SD1201 - NOTICE OF COMPLETION That the City Council adopt Resolution No. 6421: Accepting Marina Drive Storm Drain Project No. SD1201 by Mike Bubalo Construction Inc. in the amount of $1,514,712.32; and 2. Directing the City Clerk to file a "Notice of Completion" with the Orange County Clerk-Recorder within 10 days from the date of acceptance, and to release retention in the amount of $75,735.62 in 35 days. I 11ml k, The 2008 Master Plan of Drainage Update identified high priority locations for storm drain improvements. The Council approved the priority list on November 10, 2008. Due to flooding issues in the area, the highest remaining priority project listed is the Marina Drive Storm Drain Project. The downstream section of this tributary area, the West End Pump Station, was updated in 2008. This current project will continue improvements to cover the "low-lying" areas in and around Electric Avenue and 5th Street. Future upstream work will continue this storm drain protection towards Marina Drive and 5th Street. The Project Area lies within the former Redevelopment Agency (RDA). State redevelopment law, at the time, provided that the RDA could pay for the costs associated with the installation of public improvements within the Project Area, and therefore, staff proceeded with the Project. Upon the dissolution of redevelopment agencies, AB 26 X1 required successor agencies to submit "enforceable obligations" to an oversight board and then to the California Department of Finance. Both the Seal Beach Oversight Board (by Resolution SA12-09) and the California Department of Finance (by letter dated Agenda Item E May 27, 2012) approved the costs associated with the installation of this public improvement as an enforceable obligation of the Successor Agency. On December 10, 2012, the Successor Agency • the Seal Beach Redevelopment Agency awarded a contract to Mike Bubalo Construction Inc. for Marina Drive Storm Drain Project No. SD1201 in the amount of $1,292,953.00. The scope of work for this project consisted of the installation of reinforced concrete pipes and boxes, catch basins with debris filters, manholes and junction structures. This system was built to handle future expansion with newer facilities connecting onto this system in the future. Other utility relocations were necessary due to the size of the storm drain. Change Orders were encountered during construction of this project. They included extensive utility relocations due to unknown subsurface structures and abandoned facilities. In addition, new water lines, irrigation lines and sewer structures were identified as necessary after construction began on this project. One other large change order necessary was the installation of four Kristar catch basin filtration structures as opposed to standard catch basins with inserts. They were identified as necessary by Water Quality Control Regulations for Low Impact Development of facilities and structures after the bid and approval of this project. The project is now complete to the satisfaction of the City Engineer. The project was inspected and it meets all standards and requirements within the project specifications. It is required to formally accept the project and file a notice of completion with the Orange County Clerk-Recorder. ENVIRONMENTAL IMPACT: This project complies with all requirements of the California Environmental Quality Act (CEQA) and is categorically exempt under section 15303. LEGAL ANALYSIS: No legal analysis is required for this item. FINANCIAL IMPACT: The amount of $1,800,000 for this project was approved by the Successor Agency, Oversight Board and Department of Finance for the work described below. It was budgeted within the City of Seal Beach FY 13-14 Budget. A summary of expenses for the project is as follows: Item Amount Design $ 185,000.00 Construction $ 1,285,827.50 Change Orders $ 228,884.82 Construction Support $ 4,000.00 Inspection $ 28,000.00 Total $ 1,731,712.32 During the course of the project, the California Department of Finance rescinded its approval of the project as an enforceable obligation of the RDA. Thus, the City used $963,186.32 in property taxes received from the County as a result of the dissolution of the RDA to complete the project. The Final Cost of the project paid to Mike Bubalo Construction, Inc. for construction/change orders is $1,514,712.32.
