The Oity Oouncil of t~e Oity of Seal Beach met in regular
session at 7:30 P.M. and was called to order with salute to ~he
flag.

The minutes of r~gular meeting of March 2. 1944 were read
and approved.
PETITIONS
Petition- Petition in two sectlons bearing the names of 214 persons

Henkey. proposing the recall of Oouncilman Max Henkey, was read; also, the
statement of the Oity Olerk certifying that said Petitlon ls signed
by the requisite number of quallfied electors.
Councilman Postal raised the question of the legallty of t~e
joint Notice of Intentlon to circulate petltions for the recall of
two Counoilmen, which Notice was published in the Seal Beach Post.
He asked for ~n,oplnion from the Attorney General.

City Attorney Dana R. Willlams read sectlons from the
Elections Oode with reference to the Notice of Intention to circu-
late Recall Petitions. He stated that inasmuch as each Councilman
named in the Notlce was served lndivldually with a copy of said
Notice, he is of the opinion that one Notice of Intention to circu-
late Recall Petitlons is sufficlent to meet the requirements of the
law.
It was moved by Felts. seconded by-Postal that the Petltlons
be received and ordered filed, and that ths Clty Attorney be
directed to obtaln an oplnion from the Attorney General 'on the
legallty of the Petitlons, on the ground that the Notlce of Inten-
tion to clrculate petitions under Sections 11100 to 11122 of the

Elections Code, oontained the names of two officers sought to be
recalled, and that a joint petition was clrculated; and, subse-
quently a petition for the recall of each ~nd1vldual was clrcu-
lated and filed on the same joint Notice of Intentlon.

OOYMUNI OAT IONS
1. Pacific Coast Riflemen, Seal Beach Unit, by Harry Sewell, Cap~:
tainj and A. C. ~hafet Secretary - Submittlng the names of 27 members
of the local Riflemen, and asking that they be put on the payroll as
Deputy Police Offlcers at $1.00 per year for each member, in order to
be protected by State Compensation Insurance in case of injury while
on duty.
It was moved by Postal, seconded by Henkey that the 27 members of the
Seal Beach Riflemen Unit be placed on the payroll as Deputy Police
, per man,
Officers at a salary of $1.00 per year/retroactive to March 28, 19~3,
and that the Rifle Club notify the City when new members are added
to the Unlt.

the Council at meeting of March 2nd, 1944, authorizing the payment
of $5.00 to each of the 15 members of the Rifle Club, be rescinded.

It was moved by Felts, seconded by Hughes to instruct the City Att'y
to draw up a franohise to protect our cltlzen, Val C. Burch in the
operation of a taxicab business in the City of Seal Beach.

5. J. DeArmond, 124 - 7th Street, Seal Beach - Appllcation for
a five year lease wlth all commerclal rights, on the Seal Beach
Pier. Mr. DeArmond addressed the Council outlining what he proposes
to do. He suggested that for the duration, the monthly rent be set
at a certain figure for 7 months during the fishlng season, and a
lesser amount for the other flve months.
Mayor Reed suggested that the matter be referred to the Pier Co~
mittee and the City Attorney to work out the details of a lease.
It was moved by Felts, seconded by Hughes that Mr. DeArmond meet
with a Committee to be appointed by the Mayor, for the purpose of
discussion of matters in connection with the Pler lease.
Motion carrled.
Mayor Reed appointed the Finance and Pier Committees (Council-
men Postal, Hughes and Henkey) on the co~ittee wlt~ the Oity Att1y
to meet with Mr. DeArmond.
Mayor Reed introduced Assemblyman Sam L. Collins who is a
member oft the Interim 011 Oommittee. Mr. Oollins spoke briefly on
oil legls1ation in Oal~fornla wlth reference to drl11ing on tlde
lan<<s, and offered his assistance to the City if needed.
Gennett- Mr. E. M. Gennett, representing the Guy F. Atkinson 00., the

It was moved by Felts, seconded by Henkey that the matter of spur
track be referred to the 01ty Engineer for lnvestigation and report
back to the Council.
OOMMITTEE REPORTS
Councilman Hughes reported that the truck which is ln storage
can be purchased for .300.00. The Oommlttee was asked to continue,

On the question of voting rlghts of cltizens of the area
affected by the Naval Depot, City Attorney Dana R. Wl1l1ame read
Section 1 of Article 2 of the Constitution of Californla, whlch
stat~ in part, that any person duly registered as an elector ln 0..(:
one precinct and removing therefrom to another precinct in the same

Mr. Will lame stated that ~t is, therefore, his oplnion that any qual-
ifled elector ln Precinct 2 ln the Anahelm Bay area, retains his
right to vote in that precinct at the Regular Municipal. Eleotion on
April 11th, provided he does not move out of Orange Oounty before
date of election.
On the matter of a new oensus, City Attorney Dana R. Williams
reported that under the procedure outllned by the Bur~au of Census
the estimated cost of making such a census is the sUm of $555.00, of
which amount $3S0.00 must be deposited in a speclal account with the
Bank of America, subject to the check of the Supervisor for expense
of the enumeration of the censas, and $175.00 earmarked for additiona:
costs ln connection therewith.

HIRAM JOHNSON, UNITED STATES SENATOR FROM OALIFORNIA, TO LEND ASSIST-
ANOE TO THE RECORD OWNERS OF PROPERTl' I~ ANAHEIM BAY AREA AT THE TIME
SAID LAND WAS TAXEN OVER BY THE UNITED STATES NAVY, TO SECURE AN
OPTION. TO PURCHASE SUOH LAND IN THE EVENT THAT SUCH LAND IS ABANDONED
IN THE FUTURE.

Oouncilman Postal called attention to the fact that no
Notice has been published offering the Pier for lease.
The matter was referred to the Oity Attorney to prepare a Notics
for pUblication offering the Pler for lease, and authorized to
publish such Notice in the newspapers.
On the matter of the Army1s unpaid telephone and electric
bills while the Pier was used by the Army, C. A. Ml11er reported
that an itemized statement was sent to Captain Willlame showlng
amounts of $617.30 for electrlcltyand $41.05 fD~ telephone bills,
total 8658.35. The damage to the roadway of the Pier by Army trucks
was also called to the attention of the Army. Reply_was received
from Captaln Willlams requesting the City to send an .st~mate of
the damage. Mr. Miller stated that we should get a settlement soon
from the Army.
Nola Thomas, representing the Legion Auxillary, addressed
the Council calling attention to t~e scrap record drive now in p
progress. She asked about the old phonograph records in the Civic
Auditorium, and was given permisslon to flnd out to whom they be-
