Ingram, City Manager FROM: Joseph Stilinovich, Chief of Police SUBJECT: BOARD OF STATE AND COMMUNITY CORRECTION FUNDS (BSCC) SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6413 authorizing the City Manager to accept the local assistance law enforcement funds from the Board of State and Community Corrections (BSCC) in the amount of approximately $25,000; authorizing the Chief of Police to expend these funds for law enforcement services; and approving Budget Amendment No. 14-04-01. BACKGROUND AND ANALYSIS: Legislation associated with the California 2011 Budget Act established the Board of State and Community Corrections (BSCC) as an independent entity, effective July 1, 2012. The BSCC assumed the previous functions of the Corrections Standards Authority, as well as other public safety programs previously administered by the California Emergency Management Agency. Due to the steady erosion of funding for city police agencies over the past several years, local communities have experienced significant public safety impacts. In order to assist in mitigating these reductions, funds were appropriated to create a new program. This funding recognizes the need for city law enforcement to be able to provide front-line services based upon their own regional needs. As part of the 2012 Budget Act, $20 million for local assistance was appropriated for city police departments, with the allocation formula to be developed by the BSCC in consultation with the Department of Finance. In January 2013, the Governors Proposed Budget was released and included an additional $4 million augmentation to the aforementioned appropriation, for a total of $24 million for local assistance. The California Police Chiefs Association, on behalf of local law enforcement agencies, presented to the BSCC an allocation formula based upon regional Agenda Item E needs in each county. The BSCC recognized the importance of local agencies being able to best identify their own needs with regards to the use of resources, and approved the formula. Orange County agencies were allocated a total of approximately $1.43 million which is being dispersed by the City of Garden Grove. The City of Seal Beach has been allocated approximately $25,000. ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. LEGAL ANALYSIS: The City Attorney has reviewed and approved as to form. FINANCIAL IMPACT: The City will receive funds of approximately $25,000 for front-line law enforcement services. RECOMMENDATION: That the City Council adopt Resolution No. 6413 authorizing the City Manager to accept the local assistance law enforcement funds from the Board of State and Community Corrections (BSCC) in the amount of approximately $25,000; authorizing the Chief of Police to expend these funds for law enforcement services; and approving Budget Amendment No. 14-04-01. Ingram, City i ager RESOLUTION NUMBER 6413 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL ACCEPTING BOARD OF STATE AND COMMUNITY CORRECTIONS (BSCC) LOCAL ASSISTANCE FUNDING VIA THE CITY OF GARDEN GROVE WHEREAS, the Cty of Seal Beach desires to receive Board of State and Community Corrections (BSCC) funds made available through the 2012 Budget Act and distributed to Orange County Law Enforcement Agencies through the CIty of Garden Grove. THE SEAL BEACK CITY COUNCIL HEREBY RESOLVES THAT: Section 1. The City Manager is authorized to accept BSCC funds in the amount of approximately $25,000 on behalf of the City of Seal Beach. Section 2. That funds received hereunder shall be used for Law Enforcement Services as determined by the Seal Beach Chief of Police. Section 3. The City Council hereby approves Budget Amendment No. 14-04'01 and directs the Director of Finance to modify the Fiscal Year 2013/2014 budget. City Clerk Board of State and Community Corrections (BSCC) FAQ The BSCC allocation provides funding for local law enforcement assistance and is not a grant, so there are no "rules" regarding permissible uses, reporting, etc. However, the answers' below may be used to guide your decisions as to how your agency will handle these funds. 1. Is thls considered grant? ANSWER: No, this is not a grant. The 2012 Buciget Act provided funding to city police departments to enable front-line intervention services in each county. 2. Are there any restrictions/requlrernents regarding how the funds may be used? (e.g.: no supplanting, no overtime, etc.) ANSWER: There are no restrictions on how each agency decides to use their portion of the funds. Each Chief of Police decides how best to use their portion ofthe funds. 3. Are there any reporting requirements at all (e.g.: local agencies to county fiscal agent, fiscal agent to the State, etc.)? ANSWER: No, there are not reporting requirements contained in the budget language. 4. As the flscal agent f�r the Orange County portiort of the funds, does Garden Grove have any obligations to fulfill other than distributing the funds? ANSWER: No. The funding awards were determined on an approved formula-based allocation proposed by the California Police Chiefs' Association (CPCA) based on local need. Your city was chosen as the fiscal agent for local disbursement by the CPCA.
