Chair Massa-Lavitt called the regular meeting of the Planning Commission to
order at 7:30 p.m. in the City Council Chambers and the Chair asked Barbara
Barton to lead the Salute to the Flag.
ROLL CALL
Present: Chair Massa-Lavitt;
Commissioners: Campbell, Cummings, Sloan
Absent: Commissioner Goldberg

APPROVAL OF AGENDA
With no objections, the Chair so ordered the approval of the agenda as
presented.
ORAL COMMUNICATIONS
Chair Massa-Lavitt opened oral communications. Speaker(s): Mike Buhbe,
Central Way, inquired about the low income housing property. There were no
other speakers - Chair Massa-Lavitt declared oral communications closed.
CONSENT CALENDAR
Campbell moved, second by Sloan, to approve the recommended actions on the
consent calendar, as presented.
AYES: Campbell, Cummings, Massa-Lavitt, Sloan
NOES: None
ABSENT: Goldberg Motion Carried

PUBLIC HEARINGS
2. Conditional Use Permit 12-12 Property 1605 Seal Way
(Continued from October 3, 2012-December 19, 2012—February 6, 2013)
Applicants: Frank and Jenny Tomich
Owners: Frank and Jenny Tomich
Request: For a Conditional Use Permit (CUP) to allow a short-term
vacation rental property within the Residential High Density
(RHD-20) zone at 1605 Seal Way.
Recommendation: Deny Conditional Use Permit 12-12.
Resolution No. 12-22
The Senior Planner provided an updated staff report (item has been continued
three times): The subject property is a legal non-conforming triplex towards the
front of the property (three bedroom unit on the second and third floors and two
bedrooms on the ground floor unit) and a detached structure with an owner
occupied unit above the two car garage — due to non-conforming rear yard
setback there is not adequate space to park a standard size car within the area
between the garage and the rear property line — open parking space adjacent to
the garage would not be usable for parking between the 2 properties. Staff does
not believe the physical layout and dwelling unit concentration of the site is
adequate due to lot density and inadequate off-street parking. Staff
recommended denial of CUP 12-12.
Chair Massa-Lavitt opened the public hearing. Speakers: Frank Tomich,
applicant/owner, stated his case for approval of CUP 12-12 — indicated he
submitted a letter on February 28, 2013 to the Planning Commission explaining
how he will address the parking issue by allowing the tenants the use of the 2
garage spaces and the 2 on-street guest parking passes and he would park his
vehicles in the tandem space between the 2 properties — with this new plan for
parking, Mr. Tomich indicated he had informed his attorney not to go forward with
the land survey. There were 3 speakers in opposition to the request for CUP 12-
12 and there were no speakers in-favor of the approval.
After Planning Commission deliberation; Cummings moved, second by
Campbell, to adopt Resolution 12-22 denying Conditional Use Permit (CUP) 12-
12 for use as a short-term vacation rental.
AYES: Campbell, Cummings, Massa-Lavitt, Sloan
NOES: None
ABSENT: Goldberg Motion Carried
The City Attorney advised that the adoption of Resolution No. 12-22 denying
CUP 12-12 is the final decision of -the Planning Commission. There is a 10-day
appeal period to the City Council and the appeal period begins March 21, 2013.

DIRECTOR'S REPORT
The Director of Community Development stated that the Planning Commission
will meet in a joint public workshop with the AdHoc General Plan/Local Coastal
Plan Citizens Advisory Committee on Wednesday, April 3rd at 6:00 p.m. to review
the draft 2013-2021 Housing Element; and that the Planning Commission
meetings will begin at 7:00 p.m. starting April 3, 2013.
COMMISSION CONCERNS
None at this time.
ADJOURNMENT
With no objections, Chair IVlassa-Lavitt adjourned the Planning Commission
meeting at 7:57 p.m. to Wednesday, April 3, 2013 at 6:00 p.m. for a joint public
workshop with the AdHoc General Plan/Local Coastal Plan Citizens Advisory
Committee to review the draft 2013-2021 Housing Element.
