepted and that the total cost of amount to be paid to CopperTop Enterprises Inc. is $161,190.21 for the work performed. SECTION 2.
