Receive and file the staff report; and 2. Waive further reading and adopt Ordinance No. 1629 approving Zoning Map Amendment (ZMA 13-4) for the property at 1011 Seal Beach Boulevard for High Density Residential-20. At its meeting of May 29, 2013, the City Council conducted a public hearing for consideration of Resolution 6377 (General Plan Amendment 13-3) and Ordinance No. 1629 regarding changing the zoning designation for the property located at 1011 Seal Beach Boulevard (the "Site"). After closing the public hearing, the Council adopted Resolution 6377 and introduced Ordinance No. 1629. The general plan amendment and zoning ordinance are part of the 2008- 2014 adopted Housing Element implementation programs to fulfill the City's Regional Housing Needs Assessment (RHNA) housing obligations. At its meeting of July 8, 2013, the City Council instructed staff to agendize the second reading and also present scenarios demonstrating the estimated maximum number of residential units that can be developed on the Site. Staff prepared two scenarios applying the City's Municipal Code requirements and analyzing single-family and multi-family development opportunities. Under each scenario, the determination of buildable land area was calculated based upon land remaining after right-of-way dedication, parkland and open space allocation, and perimeter buffer zones. (Refer to the Attachment). Please note that potential development of the site could take many forms. Thus, staffs Agenda Item M analysis was designed to attempt to estimate the maximum number of units, based upon Municipal Code requirements. 1. Estimate of the maximum number of units in a hypothetical "Single Family Development" project: 50 units. Under this scenario, the maximum number of single - family units is estimated to be 50 with lots at least 2,500 square feet in area. Minimum lot size under the Code for single family development is 2,500 square feet. The amount of buildable land is 126,710 square feet. Please note that under the City's Subdivision Ordinance, the City can require only fees in lieu of parkland dedication for subdivisions of 50 lots or less. Thus, unlike scenario number 2, there would be no parkland dedication if the owner of the site submitted a subdivision for 50 lots or less. In that case, the Municipal Code requires a flat fee of $10,000 per lot, which would be $500,000 for 50 lots. 2. Estimate of the maximum number of units in a hypothetical "Multi Family Development" condominium project: 65 units. Under this scenario, the maximum number of multi - family units is estimated to be 65 with a unit foot pad of 1,308 square feet. The amount of buildable land is 85,030 square feet because cluster units require additional open space, guest parking, and perimeter maneuverability, for fire prevention vehicles and apparatus. The Subdivision Ordinance requires parkland dedication of 392 sq. ft. per multiple family unit. The Zoning Code requires common open space of 2,000 sq. ft. plus 500 sq. ft. per 10 units above 40 units. In addition, the Code requires private open space of 200 sq. ft. per unit. ENVIRONMENTAL IMPACT: On May 29, 2013, the City Council approved and adopted a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for the rezoning of the subject property in connection with its approval of General Plan Amendment 13 -3, changing the land use designation of the property to residential high density. No further environmental review is required. LEGAL ANALYSIS: The City Attorney has reviewed and approved the ordinance as to form. FINANCIAL IMPACT: There is no financial impact related to this item. In compliance with the California Environmental Quality Act, Cal. Pub. Res. Code § 21OOOegseq. (CEDA^)and the State CECA Guidelines, 14 C.C.R. §15OOD etseq.. a Mitigated Negative Declaration (^K4NC") has been prepared for Zoning Map Amendment 13-4, which would amend the City's Zoning [Nmp to change the zoning designation of the property located at 1011 8em| Beach Boulevard to Nao|donUml High Dano|b/-20. The K4ND finds that the amendment would not have o significant effect on the environment if subject to the mitigation measures described in the Mitigation Monitoring and Reporting Program (,&1&1RP^). The City Counci|, in its independent judgment, approved and adopted the yNND and the N1K8RPon May 29, 2O13 for the rezoning of the property in connection with its approval of General Plan Amendment 13-3 designating the property for Residential High Density use.
