City of Seal Beach Planning Commission • Agenda of October 7, 2009 PLANNING COMMISSION AGENDA INFORMATION SHEET The following is a brief explanation of the Planning Commission agenda structure: AGENDA APPROVAL: The Planning Commission may wish to change the order of the items on the agenda. ORAL COMMUNICATIONS: Anyone wishing to address the Planning Commission, only on items not on tonight’s agenda, may do so during this time period. No action can be taken by the Planning Commission on these communications on this date, unless agendized. PUBLIC HEARING ITEMS: Public Hearings allow citizens the opportunity to speak in favor of or against agendized items. More detailed information is found in the actual agenda attached. If you have documents to distribute, you should have enough copies for all Planning Commissioners, City staff and the public. Please give one to the secretary for the City files. The documents become part of the public record and will not be returned. CONSENT CALENDAR: Consent Calendar items are considered routine items that normally do not require separate consideration. The Planning Commission may make one motion for approval of all the items listed on the Consent Calendar. SCHEDULED MATTERS: These items are considered by the Planning Commission separately and require separate motions. These transactions are considered administrative and public testimony is not heard. STAFF CONCERNS: Updates and reports from the Director of Development Services (Planning and Building Departments) are presented for information to the Planning Commission and the public. COMMISSION CONCERNS: Items of concern are presented by the Planning Commissioners and discussed with staff. All proceedings are recorded. By Motion of the Planning Commission, this is the time to: (a) Notify the public of any changes to the Agenda; (b) Re-arrange the order of the Agenda; and/or (c) Provide an opportunity for any member of the Planning Commission, staff, or public to request an item be removed from the Consent Calendar for separate action. Minor Plan Review 09-6 601 Taper Drive 1 City of Seal Beach Planning Commission • Agenda of October 7, 2009 Applicant/Owner: William Vermulen / Thomas Motter & Kimberly Haber Request: To construct a new barbecue station and countertop, solid roof patio cover, outdoor gas fireplace, and a new spa/swimming pool, all to be located within the required side yard and rear yard setback areas. Recommendation: Approval, subject to conditions, and adoption of Resolution 09-34. 7. Minor Plan Review 09-8 410 Ocean Avenue Applicant/Owner: Richard Neri Request: To construct a new floating barbeque grill island, floating buffet with burners, in-ground Jacuzzi, sunken fire pit, composite wood deck, four (4) reflecting pools, and two (2) water features, all to be located within the required rear yard setback area. Conditional Use Permit 08-1 (Indefinite Extension) 12301 Seal Beach Boulevard (Sprouts Farmers Market) Applicant/Owner: Sprouts Farmers Market, LLC / Rossmoor Shops, LLC Request: Indefinite extension of an existing Conditional Use Permit to allow the off-premise sale of beer and wine (Type 20 License) in conjunction with an existing grocery store located within the Shops at Rossmoor Center. Recommendation: Approval, subject to conditions, and adoption of Resolution 09-33. 9. Variance 09-5 & Minor Plan Review 09-9 1101 Seal Way (Continued to October 21, 2009) Applicant/Owner: Michael Niemeyer 2 City of Seal Beach Planning Commission • Agenda of October 7, 2009 Request: To allow an approximate 207-sq. ft. expansion to an existing, nonconforming residential property. The property is currently nonconforming due to a less than required street side yard setback (existing setback is 3’-8”; required setback is 5’-8”); an inadequate garage setback from the public alley (existing setback is 4’-0”; required setback is 9’-0”); noncompliance with current density requirements (3 units are existing on the property, whereas only 1 unit would be allowed under the current Code); and less than required parking (4 spaces are provided, whereas 6 spaces are required under current City Code). Recommendation: Deny Variance 09-5 and approve Minor Plan Review 09-9, subject to conditions, and adoption of Resolution 09-32 and 09-38, respectively. 10. Variance 09-6 & Minor Plan Review 09-7 222 Central Way Applicant/Owner: Louis & Pamela Mannone Request: To allow an approximate 400-sq. ft. addition (enclosure of an approximate 200-sq. ft. covered breezeway, and the reduction of existing 695-sq. ft. 3-car garage to a 455-sq. ft. 2-car garage) to an existing, nonconforming residential property. The property is currently nonconforming due to a less than required garage setback from the public alley and a less than required street side yard setback. Recommendation: Approval, subject to conditions, and adoption of Resolution 09-35 and 09-36, respectively. 11. Variance 09-7 & Minor Plan Review 09-5 th 334 12 Street (Continued to October 21, 2009) Applicant/Owner: John & Michelle Currey Request: To allow an approximate 318-sq. ft. expansion to an existing, nonconforming residential property.
