I I KI 171%r KA AM. lrmlmr, C i t of S e a l B e a c h J I.. ...- Ar—K Planning Commission Staff Report Conditional Use Permit 13-4 302 Main Street November 6, 2013 The subject site is located in the Main Street Specific Plan area located at the corner of Electric Avenue and Main Street. The subject site is a 1,820 square foot tenant space, in a four-unit commercial building, previously occupied by Who Voyage (DBA: The Main Street Wine Cellar. The Planning Commission approved Conditional Use Permit 08-3 to allow the business to operate as a wine bar/wine store. The business was classified as a retail use and required to provide parking. The business was deficient two parking spaces and was required to participate in the Main Street In-Lieu Parking Program. The applicant paid the full Parking In-Lieu Fee for the two deficient parking spaces. The Parking In-Lieu Fee paid for the two spaces remain as credits on the subject site that can be attributed to businesses occupying the subject site. ANALYSIS: The applicant, Pascal Chheng, is requesting approval of a restaurant use and a Type 41 ABC license (on-sale beer and wine) at 302 Main Street within the Main Street Specific Plan area. The subject site consists of a 1,820 sq. ft. tenant space within a one-story, four- unit commercial building located on the east side of Main Street, north of Electric Avenue. The commercial building is surrounded by commercial uses to the north and west, commercial uses to the west across Main Street and commercial uses to the south across a parking lot and Electric Avenue. The Main Street Specific Plan recognizes an important element of the Main Street area is the mix of uses in close proximity to one another. The land use segment of the Specific Plan permits restaurant uses and on-site alcohol service subject to the approval of a Conditional Use Permit. The applicant is proposing to operate a French bistro, named Bistro St. Germain, as an addition to the mix of commercial uses in the Main Street Specific Plan area. The Main Street Specific Plan requires restaurants to close at 10:00 P.M. on Sunday through Thursday and 11:00 P.M. on Friday and Saturday. The proposed restaurant will operate from 7:00 A.M. to 10:00 P.M. Sunday through Thursday and from 7:00 A.M. to 11:00 P.M. on Friday and Saturday, in compliance with the operating hours permitted by the Specific Plan. The applicant has proposed a full menu offering breakfast, lunch and dinner. The Seal Beach Municipal Code requires restaurants to provide one parking space for every 100 sq. ft. of the gross restaurant area. The applicant proposes to occupy a tenant space that is 1,820 sq. ft., which requires a total of 18 parking spaces for the new restaurant use. The Main Street Specific Plan and the Seal Beach Municipal Code recognize that the close proximity of uses within the Main Street area can lead to parking constraints in the area. In the event parking cannot be provided, a business is required to participate in the Main Street In-Lieu Parking Program to meet all or part of the required parking for the business use. The In-Lieu Parking Fee is $3,500 per deficient parking space. The subject site does not have any physical parking spaces so the applicant must meet all of the required parking by participation in the In-Lieu Parking Program. Due to the previous business' participation in the program, the new restaurant is credited with two spaces that have already been paid for by the previous business. The total In -Lieu Parking Planning Commission Staff Report Conditional Use Permit 13 -4 302 Main Street November 6, 2013 Fee for 16 parking spaces will be $56,000, to be paid over a five year period. The payment schedule has been included as a Condition of Approval in the attached Resolution. The Main Street Specific Plan noted that "overconcentration" existed in the downtown area at the time of the Specific Plan's adoption. At the present date, ABC recognizes that an overconcentration continues to exist within the census tract that encompasses the Main Street Specific Plan area. However, the subject site has an existing Type 42 (beer and wine — bar or tavern) ABC License that was issued to the previous business, The Main Street Wine Cellar. An alcohol license exists at the subject so approval of this Conditional Use Permit will not cause further overconcentration in the Main Street Specific Plan area. The California Department of Alcoholic Beverage Control (ABC) has confirmed receipt of an application for a Type 41 (beer and wine — eating establishment) License from the applicant. The ABC representative noted that they do not have objections or concerns regarding the application at the subject site. CONCLUSION: After conducting the public hearing and receiving public testimony, staff recommends that the Planning Commission adopt the attached Resolution No. 13 -16 approving CUP 13 -4 to permit a restaurant use and a Type 41 (on -sale beer and wine) ABC License at 302 Main Street. Proposed Menu 0 .4 =IQ all I 1*] 0 0 0 1* A • A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT 13-4 TO PERMIT A RESTAURANT USE AND A TYPE 41 (ON-SALE BEER AND WINE) ALCOHOLIC BEVERAGE CONTROL LICENSE AT 302 MAIN STREET IN THE MAIN STREET SPECIFIC PLAN AREA THE PLANNING COMMISSION OF THE CITY • SEAL BEACH DOES HEREBY FIND AND RESOLVE AS FOLLOWS: Section 1. On September 10, 2013, Pascal Chheng ("the applicant") submitted an application to the City of Seal Beach Department of Community Development for Conditional Use Permit (CUP) 13-4 to permit a restaurant and a Type 41 (on-sale beer and wine) ABC License at 302 Main Street (the "subject property"), which is located in the MSSP (Main Street Specific Plan) Zone. Approval of this Resolution will rescind all previous Conditional Use Permits approved for separate uses on the subject site. Section 2. Staff has determined CUP 13-4 to be a Class 1 (Existing Facilities) Categorical Exemption pursuant to Section 15301 of the Guidelines for the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) for the permitting of a restaurant use within an existing single story commercial building, involving negligible or no expansion beyond the existing use. Section 3. A duly noticed public hearing was held before the Planning Commission on November 6, 2013 to consider the application for CUP 13-4. At the public hearing, the Planning Commission received and considered all evidence presented, both written and oral, regarding the subject application. The record of the public hearing indicates the following: A. The subject site consists of a 1,820 sq. ft. tenant space within a one-story, four-unit commercial building located on the east side of Main Street, north of Electric Avenue. The commercial building is surrounded by commercial uses to the north and west, commercial uses to the west across Main Street and commercial uses to the south across Electric Avenue. The subject property is located in the MSSP (Main Street Specific Plan) zone, which permits a restaurant use and on-site alcohol sales subject to approval of a Conditional Use Permit. B. The applicant will complete interior tenant improvements to add a full service kitchen and convert the tenant space into a restaurant use. The business will operate from 7:00 A.M. to 10:00 P.M., Sunday through Thursday, and 7:00 A.M. to 11:00 P.M. Friday and Saturday as regulated by the Main Street Specific Plan. Section 4. Based upon the facts contained in the record, including those stated in the preceding Section of this resolution and pursuant to Chapter 11.5.20 of the Code of the City of Seal Beach, the Planning Commission makes the following findings: -1- A. The General Plan Land Use Map designates the subject property as a Commercial — Service land use area. The proposed use, as conditioned below, is consistent with the General Plan, The General Plan specifies that the Commercial — Service land use category consists of commercial establishments selling a broad range of convenience and consumer goods or providing a variety of personal services. The General Plan describes the Main Street Specific Plan area as an area that experiences heavy vehicle and pedestrian influx while also serving as the major commercial service area for the surrounding residential areas. The proposed restaurant use will add to the range of service retail and restaurant uses in the Main Street Specific Plan area. B. The proposed restaurant use and Type 41 ABC License for the on- site sale of beer and wine is permitted in the MSSP (Main Street Specific Plan) zone with approval of a Conditional Use Permit. The Main Street Specific Plan identifies the areas mix of uses in close proximity to one another as an important element in the small town village charm. The subject site storefront opens directly onto Main Street and will add to the mix of service-commercial uses. C. The proposed use, as conditioned below, will be located on a site that is physically adequate for the type, density, and intensity of use being proposed, including provision of services, and the absence of physical constraints. The Seal Beach Municipal Code requires 18 parking spaces to meet the need of the proposed restaurant. The Seal Beach Municipal Code recognizes that the parking is constrained in the Main Street Specific Plan area and requires participation in the Main Street Specific Plan District In-Lieu parking Program. The program permits all or part of the parking space requirements to be satisfied by compliance with this program. The subject site does not have any physical parking spaces to serve the proposed restaurant so the applicant will participate in the program to satisfy all of the required parking spaces required for the restaurant use. The business which previously operated in the subject site participated in the In-Lieu Parking Program by paying for two parking spaces. The In-Lieu Parking Fee is $3,500 per deficient parking space. The two spaces, paid in full by the previous business, are credited to the subject site so the new restaurant use is determined to have a deficiency of 16 parking spaces. The applicant will pay a total In-Lieu Parking Fee of $56,000.00 to be paid over a period of five years, in monthly installments of $933.00, with an initial payment of $953.00, D. The location, size, design, and operating characteristics of the proposed use, as conditioned below, will be compatible with and will not adversely affect uses and properties in the surrounding neighborhood. The proposed restaurant use is compatible with the commercial area in which it is located. The subject property consists of a, 1,820 sq. ft. tenant space within a one-story, four-unit, commercial building in the Main Street Specific Plan area. The proposed restaurant will not result in additional square footage to the building and will not disrupt the existing character of the Main Street Specific Plan area. The proposed operating hours for the restaurant of 7:00 AM to 10:00 PM, Sunday through Thursday and 7:00 AM -11:00 PM on Friday and Saturday is consistent with the hours set for new restaurant uses in the Main Street Specific Plan. IRE E. The establishment, maintenance, and operation of the proposed restaurant at the location proposed, as conditioned below, will not be detrimental to the health, safety, or welfare of persons residing or working in the vicinity. The proposed restaurant is located in a four-unit commercial building occupied by retail and restaurant uses. The proposed restaurant use is consistent with the existing uses throughout the Main Street Specific Plan area. The Conditions placed on the restaurant will ensure the restaurant does not become detrimental to persons residing or working in the vicinity. F. The proposed use is consistent with the intent and purpose and Vision established for the Main Street Specific Plan. The Main Street Specific Plan identifies the vision for Main Street as "small town America" with friendly people in a pedestrian oriented area where people walk and feel safe on the street at night. The proposed restaurant use is consistent with the goals to preserve and enhance the Main Street Specific Plan area because it adds to the mix of service commercial uses offered to residents and visitors. G. The proposed use does not conflict with the Specific Plan's goal to establish and maintain a balanced mix of uses that serve the needs of both local and non-local populations. The proposed restaurant will add to the mix of uses in the Specific Plan area and maintain the balance of service commercial uses. The proposed restaurant's hours of operation are in compliance with the hours regulated by the Main Street Specific Plan in order to maintain consistency with similar uses in the area. H. The use will contribute to the unique character of Main Street and the qualities that provide the Main Street a sense of identity. The small town village charm of Seal Beach's Main Street area comes from a variety factors such as an eclectic mix of architecture, constrained area, relation to the ocean and the mix of uses in close proximity to one another. The proposed restaurant will add to this eclectic mix of uses and enhance the variety of items offered in the Main Street Specific Plan area, 1. The proposed use complies with all applicable City Council policies, such as the policies the Council has adopted concerning alcohol serving uses. The proposed restaurant is proposing to operate with a Type 4.1 (beer and wine) ABC License. Conditions of Approval have been included in this Resolution to ensure compliance with City Council Policy 600-1, approved on February 22, 1993. Section 5. Based upon the foregoing, the Planning Commission hereby approves CUP 13-4 to permit a restaurant and a Type 41 (beer and wine) ABC License on the subject property and rescinds all prior Resolutions and Conditional Use Permits previously approved for separate uses on the subject site, subject to the following conditions: 1. Conditional Use Permit 13-4 is approved to permit a restaurant with a Type 41 (beer and wine) ABC License at 302 Main Street and is issued to Pascal Chheng for Bistro St. Germain. Z The applicant shall comply with all restrictions placed upon the license by the State of California Department of Alcoholic Beverage Control. In connection with the City consideration of an application, the applicant must demonstrate compliance with all 51 restrictions placed upon the issuance of such license by the Alcoholic Beverage Control Act, Business and Professions Code §2300 to §2600, including but not limited to Rule 61.3(a) and 61.4. 3. The applicant shall furnish the City a copy of his ABC license and a copy of the conditions placed on the license by the Department of Alcoholic Beverage Control. This shall be done as soon as the license is received by the applicant from the State of California Department of Alcoholic Beverage Control. 4. The premises of the restaurant must be in substantial compliance with the project plans submitted with the application and maintained on file with the Community Development Department. 5. The hours of operation shall be 7:00 A.M. to 10:00 P.M. Sunday through Thursday and 7:00 A.M. to 1 11:00P.M. on Friday and Saturday. 6. No video games or similar amusements shall be permitted on the premises. 7. There shall be no exterior advertising of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. 8. The In-Lieu Parking Fee of $56,000.00 must be paid over a period of five years, in monthly installments of $933.00, with an initial payment of $953.00. The initial installment must be paid to the City by November 18, 2013, all remaining payments will be considered due on the 1st of every month 9. In the event staff determines security problems exist on the site, the Conditions of this permit may be amended to require the provisions of additional security measures. 10. Deliveries to the premises are prohibited between 10:00 P.M. and 7:00 A.M. 11. There shall be no dumping of trash outside and/or glass bottles outside the establishment between the hours of 10:00 P.M. and 7:00 A.M. 12. The establishment must comply with Chapter 7.15 "Noise" of the City of Seal Beach Municipal Code. Should complaints be received regarding noise generated by the establishment, the Planning Commission reserves the right to schedule this permit for reconsideration and may require the applicant/business operator to mitigate the noise level to comply with the provisions of Chapter 7.15. 13. This CUP shall not become effective for any purpose unless/until a City "Acceptance of Conditions" form has been signed and notarized by the applicant before being returned to the Planning Department; and until the ten (10) calendar day appeal period has elapsed. 14. A modification of this CUP must be applied for when: a. The establishment proposes to change its type of liquor license. b. The establishment proposes to modify any of its current Conditions of Approval. KIN c. There is a substantial change in the mode or character of operations of the establishment. 15. The Planning Commission reserves the right to revoke or modify this CUP if any violation of the approved conditions occurs, any violation of the Code of the City of Seal Beach occurs. 16. In the event staff determines that security problems exist on the site, the conditions of this permit may be amended, under the procedures of the Seal Beach Municipal Code to require the provision of additional security measures. 17. The Planning Commission reserves the right to revoke or modify this CUP if harm or operational problems such as criminal or anti-social behavior occur. Examples of harmful or operation behaviors include, but not limited to, violence, public drunkenness, vandalism, solicitation and/or litter. 18. The establishment shall have a public telephone listing. 19. It shall be the responsibility of the applicant/licensee to provide all employees that sell or serve alcoholic beverages with the knowledge and skills that will enable them to comply with their responsibilities under State law. 20. Litter and trash receptacles shall be located at convenient locations inside the establishment and operators of such establishments shall remove trash and debris on an appropriate basis so as not to cause a health problem. 21. All alcoholic beverages sold in conjunction with the on-premises licensed establishment must be consumed entirely on the premises prior to closing time, and none shall be sold as take-out. 22. The restaurant must be maintained as a "bona fide public eating place" as defined by the California Department of Alcoholic Beverage Control. 23. The establishment must serve a complete menu of food until thirty minutes prior to closing time. 24. There shall be no live entertainment, amplified music, or dancing permitted on the premises at any time, unless specifically authorized by a Conditional Use Permit issued by the City and unless such uses are consistent with the license conditions imposed by the State of California Alcoholic Beverage Control. 25. The sale of alcoholic beverages for off the premises consumption shall be prohibited. Consumption of alcoholic beverages shall be prohibited in the establishment's parking area. There shall be appropriate posting of signs both inside and outside the licensed premises indicating that drinking outside the licensed premises is prohibited by law. 26. This CUP shall become null and void unless exercised within one year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to written request for extension submitted to the Community Development Department a minimum of ninety days prior to such expiration date. N 27. The applicant will prominently display these Conditions of Approval in a location within the businesses' customer area that is acceptable to the Community Development Director, 28.The applicant shall indemnify, defend and hold harmless City, its officers, agents and employees (collectively "the City" hereinafter) from any and all claims and losses whatsoever occurring or resulting to any and all persons, firms, or corporations furnishing or supplying work, services, materials, or supplies in connection with the performance of the use permitted hereby or the exercise of the rights granted herein, and any and all claims, lawsuits or actions arising from the granting of or the exercise of the rights permitted by this Conditional Use Permit, and from any and all claims and losses occurring or resulting to any person, firm, corporation or property for damage, injury or death arising out of or connected with the performance of the use permitted hereby. Applicant's obligation to indemnify, defend and hold harmless the City as stated herein shall include, but not be limited to, paying all fees and costs incurred by legal Counsel of the City's choice in representing the City in connection with any such claims, losses, lawsuits or actions, expert witness fees, and any award of damages, judgments, verdicts, court costs or attorneys' fees in any such lawsuit or action. 29. Building permits shall be obtained for all tenant improvements conducted within the building. 30. Failure to comply with any of these conditions or a substantial change in the mode or character of the establishment shall be grounds for revoking or modifying this CUP approval.
