Crumby P.E., Assistant City Manager/Public Works SUBJECT: TIGER GRANT APPLICATION SUMMARY OF REQUEST: Council Member Levitt requested that staff place on the agenda a discussion item regarding the TIGER Grant Program. BACKGROUND: During the public comment portion of the May 13, 2013 City Council meeting, a member of the public asked the City to agendize a discussion item regarding the TIGER Grant Program to fund a project within Leisure World. The TIGER Grant Program: According to the United States Department of Transportation (USDOT), the purpose of the Transportation Investment Generating Economic Recovery (TIGER)grant program is to "invest in road, rail, transit, and port projects that achieve critical national objectives" and have "a significant impact on the Nation, a region or a metropolitan area." Funding for the TIGER Grant Program has proceeded in several annual phases, with decreasing funding levels each year. Congress previously allocated $1.5 billion for TIGER I in 2009, $600 million for TIGER II in 2010, $527 million in 2011, and $500 million in 2012. According to the Notice of Funding Availability for 2013 TIGER Grants that was published in the Federal Register on April 26, 2013, $473 million will be available for eligible projects for the next cycle. Grants can vary between $10 million and $200 million and require a minimum local contribution of at least 20%. Grant applications are due on June 3, 2013. Applications may be submitted by any state, local, or tribal government, including U.S. territories, transit agencies, port authorities, Metropolitan Planning Organizations (MPOs), other political subdivisions of any state or local government. Multi-state or multi jurisdictional groups may apply through a single lead applicant, provided that each member of a multi-jurisdictional group must otherwise be an eligible applicant. All project co-applicants and project partners must sign onto the application or provide letters of support. Agenda Item A A listing of projects previously funded by the TIGER Grant Program is attached to this report. Each funded project has been multi-modal, multi-jurisdictional, or otherwise challenging to fund through existing programs, and typically involves support from regional planning and transportation agencies. As the following breakdown shows, relatively few have been awarded in California. TIGER I —FY 2009 51 projects (4 in California) TIGER 11 — FY 2010 42 projects (4 in California) TIGER— FY 2011 46 projects (3 in California) TIGER—FY 2012 33 projects (3 in California) Leisure World Storm Drain Channel: Leisure World residents have requested that the City apply for a grant to cover the open storm drain channel at Golden Rain Road in Leisure World and construct a new Leisure World entrance from Westminster Avenue at Island Village Drive. The channel is owned and maintained by the Orange County Flood Control District (OCFCD). The work requested would be mostly within the boundaries of Leisure World, which is privately owned by the Golden Rain Foundation (GRF). If this project were to move forward as proposed, it would likely follow the following rough timeline: June 3, 2013 Submittal of grant application. Fall 2013 Announcement of grant recipients Fall 2013 — Summer 2014 Environmental review Summer 2014—Summer 2015 Project design The design process would likely be extensive involving numerous agencies and entities; including but not limited to the Federal Government, OCFCD, Los Angeles County, City of Long Beach, and the GRF. Environmental review would be in accordance with the National Environmental Protection Act (NEPA), and the California Environmental Quality Act(CEQA). An Environmental Impact Report/Environmental Impact Study would likely be needed. Summer 2015— Summer 2016 Construction The residents who have requested the City submit an application for the project estimate the project will cost $12.5 million, which would require a local match of $2.5 million. They have also provided the City with a draft application. A review of the application and the estimated costs is currently in progress. The same residents made a similar request of the City in 2012. At that time, the project entailed covering the storm drain channel that runs inside Golden Rain Road as well as the storm drain channel that lies north of Westminster Avenue between Seal Beach Boulevard and the western city limits. They estimated that the work would cost $20 million. The City Council decided not to grant their request because the City was not prepared to provide the entire required 20% matching funds ($4.0 million). Additionally, the short time frame between announcement of the grant and the application deadline did not provide the City with adequate time to Page 2 analyze the project, or any other storm drain channel projects citywide of higher priority that may qualify for funding, and allocate staff time to preparing the grant application. On May 13, 2013, the Leisure World Finance Committee discussed the feasibility of Leisure World and/or partners pledging $2.5 million toward the local contribution for the project. A request for the funding was presented to the GRF Board of Directors on May 21, 2013, and GRF approved proceeding with a TIGER Grant application as a partner with the City of Seal Beach being the applicant and GRF making a commitment to fund the 20% matching funds. The GRF Board of Directors did however direct the group of residents to request that the City of Seal Beach participate in funding a portion of the 20% required match. In the event it is the consensus of the City Council to apply for the grant, it is recommended that it be contingent upon receiving a written commitment from GRF, to be followed by establishing an escrow account for GRF funds. Challenges: There are significant challenges for the proposal. The first challenge is financial. If the GRF Board does not provide a formal letter dedicating funding for the project, and then placing the funds into an escrow account (with a third party back), the City would have to solely allocate the local matching requirement given that no other local or state agency appears interested in the project. Neither the Southern California Association of Governments (SCAG) nor the Orange County Transportation Authority (OCTA) has been involved in the project, and it is unlikely that the project would provide a benefit to either organization. If the local funding obligation falls in part or entirely on the City, it would likely impact the City's ability to meet other previously identified capital improvement needs. The City's FY 2012-13 Capital Improvement Program already lists unfunded infrastructure needs of $142 million. Staff anticipates that the unfunded needs in FY 2013-14 will be even larger due to park needs being indentified in the nearly completed Parks and Recreation Master Plan. The City has also previously identified approximately $72 million in storm drain needs elsewhere in the City where flooding has historically been a greater problem and not occurred on property that is not owned or maintained by the City. The second challenge is the lack of cooperation and assistance of other public agencies. As discussed above, projects that receive TIGER grants typically involve multiple agencies or jurisdictions. In this case, the Los Angeles Department of Power and Water would need to dedicate property to the project, and the City of Long Beach would need to coordinate integration with Westminster Avenue. Most significantly, OCFCD, which owns and maintains the storm channel inside Leisure World, would have to approve any use of the ground surface above any underground drainage structures. OCFCD has indicated to City staff that it is not in favor of the project. OCFCD has said that covering the channel would have "No Flood Control Benefit" and would increase OCFCD's maintenance costs. It therefore appears unlikely that OCFCD would agree to sign onto the TIGER Grant application or provide a letter of support. Finally, preparation of the grant and execution of the project if the grant is approved, would significantly impact City staffing needs for a project that is not currently identified Page 3 in the Capital Improvement Program (CIP) or Annual Budget, is predominantly located on private property, and would primarily benefit private property. ENVIRONMENTAL IMPACT: Submittal of a grant application does not qualify as a project under either CEQA or NEPA. If the project is ultimately approved and funded, however, its environmental impacts would be reviewed in accordance with CEQA and NEPA. LEGAL ANALYSIS: The City Attorney has reviewed this staff report and approved it as to form. FINANCIAL IMPACT: The financial impact on the City would vary depending on the availability of funding from other local groups. If the City were to solely fund the local matching component, it would require the City to provide the entire $2.5 million. It has been the standard practice of the City of Seal Beach to budget for matching amounts at the time of the grant application. This is particularly of importance as the grant amount increases in size. Applications for TIGER Grant funds are to be submitted only by a government entity, such as a city or state, and are due June 3, 2013. The grant award amounts will range between $10-200 million, with recipients required to provide an 80-20 match. At its meeting on May 13, 2013, the Golden Rain Foundation (GRF) Finance Committee addressed the possibility of obtaining funds to cover the open drainage channel along Golden Rain Road with a TIGER Grant funding the majority of the cost. The estimated cost of covering the Federal Storm Channel C01 S06 would be $12.5 million, with Leisure World and/or partners pledging 20% ($2.5 million) of the total. The Finance Committee is requesting the Golden Rain Foundation Board of Directors, at their May 21st meeting, to petition the City of Seal Beach to submit the TIGER Grant application. Leisure World and the City should be informed approximately three months thereafter as to the application's acceptance by the U.S. department ofi Transportation.
