Ingram, City Manager FROM: Jim Basham, Director of Community Development SUBJECT: RESIDENTIAL USE IN THE BOEING INTEGRATED DEFENSE SYSTEM SPECIFIC PLAN AREA AND/OR THE PROPERTY ADJACENT TO MARINA PARK (Deaton/Miller) SUMMARY OF REQUEST That the City Council receive and file this report. BACKGROUND On May 29, 2013, the City Council introduced Ordinance No. 1629, which, if adopted, would rezone the property located at 1011 Seal Beach Boulevard (commonly referred to as "Accurate Storage") from Light Industrial to Residential High Density ("RHD-20") to accommodate the City's share of the Regional Housing Needs Assessment ("RHNA"), Mayor Pro Tern Deaton also requested that staff meet with representatives of the Boeing Corporation to determine whether Boeing would be in favor of amending the Boeing Integrated Defense Systems ("BIDS") Specific Plan to allow residential use as a permitted use within the BIDS Specific Plan area. The City Council asked that the matter also be placed on a future agenda for discussion. Additionally, at the June 10, 2013 Council meeting, Mayor Miller requested that staff include the property adjacent to Marina Park within the discussion. DISCUSSION 1. Boeing Property The BIDS Specific Plan area includes approximately three acres of excess parking area located along the southern edge of Westminster Avenue, east of Apollo Drive. It is zoned for specific plan regulation and currently residential uses are not permitted. Agenda Item — A Staff met with Boeing representatives on June 5, 2013, and based upon discussion that took place at that meeting, staffs recommendation is that the City Council not consider the Boeing site as feasible for potential high density residential zoning for the following reasons: • Boeing is considering the Seal Beach site, along with others in the area, for employee expansion in the Southern California region, • Boeing's corporate policy prohibits residential development, in any form, on its properties, • Boeing regularly imposes deed restrictions that preclude future residential development on its properties. • Boeing's commercial and defense operation must be able to continue to maintain site control, high-level security, and aggressive risk management controls that are imperative to their operation, 2. Property adjacent to Marina Park The property is approximately four acres and located on the southeastern side of First Street adjacent to Marina Park. It is zoned for oil extraction and is currently vacant. The owner previously indicated a desire to develop the site for residential use, but it is unknown if this is still the owner's intent. The City recently submitted and was unsuccessful in being awarded a Prop. 84 statewide parks grant for the possible expansion of Marina Park to include a community pool. 3. Site Studies and Analyses If the City Council directs staff to initiate the process to allow residential uses on either site, feasibility and environmental impact studies are necessary. The feasibility study would examine such matters as the likelihood of residential development and the scope of necessary legislative amendments (e.g., zoning map and general plan amendments) and administrative approvals and entitlements (e.g., subdivision approval) that would be necessary before the sites could be developed with residential uses. The environmental assessment would examine such matters as land use compatibility, parking, transportation/traffic circulation, aesthetics, and air quality impacts. LEGAL ANALYSIS The City Attorney has reviewed this report. Page 2 CONCLUSION/FINANCIAL IMPACT Staff estimates that the City's consultant would need four to five months to complete the necessary analyses at a cost to the City of $22,000 for one site and $40,000 for both sites. Either course of action would require an amendment to the consultant's contract (Douglas & Associates) and to amend to the FY 201312014 Budget.
