SUBJECT: ACCEPT RESIGNATION - PLANNING COMMISSION -
DISTRICT ONE
SUMMARY OF REQUEST:
Accept the resignation of David Everson, District 1 representative on the
Planning Commission and ratify appointment of Steven Sloan to fill the unexpired
vacancy.
BACKGROUND AND ANALYSIS:
Mr. Everson submitted a letter of resignation indicating he will be moving out of
the state and will no longer be able to serve on the Planning Commission,
effective immediately (Attachment A).
In accordance with Government Code §54974 (Maddy Act) whenever an
unscheduled vacancy occurs in any board, commission, or committee for which
the legislative body has the appointing power, a special vacancy notice shall be
posted and appointment to the board, commission, or committee shall not be
made by the legislative body for at least 10 working days after the posting of the
notice. The notice was posted on January 18, 2013.
ENVIRONMENTAL IMPACT:
There is no Environmental Impact related to this item.
LEGAL ANALYSIS:
No legal analysis is required for this item.
FINANCIAL IMPACT:
There is no Financial Impact.

Dear Ms. Deaton,
It has been my pleasure to serve the City of Seal Beach as its Planning Commissioner
from District One for the past two years. During that time the Planning Commission
has dealt with many issues ranging from basic Conditional Use Permits and Variance
requests to the proposed housing development on the former DWP property and
the passage of the Housing Element. I hope that my voice on the Commission during
all of these issues has benefited the citizens of Seal Beach.
It is my regret to inform you that my family and I are moving out of State in
February of this year and that I will no longer be able to serve on the Planning
Commission. I hereby offer my resignation, effective immediately.
Thank you for nominating me to the Planning Commission and thank you for all of
your support during my tenure. I wish you,your family,and the City of Seal Beach
all the best during the years to come.

NOTICE OF SPECIAL VACANCY
ON I
NOTICE IS HEREBY GIVEN that the Planning Commissioner for
Council District One has resigned effective January 18 2013. The
resignation has created an unscheduled vacancy on the Planning
Commission. (Government Code§54974 -Maddy Act)
PLANNING COMMISSION -Municipal Code§3.10.010
A. Establishment. The planning commission is hereby established for the
purpose of exercising such powers and performing such duties as are prescribed by this
code.
B. Composition. The planning commission shall consist of 5 members. The
members of the commission shall be appointed and subject to approval in accordance
with the city charter. The term of membership on the commission shall be 4 years, (Ord.
No. 1583)
C. Meetings. Regular meetings of the planning commission shall be held twice
per month on a day and at a time fixed by commission resolution and confirmed by the
city council. The city clerk shall distribute minutes of commission meetings to the city
council. (Ord. No. 1593)
D. Powers and Duties. The planning commission shall have the following
powers and duties:
1. To remain informed on matters affecting the function and duties of,
and matters before, the commission.
2. To exercise such powers and perform such duties as are provided by
state law for planning commissions of general law cities.
Note: Compensation $60 per meeting not to exceed 3 meetings per month - by
action of Council June 12, 1990
The appointment to fill the vacancy may be made by the City Council
on January 28, 2013 or thereafter.
