SUBJECT: Specific Plan Amendment 13-2 to the Boeing Integrated
Defense Systems (BIDS) Specific Plan regarding
emergency shelters
RECOMMENDATION: That the Planning Commission hold a public hearing
regarding the proposed amendment to the BIDS Specific
Plan, and after considering all information and testimony
presented, adopt the attached Resolution (Attachment A)
recommending that the City Council adopt the
amendment.
LEGAL NOTIFICATION:
A Notice of Intent to adopt a Mitigated Negative Declaration was published on February
28, 2013 in the Sun and circulated for public review for a period of 30 days (March 1 ,
2013 to April 1, 2013) and posted on March 1 , 2013, in the Mary Wilson Library,
Rossmoor/Los Alamitos Library, Leisure World Library and the City of Seal Beach
Development Services Department with affidavits of publishing and posting on file.
The legal notice of this Public Hearing was mailed to 138 property owners and
occupants within a 500-foot radius of the subject property on March 18, 2013 and
published in the Sun on February 28, 2013, with affidavits of publication and mailing on
file.
ENVIRONMENTAL ASSESSMENT:
As required by the California Environmental Quality Act (CEQA), Staff prepared an
Initial Study to determine what environmental impacts, if any, would be generated by the
proposed project. Staff recommends that after consideration of the Initial Study and
comments received during the public review period, that the Planning Commission
exercise its independent judgment and conclude that with the implementation of certain
mitigation measures, the proposed Project would not have a significant impact on the
environment and therefore a Mitigated Negative Declaration with Mitigation Measures
and Mitigation Monitoring and Reporting Plan is recommended.

An Initial Study/Mitigated Negative Declaration (MND) was prepared and posted in the
Mary Wilson Library, Rossmoor/Los Alamitos Library, Leisure World Library and the City
of Seal Beach Development Services Department on March 1, 2013 (Attachment D).
The MND concludes that with the recommended mitigation measures, the project would
not have a significant effect on the environment. At the time this report was prepared,
no comments had been received on the MND. Staff will update the Commission at the
public hearing regarding the status of public comments.

BACKGROUND:
On April 9, 2012, the City Council adopted the Seal Beach Housing Element for the
2008-2014 planning period, and on June 1, 2012 HCD issued a letter -finding the
element in full compliance with state law.
The 2008 Housing Element includes several programs calling for amendments to City
plans and zoning regulations in order to accommodate the City's share of regional
housing needs and to comply with state housing law.
State law requires that every city identify at least one zone where emergency shelters
are permitted by-right subject to appropriate development standards. "Emergency
shelters" for purposes of this requirement are year-round facilities providing short-term
shelter with minimal supportive services for homeless persons and families. In
accordance with state law, the Housing Element identifies the BIDS Specific Plan as
the proper location for allowing emergency shelters by right.
ANALYSIS:
The proposed amendment to the BIDS Sepcife Plan would allow emergency shelters
subject to the development standards established in the Municipal Code under MCA
13-1 (see related agenda item), which include:
• A Maximum of 10 beds.
• A Minimum separation of 300 feet between emergency shelters.
• Approval of a Management Plan, which shall establish hours of operation, staffing
levels, maximum length of stay, size and location of exterior and interior onsite
waiting and intake areas, and security procedures.
• Other development standards as required by the BIDS Specific Plan.
Applications for emergency shelters would be reviewed by the Community
Development Director and approved if all requirements are satisfied.
CONCLUSION:
It is recommended that the Commission conduct the public hearing and consider
adoption of the attached resolution.

THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES
HEREBY FIND AND RESOLVE
Section 1. On April 3, 2013 the Planning Commission held a duly noticed public
hearing to consider Specific Plan Amendment 13-2, which would amend the Boeing
Integrated Defense Systems ("BIDS") Specific Plan to allow emergency shelters as set
forth in the draft City Council ordinance included as Exhibit A to this Resolution.
Section 2. In compliance with the California Environmental Quality Act, Cal. Pub.
Res. Code § 21000 et seq. ("CEQA") and the State CEQA Guidelines, 14 C.C.R. §
15000 et seq., a Mitigated Negative Declaration ("MND") has been prepared for SPA
13-2. The MND finds that the amendment would not have a significant effect on the
environment if subject to the mitigation measures described in the Mitigation Monitoring
and Reporting Program ("MMRP") that is included as Exhibit A-1 of this Resolution. The
Planning Commission, in its independent judgment, hereby finds the MND and MMRP
comply with CEQA and recommend that the City Council adopt them.
Section 3. The Planning Commission recommends that the City Council adopt
Specific Plan Amendment 13-2.

1. Emergency shelters shall be permitted subject to the provisions of Municipal Code
Sec. 11.4.05.140
Section 2. In compliance with the California Environmental Quality Act, Cal.

15000 et seq., a Mitigated Negative Declaration ("MND") has been prepared for SPA
13-2. The MND finds that the amendment would not have a significant effect on the

and Reporting Program ("MMRP") that is included as Exhibit A-1 to this Resolution. The
City Council, in its independent judgment, hereby approves the MND and the MMRP.
Section 3. The City Clerk shall certify to the passage and adoption of this

in the manner required by law.
