S[)eaIers.' Thome were 22 members of the public (including the owner of the pig) spoke in favor of the resident to be allowed to keep her pig and 2 spoke in opposition. There being no other speakers, Mayor Miller declared oral communications closed. ITEM �" / ORDINANCE NO. 1633 /AMEND MUNICIPAL CODE SECTION 7.05,120 / PROHIBIT KEEPING OF PIGS Mayor Pro Tem Deaton pulled this item to explore alternatives toallow the resident hzkeep her pig and requested that the Municipal Code be amended to allow the resident ho obtain o permit to keep the pig. Oeaton moved, second by Shanks, to waive further reading and adopt Ordinance No 1833 entitled "AN ORDINANCE OF THE COY OF SEAL BEACH AMENDING THE SEAL BEACH MUNICIPAL CODE TO PROHIBIT THE KEEPING OF PIGS OF ANY SIZE, K|ND, OR SE)C. (Section 7.05.120) The Assistant City Attorney stated that the ordinance will be in effect in 30 days (December 12.2O13). NEW BUSINESS ITEM "F" / BUILDING DIVISION FEE STUDY The Director ufCommunity Development introduced Jon Tnaw, Building Officia|, to provide the staff report. Mr. Txom/ gave an overview of the preliminary fee study covering the gne| of the study, the scope of the study, the fee Page-3 City Council 11/12113 determination methodology used, and the preliminary findings. After City Council deliberation it was determined that staff provides recommendations for fee changes and aQandiza for Council consideration. With no objections, Mayor Miller so ordered the report be received and filed. ITEM "G" / ORDINANCE NO. 163412103 SEAL BEACH BUILDING CODE The staff report was given by Jon Tmyw. Building Offiuia|, stating that the nature of the amendments was to put an administrative section at the beginning of the chapter and the ordinance would supersede the current 2010 Building Code section. After City Council discussion Sloan mnved, second by Shanko, to introduce first reading of Ordinance No. 1634 amending the Municipal Code (Title 0 - Chapter 8O) to adopt the 2013 California Building Standards Code and Related Model and Uniform Codes and set the public hearing for the regular City Council meeting on December A,2D13. The City Manager asked the Director of Finance to introduce Dan Di|on.newly hired accountant in the Finance Department. ORAL COMMUNICATIONS There were no speakers at this time. OLD TOWN PARKING STUDY SESSION The Director of Community Development started the study session by stating that the purpose of the study session was to provide an overview from the consultants regarding phase 1 of the parking on N1e|n Street and the 0d Town area. The Director introduced the consultants Laura Stetson from PW|G and Brian Marchetti from KOACorporation. The consultants provided a puwerpoint presentation explaining the focus of the study; summary from the stakeholder interviews (areas ofconsensus and onaon of disagreement — a copy of the full written report is available in the Community Development department); findings from the field observations; and outline the next stops. There were 10 residents that expressed their concerns with parking on Dolphin, 8' * 11 m .13 1h, 14 m . and 15mstreets. Council discussed: Parking aua seasonal issue; enforcement uf residents using 0amoQea for parking their cars; bottersignoQe; looking at the possibility of parking structure (beach |n1 or parking lot next 8z fine station); merchant in-lieu parking; ounuinhanoy throughout 0d Town for residential parking permits; consider limiting residential and guest parking permits to include an inspection of garage usage; incentive to use beach parking lot (change sign to read "public" pa/king not beach parking); consider converting Zoeterha|d area (by day care) into parking; and consider changing the direction of traffic on the one-way streets. The City Manager indicated that staff and the consultants received sufficient information 1n progress tu Phase ||. With no objections Mayor Miller announced that the regular scheduled meeting of November 25, 2013 was hereby cancelled and recessed the study unmoinn to closed session at 6:40 p.m. Page 2 - City Council 11/18/13 CLOSED SESSION The City Attorney announced that the City Council would meet to discuss the items identified on the closed session agenda: Item "A" — Conference with Legal Counsel — Existing Litigation - GC §54956.9(d)(1) [City of Seal Beach v. Rudy's Diner OCSC Case No. 30- 2013 - 00640596- CU- BC -CJC] and Item "B" — Conference with Real Property Negotiators — GC §54956.8 (property at 900 -A Ocean Avenue — Negotiating Parties for MDK, Fessel International, and Blue Water Seal Beach L.P.) The Council reconvened the open session. The City Attorney announced that the City Council went into closed session to discuss the items identified on the agenda, gave direction to the City Attorney regarding the litigation with Ruby's, and gave direction to its negotiator concerning all three real property negotiations. There was no other reportable action taken. ADJOURNMENT With no objection, the Mayor adjourned at 7:59 p.m., to Monday, December 9, 2013 at 5:00 p.m. to meet in closed session, if deemed necessary.
