Crumby P.E., Assistant City Manager/Public Works SUBJECT: AMENDMENT No. 1 TO PROFESSIONAL SERVICES AGREEMENT WITH MOFFATT & NICHOL FOR PIER UPGRADES PROJECT NO. BP1002 SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6348 approving Amendment No. 1 to Agreement to Moffitt & Nichol in the amount of $55,508 to prepare plans and specifications for the Pier Upgrades, Project No. BP1 002. BACKGROUND AND ANALYSIS: The Seal Beach Municipal Pier is approximately 1,800 feet long consisting mostly of poly-wrapped timber piles, timber support members, and a -timber decking. Utility lines are generally located under the deck of the pier or attached to the side of the pier and span the entire length of the pier. The utility lines include gas, water service, fire service, sewer, communication and electric. Lifeguards and Public Works crews have regularly inspected and monitored various components of the Pier. These inspections include monitoring the age and condition of the utilities under the deck. Staff has noted the deteriorating condition of various utilities, including repairs that were required to the water and gas lines in the last couple of years. Additionally, Moffatt & Nichol has visually identified numerous locations of loose utilities, damaged and corroded lines and damaged connection hardware during a structural safety assessment inspection performed for the City in 2008. This project is a combination of three projects that are identified within the FY 2012-13 Adopted Capital Improvement Program and are described as follows: Pier Re-Decking Final Phase Proiect No. BP1004 The City has completed construction of the first three phases of placing new decking on the pier. The fourth and -final phase will replace the worn Douglas Fir timber members at the end of the pier with new Greenhart timber to match the rest of the pier. This project, BP1004, has been designed by Moffatt & Nichol Agenda Item i and is ready to bid out for construction, but has been on due to the Pier Restaurant having been in a ready state for remodel for the past 10 years. Currently, the Pier Restaurant is vacant and the City is in the process of locating a replacement restaurant. This portion of the design will have the consultant ready to modify the plans to match the layout of the future restaurant. If no changes are necessary to the plans the consultant will not be paid for this task. Pier Utilities Upgrades Project No. BP1002 The utilities that serve the Pier are aged and beyond their useful life. This project replaces the potable water, fire protection (water), sewer, gas, communications, and electrical lines for the Pier. These facilities serve not only the restaurant, but the restrooms and lifeguards. Additionally, utility lines are going to be added to the Pier so that bait cutting stations are available for the fishermen and cutting of fish can be restricted to designated areas. On November 9, 2009, City Council authorized a professional services agreement between the City and Moffitt & Nichol to design the Pier Utility Upgrades Project. This project was put on hold shortly after design work began, in order to allow the previous Pier restaurant to perform required tenant improvements as part of their lease agreement. The rationale being that the City would replace utilities and the decking after the restaurant had completed their work. Unfortunately, the tenant failed to comply with the term of the lease agreement requiring $400,000 of improvements prior to the expiration of their lease term on October 31, 2012, Pier Structural Assessment Project No. BP1 103 The Pier had a structural assessment completed in 2008, which recommended various improvements to the structure. This structural inspection is typically done every five years. The improvements were grouped based upon the priority of the need. The City immediately performed improvements that were classified as a high priority and budgeted for improvements that were less urgent. Those improvements have been on hold with the other projects in an attempt to combine for a larger project. The larger project is anticipated to be constructed in the most cost effective manner. The Pier restaurant is now vacant and the future tenant is being identified. It is recommended that this professional services agreement be amended and have the design firm ready to revise and complete designs for the various projects. Once proposals are received for the restaurant and a vendor is selected the layout of the new restaurant will be incorporated into the designs and the construction can be timed to coincide with the opening of the new restaurant. Moffatt & Nichol was chosen for these projects due to their coastal experience and knowledge of the Seal Beach Municipal Pier. Moffatt & Nichol has done previous work in Seal Beach and often is retained as an expert on design of coastal projects in the City. They designed Phases 1, 11, 111 and IV of the pier Page 2 deck rehabilitation project as well as performed the design portion of the Sand Replenishment project. The fee for Moffatt & Nichol to design the Pier Structural Assessment Implementation Project and combine the final designs for all three projects is $55,508. This fee proposal is appropriate for the services rendered. ENVIRONMENTAL IMPACT: There is no Environmental Impact related to this item at this time however staff will prepare all environmental documents to comply with CEQA by -the award of construction. LEGAL ANALYSIS: The City Attorney has reviewed and approved the City's Design Professional Services Agreement Amendment with Moffatt & Nichol. FINANCIAL IMPACT: Funds have been approved in the 2012-2013 Fiscal Year Budget in the amounts shown below: Description Amount Pier Utilities Upgrades Project No. BP1002 $ 1,000,000 Pier Re-Decking Final Phase Project No. BP1004 $ 300,000 Pier Structural Assessment Project No. BP1103 $ 100,000 Total $ 1,400,000 This is a total of $1,400,000 for the combined pier upgrades. City shall compensate Consultant for the Original Services at its standard hourly rates in accordance with the fee schedule set forth in Exhibit A and for the Additional Services at its standard hourly rates in accordance with the fee schedule set forth in Exhibit C, but in no event shall the City pay more than $86,500 for the Original Services or $55,508 for the Additional Services." Our proposed scope of additional services is attached. Our total fee for the Additional Scope of Services described including an hourly rate adjustment for the balance of the existing agreement,is$ 55,508 inclusive of reimbursable costs and allowances. This brings the total amount of the amended agreement to$ 142,008. A summary of the changes is attached after the scope of additional service along with the current Rate Schedule for Professional Services. Design services include design for current uses,preparation of construction drawings,preparation of specification and estimates,as well as field investigation,meetings and coordination,quality control reviews and reimbursable expenses. The existing scope includes all utility lines on the timber portion of the pier,but does not include utilities within the buildings.The additional scope includes miscellaneous structural repairs based on the 2008 inspection report and designer construction services.
