It is requested that the City Council adopt Resolution No. 6420:
Accepting 2013 Annual Concrete Repair Program Project No. ST1205 by
Above All Names Construction Services, Inc. in the amount of
$61,114.75; and
2. Direct the City Clerk to file a "Notice of Completion" with the Orange
County Clerk-Recorder within ten (10) days from the date of acceptance
and to release retention in the amount of $3,055.74 in 35 days; and
3. Amending the contract with Above All Names Construction Services, Inc.
to $61,114.75 and direct the City Manager to execute the contract
amendment.
On May 29, 2013, City Council awarded a contract to Above All Names
Construction Services, Inc, for the 2013 Annual Concrete Repair Program Project
No. ST1205 in the amount of $51,325.
The 2013 Annual Concrete Repair Program Project No. ST1205 includes repairs
identified within the 2012 Update to the Citywide Concrete Inspection Report
(UCCIR).The UCCIR provides an overview of the current sidewalk conditions
citywide. Prioritization was based upon current sidewalk conditions and a
concrete repair program was developed based upon an annual budget of
$50,000 per fiscal year. The 2013 Annual Concrete Repair Program Project No.
ST1205 has completed the first year of twelve year improvements beginning with
the highest severity displacements. In addition, the project consisted of repairing
driveway approaches, curb and gutter.

During construction, additional concrete repair locations were added by the City
or residents participating in the City's 50/50 Sidewalk/Concrete Program. The
50/50 Sidewalk/Concrete Program is a policy addressing the maintenance and
replacement of concrete within the public right of way, using a 50150 cost-sharing
program to split the cost between the City and property owner.
The project is now complete to the satisfaction of the City Engineer. The project
was inspected and it meets all standards and requirements within the project
specifications. It is required to formally accept the project and file a notice of
completion with the Orange County Clerk.
ENVIRONMENTAL IMPACT:
This project has complied with the California Environmental Quality Act.
LEGAL ANALYSIS:
The City Attorney has reviewed and approved as to form.
On May 29, 2013, the City Council Budgeted $61,325 for the 2013 Annual
Concrete Repair Program Project No. ST1205. Below is a summary and
breakdown of expenses for the project:

RECOMMENDATION:
It is requested that the City Council adopt Resolution No. 6420:

DOCUMENTS FOR 2013 ANNUAL CONCRETE REPAIR
PROGRAM PROJECT NO-ST12U5
WHEREAS, on May 29.203the City of Seal Beach entered into o contract with
Above All Names Construction Services, |nc.;and
WHEREAS, the Qh/ Engineer has determined that the work has been
substantially completed in accordance with the contract documents.
THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE:
Section 1. That the work required to be performed by Above All Names
Construction Services, Inc. has been completed and accepted.
Section 2. That the bztn| cost of amount to be paid to Above All Names
Construction Services, Inc. io$61.114.75 for the work performed.
Section 3. That the City Council hereby amends the contract with Above All
Names Construction 8emioen. Inc. to $61,114.75 and direct the
City Manager hz execute the contract amendment.
Section 4. That a "Notice of Completion" be filed on behalf of the City in the
Office of the Orange County Recorder within 10 days ofthe date of
this resolution.

THIS AMENDMENT is made as of November 12 2013, by and between the City
of Seal Beach, a California charter city ( "City "), and Above All Names
Construction Services, Inc. a General Contractor ( "Contractor").

RECITALS
A. WHEREAS, the City Council awarded a contract in the amount of
$51,325.00 to Above All Names Construction Services, Inc. for the 2013 Annual
Concrete Repair Program Project, CIP No. ST1205 ("Project");
B. WHEREAS, During construction, additional costs were incurred;
NOW, THEREFORE, in consideration of performance by the parties of the
mutual promises, covenants, and conditions herein contained, the parties hereto
agree as follows:
1. Section 3 Pa mend of the May 29, 2013 Agreement is hereby
amended to increase by $9,789.75, the contract amount to $61,114.75, to read
as follows:
"3. Payment. For performing and completing the Work in accordance
with the Contract Documents, City shall pay Contractor, in full
compensation therefor, the amount of $61,114.75, subject to any additions
and deletions pursuant to the terms of the Contract Documents. Said sum
shall constitute payment in full for all work performed hereunder, including,
without limitation, all labor, materials, equipment, tools and services used
or incorporated in the Work, supervision, administration, overhead,
expenses and any and all other things required, furnished or incurred for
completion of the Work as specified in the Contract Documents. City shall
make payments to Contractor on account of the contract sum at the time,
in the manner, and upon the conditions specified in the Contract
Documents.
2. Except as amended herein, the terms and provisions of the
Agreement shall remain in full force and effect,
3. The City Clerk is hereby directed to attach to the Agreement this
Amendment as Exhibit H thereto.
IN WITNESS WHEREOF, the parties, through their respective authorized
representatives, have executed this Amendment as of the date first written
