HomeMy WebLinkAboutPC AG 2013-04-03 #4 PLANNING COMMISSION """"ER AGENDA REPORT 4 5 1 r TO: Planning Commission FROM: Jim Basham, Community Development Director DATE: April 3, 2013 SUBJECT: General Plan Amendment 13-3 and Zoning Map Amendment 13-4 1011 Seal Beach Boulevard (Accurate Storage) RECOMMENDATION: That the Planning Commission hold a public hearing regarding the proposed General Plan and Zoning Map amendments to designate the property at 1101 Seal Beach Boulevard for Residential High Density use, and after considering all information and testimony presented, adopt the attached Resolution (Attachment A) recommending that the City Council adopt these amendments and Mitigated Negative Declaration with Mitigation Monitoring and Reporting Program. LEGAL NOTIFICATION: A Notice of Intent to adopt a Mitigated Negative Declaration was published on February 28, 2013 in the Sun and circulated for public review for a period of 30 days (March 1, 2013 to April 1, 2013) and posted on March 1, 2013, in the Mary Wilson Library, Rossmoor/Los Alamitos Library, Leisure World Library and the City of Seal Beach Development Services Department with affidavits of publishing and posting on file. The legal notice of this Public Hearing was mailed to 138 property owners and occupants within a 500-foot radius of the subject property on March 18, 2013 and published in the Sun on February 28, 2013, with affidavits of publication and mailing on file. ENVIRONMENTAL ASSESSMENT: As required by the California Environmental Quality Act (CEQA), Staff prepared an Initial Study to determine what environmental impacts, if any, would be generated by the proposed project. Staff recommends that after consideration of the Initial Study and comments received during the public review period, that the Planning Commission exercise its independent judgment and conclude that with the implementation of certain mitigation measures, the proposed Project would not have a significant impact on the environment and therefore a Mitigated Negative Declaration with Mitigation Measures and Mitigation Monitoring and Reporting Program is recommended. General Plan Amendment 13-3 and Zoning Map Amendment 13-4 1011 Seal Beach Boulevard April 3, 2013 Page 2 of 5 An Initial Study/Mitigated Negative Declaration (MND) was prepared and posted in the Mary Wilson Library, Rossmoor/Los Alamitos Library, Leisure World Library and the City of Seal Beach Development Services Department on March 1, 2013 (Attachment D). The MND concludes that with the recommended mitigation measures, the project would not have a significant effect on the environment. At the time this report was prepared, no comments had been received on the MND. Staff will update the Commission at the public hearing regarding the status of public comments. General Plan Amendment 13-3 and Zoning Map Amendment 13-4 1011 Sea] Beach Boulevard April 3, 2013 Page 3 of 5 BACKGROUND: On April 9, 2012, the City Council adopted the Seal Beach Housing Element for the 2008-2014 planning period, and on June 1, 2012 the California Department of Housing and Community Development (HCD) issued a letter finding the element in compliance with state law. (Attachment B.) The 2008 Housing Element includes several programs calling for amendments to City plans and zoning regulations in order to accommodate the City's share of regional housing needs and to comply with state housing law. On November 13, 2012, the City Council initiated General Plan and zoning amendments to redesignate the Accurate Storage property at 1011 Seal Beach Boulevard' from Industrial-Light to Residential High Density with a maximum of 20 units per acre. Completion of this program is necessary in order to ensure that the City's Housing Element remains in full compliance with state law. ANALYSIS: Purpose. The purpose of the proposed General Plan and zoning amendments for the Accurate Storage site is to implement Program 1 a of the Housing Element and thereby satisfy the City's obligations under state Housing Element law to ensure that adequate sites with appropriate zoning are available to accommodate the Regional Housing Needs Assessment (RHNA) allocation for the 2008-2014 planning period. As part of the preparation of the 2008 Housing Element, the General Plan/LCP Ad Hoc Committee, Planning Commission and City Council reviewed several alternatives for meeting the RHNA, and the certified Housing Element identifies four potential sites that could potentially satisfy the rezoning requirement. However, in its letter reviewing the adopted Housing Element (Attachment B), HCD indicated that it did not consider the Sunset Aquatic Park to be a suitable site. On November 13, 2012, the City Council initiated General Plan and zoning amendments to redesignate the Accurate Storage site for multi-family residential use (Attachment C). Planning Commission Authority. Under Municipal Code § 11.5.15.020, the Planning Commission is required to conduct a public hearing on proposed General Plan and Zoning amendments and adopt a resolution recommending to the Council its recommended action. For City Council initiated actions, failure of the Commission to adopt a resolution shall be deemed to be a recommendation of approval. Analysis. The Accurate Storage site is developed with a light industrial building, surface parking and landscaping and is currently used for RV and boat storage. No vehicle sales or maintenance takes place on the site. The proposed amendments would change the General Plan land use designation for the property from Industrial- Light to Residential High Density and change the Seal Beach Zone Map designation for the property from Light Manufacturing to Residential High Density-20. These amendments would allow (but not require) development of multi-family housing units at a density of up to 20 units per acre on this 4.5-acre property. General Plan Amendment 13-3 and Zoning Map Amendment 13-4 1011 Seal Beach Boulevard April 3, 2013 Page 4 of 5 currently proposed in connection with these amendments, and the existing RV storage use would be allowed to continue on this site if these amendments are approved. If the proposed amendments are adopted, the property owner would have the option of continuing the existing business or pursuing redevelopment of the site. Maximum building height in the RHD district is 25 feet, which is the same as for the Residential Low Density district and the Heron Pointe development to the south. The immediately adjacent properties to the north and west are developed with parking lots and office/light industrial uses, and the City Police Department and Public Works facilities are across Adolfo Lopez Drive to the south. None of the surrounding uses present any conditions that would be incompatible with residential use of the site and Seal Beach Boulevard provides good access and bus service to surrounding areas. Any new development would be required to comply with all standard conditions regarding construction operations, including work hours, protection of archaeological resources, erosion and dust control, construction traffic control, and payment of impact fees for schools, parks, and utilities. A question has been raised of whether the City must re-zone the entire site for multi- family units as opposed to rezoning only the minimum portion of the site required to accommodate the City's RHNA allocation of 19 multi-family units for the 2008-2014 planning period and the City's RHNA allocation of 2 for the next cycle, 2013-2021. As a threshhold issue, the November 13, 2012 staff report to the City Council states: "Staff is requesting that -the City Council, under Municipal Code Section 11.5.15.005.B, initiate a General Plan Amendment and a Zone Change to redesignate the four-acre property located at 1701 Adolfo Lopez Drive to permit multi-family residential development at a density of 20 to 33 units per acre," and the City Council adopted staff's recommendation by minute order. In consultation with the City Attorney, it is our professional opinion that amending the General Plan and zoning for only a portion of the site could have undesirable consequences from a land use and planning standpoint, including the following: 1. It may be infeasible to subdivide the site in a manner that would enable developent of a 19-21 unit residential project that conforms to all development standards (such as setbacks, parking and internal circulation that meets Fire Department access standards including drive aisle widths and fire apparatus turning radii), while retaining the existing light industrial building on a residual parcel that also meets all Code requirements. Relying on a potentially infeasible development option to satisfy the City's RHNA obligation could jeopardize the certification of the Housing Element. 2. Allowing a high-density residential development in very close proxirniity to a light industrial use could create land use compatibility issues. 3. Designating only a portion of the site for residential use would create a "split zoning" condition. The property owner would not be able to sell the residential portion without subdividing the lot. As stated in our recommendation, staff is recommending that the Commission adopt the proposed resolution. However, the Commission has the discretion to direct staff to present other recornmendations. ("CEQA") and the State CEQA Guidelines, 14 C.C.R. § 15000 et seq., a Mitigated Negative Declaration ("MND") has been prepared for GPA 13-3 and ZMA 13-4. The MND finds that these amendments would not have a significant effect on the environment if subject to the mitigation measures described in the Mitigation Monitoring and Reporting Program ("MMRP") that is included as Exhibit B-2 within this Resolution. The Planning Commission, in its independent judgment, hereby finds the MND and the MMRP comply with CEQA and recommend the City Council adopt them. Section 3. The Planning Commission recommends that the City Council adopt General Plan Amendment 13-3 and Zoning Map Amendment 13-4. The Department is required to review adopted housing elements and report the findings to the locality pursuant to Government Code Section 65585(h). The Department is pleased-lo find the adopted housing element in full compliance with State housing element law (Article 10.6 of the Government Code). The element now identifies adequate sites to accommodate Seal Beach's regional housing need for lower- income households demonstrated by Program 1 a to rezone at least 0.58 to 0.95.acres to high density residential at a density of 20 to 33 units per acre by June, 2012. Please be aware, the Department's determination of adequate sites did not consider the potential capacity of the Sunset Aquatic Park site (Table B-3) as due to the need for negotiation with the County, this site is not likely to be available for rezoning within the planning period. The City must monitor and report on the results of this and other programs through the annual.progress report, required pursuant to Government Code Section 65400. The Department congratulates Seal Beach on adopting its first compliant housing element. This accomplishment positions the City to effectively access important State resources and implements Seal Beach's vision for a sustainable future. By successfully planning for an adequate supply of housing, the City can meet important housing and community development objectives including promoting a variety of housing types, facilitating more compact development while maximizing land resources, and promoting economic vitality. The Department.is pleased to report the City now meets specific requirements for several State funding programs designed to reward local governments for compliance with State housing element law. Ingram, City Manager The City Manager wished everyone a happy, healthy, and safe Thanksgiving and introduced Luis Estevez who will be the new Deputy Director of Public Works/Maintenance and Utilities. ' COUNCIL COMMENTS Councilman Sloan announced that he had attended the Veteran's Day service at Eisenhower Park; Mayor Pro Tern Miller stated that former Mayor Patty Campbell's husband passed away and the memorial service will be on Saturday, November 17th; Councilwoman Deaton requested an item be placed on a future agenda to discuss limiting pier fishing times, areas, and enforcement options; and Mayor Levitt said that he also attended the Veteran's Day services at Eisenhower Park.
