Ingram, City Manager FROM: Jim Basham, Director of Community Development SUBJECT: APPLICATION FOR GRANT FUNDS FOR THE CALIFORNIA COASTAL COMMISSION LOCAL COASTAL PROGRAM (LCP) PLANNING GRANT SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6423 authorizing the application for grant funds for the California Coastal Commission LCP Planning Grant. "Il X11NOE W1 WA&*1&7M Governor Brown and the California Legislature approved an augmentation of $1 million to the California Coastal Commission's budget for fiscal year 2013-2014 to support local governments responsible for planning under the California Coastal Act to develop or update Local Coastal Programs (LCP's). The California Coastal Commission was established by voter initiative in 1972 (Proposition 20) and later made permanent by the Legislature through adoption of the California Coastal Act of 1976. Implementation of Coastal Act policies is accomplished primarily through the preparation of local coastal programs (LCP's) that are required to be completed by each of the 15 counties and 61 cities located in whole or in part in the coastal zone. Completed LCP's must be submitted to the Commission for review and approval. Staff has prepared an application in response to the California Coastal Commission LCP Planning Grant Program Announcement because the City of Seal Beach does not have a certified Local Coastal Program. The application requests a grant amount of $150,000 from the California Coastal Commission. If awarded, staff proposes to utilize the grant funds to hire a consultant experienced in preparing Local Coastal Programs. The grant application includes a work program that details a heavy focus on early involvement with Coastal Commission staff and community outreach throughout the development of the Local Coastal Program. Agenda Item— E The attached Resolution provides the California Coastal Commission with confirmation that the City Council is aware of the application and authorizes staff's request of grant funds for the Seal Beach Local Coastal Program. The grant application is included as Attachment B to this staff report. The Resolution authorizes the Director of Community Development of the City of Seal Beach to sign and submit the application on behalf of the City of Seal Beach. In the event that the City is awarded a grant from the California Coastal Commission, the Resolution authorizes the City Manager to sign a contract agreement accepting funding from the California Coastal Commission. The California Coastal Commission standard agreement form is included as Attachment C to this staff report. ENVIRONMENTAL IMPACT: The proposed submittal of the grant application does not constitute a project and therefore is exempt from the State of California Environmental Quality Act (CEQA) Guidelines pursuant to Section 15060. However, if the City is awarded a grant, then the Planning Division would proceed with the preparation of an Initial Study as required by CEQA Section 15063 to determine if the project may have a significant effect on the environment. The proposed submittal of the application will not involve any development or change to the physical environment and therefore, no further review under CEQA is warranted or necessary. GOALS AND OBJECTIVES The Coastal Act of 1976 requires that each local government lying, in whole or in part, within the coastal zone shall prepare a local coastal program for that portion of the coastal zone within its jurisdiction. The City has had two previous attempts at developing a Local Coastal Program (LCP) but, due to various factors, was not able to adopt a certified Local Coastal Program. The City has gone through several structural and staff changes and is now in a position to prioritize the development, adoption and certification of the Seal Beach LCP. Development of the Seal Beach Local Coastal Program is a priority goal for the City Council, staff and residents. The City is anxious to move forward and initiated a Request for Proposals to seek a consultant that could lead the City through the development process early in 2013, The RFP highlighted the importance of community outreach and involvement during the development, certification and adoption of a LCP. The California Coastal Commission LCP Planning Grant can provide the funding necessary to critically analyze and address sea level rise and climate change. If awarded the grant the City will be able to move forward with a consultant and begin work on the Seal Beach Local Coastal Program. The City was awarded a grant by the Southern California Association of Governments (SCAG) in October 2013 to develop and adopt a Climate Action Plan (CAP). The Climate Action Plan is scheduled to commence in the Spring of 2014. If the City is awarded the California Coastal Commission LCP Planning Grant, the City will have an exceptional opportunity to develop both documents concurrently so they are cohesive and accurate reflections of existing conditions with realistic and effective implementation programs. The goal of this proposal is to develop the Seal Beach Local Coastal Program in accordance with the goals of the California Coastal Commission (CCC). The City has developed a work plan that will initiate early coordination with the CCC to ensure the development of the LCP will be consistent with the Coastal Act goals. The Seal Beach Local Coastal Program will serve as the primary document regulating development and setting policies for protection of the existing environment within the Coastal Zone. The LCP will consist of a Land Use Plan (LUP) and a Coastal Implementation Plan (CIP). b. PROJECT DETAILS The City of Seal Beach is prepared to initiate the project in April 2014 by contracting an experienced consultant to assist the City in completing a document that can be accepted and adopted by both the City of Seal Beach and the California Coastal Commission (CCC). The City's emphasis during this process will be to initiate early contact and maintain communication with the Coastal Commission throughout development of the Local Coastal Program. The City will prepare to meet with the CCC within two weeks of the project commencement to ensure the project's scope meets the intent of the California Coastal Act by properly addressing enhancement of coastal habitats and providing public access. Communication will be maintained with the CCC throughout the development of the Seal Beach Local Coastal Program 3 |S�a| Beach Lnca| Coastal Program � to ensure every program and draft bwithin the scope discussed and agreed upon with the California Coastal Commission. Community outreach will be another early and consistent component throughout the preparation of the Seal Beach Local Coastal Program. The community will be involved at the onset of the development process through @ series of workshops and meetings. The City will hold a rninirnunn of three public workshops with the general public, two public workshops with the Ad-Hoc Citizen Advisory Committee, two study sessions with the Planning Commission, two study sessions with the City Council and create avvebs|teto provide continuous updates onthe progress of the Local Coastal Program. Stakeholder interviews may also be included as a component of the community outreach program to facilitate participation from various community groups. The meetings, workshops and study sessions will be dispersed throughout different phases of the project development to`ensunuthe community and CCC are aware of the progress and vested |n all programs and policies. The project will focus G large amount of time and resources into the assessment of climate change vulnerability inthe Coastal Zone. |twill be important to identify potential exposure and sensitive areas that can be significantly affected by climate change impacts. The concurrent development of the CAP will provide useful data regarding existing conditions, future projections and trends that can be Used to identify high impact areas which may require specific programs or preservation policies. The City of Seal Beach is committed to the development and adoption of certified Local Coastal Program. The proposed work plan identifies a 12 month period, reflective of the City's anticipation to begin and quickly move forward with developing the Seal Beach Local Coastal Program. However, staff is aware that the public hearing process and community outreach process may extend the overall project tirne|ine.7heCityispreparedtodedicmtethenenessary time required to CoD1p|e{a this process and is committed to extending the project timeline as necessary to ensure the Seal Reach UCP is completed and certified by the California Coastal Conmmm|ss|on, 1, PUBLIC 0EN NVF|CANCE The City has a prime opportunity to develop a Local Coastal prmerarn in conjunction with a Climate Action Plan. The Climate Action Plan will provide significant data that can be used to determine the vulnerability nf areas within the Coastal Zone. The Seal Beach Local Coastal Program will be developed concurrently with the planned Climate Action Plan ([AP). The CAP will assess existing conditions throughout the City and develop potential mitigation measures and policies. The City fully intends to utilize this information to analyze the effects of climate change and identify vulnerabilities that must be addressed in the Coastal Zone. The City will work closely with the consultant to confirm the potential risk of sea-level rise is thoroughly evaluated and programs are developed to preserve existing resources. The early analysis and implementation of programs addressing sea-level rise and other potential climate Change impacts can make a significant positive impact on the preservation of resources. City staff will work closely with the consultant, the connnlunhx and the California Coastal Commission,to develop implementation activities that will ensure assets within coastal zone 4 |Sea| Beach Local Coastal Program � � will beprotected and preserved for use by the regional and local community. The Local Coastal Program will be developed in conformance with all goals and policies set by the California Comstal,Act of l976. The development and adoption ofacertified LOoA Coastal Program will ensure programs addressing shoreline public access, habitat protection, and |andfOnm alteration are fully recognized and incorporated into the City's permitting procedures. The Local Coastal Program will include a Coastal Implementation Plan that can serve to streamline the permitting process in the coastal zone while ensuring sensitive resources and public access are preserved. Ill. RELATIVE NEED FOQLCP The California Coastal Act nf1S75 defines a Local Coastal Program as ah3Cal government's land use plans, zoning ordinances, zoning district maps, and within sensitive coastal resources areas, other implementing actions, which, when taken together, meet the requirements o[ and implement the provisions and policies nt the California Coastal CVrnrnisS|on at the local level. Chapter 6iArticle 1 of the Coastal Act requires that each local government lying, in whole or in part, within the coastal zone shall prepare a local coastal program for that portion of the coastal zone within its jurisdiction. The City pf Seal Beach does not have a certified Local Coastal Program (LCP). Most of the fifteen counties and sixty-one cities located within the coastal cone have adopted, certified and updated an hCP for their communities. If awarded the grant, the City will utilize the funding to contract an experienced consultant tOassist in the development ofa Land Use Plan and Coastal |rnp|8nnen&atiVn Plan. Development of the Local Coastal Program will include an assessment of potential risks that may result from Climate Change. The severe storms and potential sea-level rise that result from the effects Of climate change have the potential to significantly disrupt the natural habitat along the shoreline in the Coastal Zone. The development Ofthe LCP will focus on assessing the risk to vulnerable assets within the Coastal Zone. The Seal Beach Natural Wildlife Refuge and potential effects to the shoreline due to sea-level rise will be areas of particular concern, Development of the Local Coastal Program will include a Coastal Implementation Plan to ensure the goals of the Coastal Commission are maintained through the adoption of programs aimed at preserving existing habitats. The development of a Coastal Implementation Plan will include preparation of a Coastal Development Permit Ordinance to identify the policies and procedures for processing Coastal Development Permits within the City's Coastal Zone. The City of Seal Beach does not currently issue Coastal Development Permits for work within the City's Coastal Zone. The development of an L[P consistency review process will allow the City of Seal Beach to assume the responsibility of issuing Coastal Development Permits for development within the Coastal Zone. The ability to issue permits for minor development within the Coastal Zone will significantly improve permit streamlining for residents and local businesses in the community. The implementation of an LCP review process will ensure that all development permitted within the Coastal Zone is consistent with the goals and programs approved by the Coastal Commission. The Coastal Commission staff will also benefit from the City's ability t0 assume responsibility of issuing 51 Seal Beach Local Coastal Program Coastal Development Permits because it will reduce the some of the workload for coastal Commission staff. iii. ADDRESSING THE EFFECTS OF CLIMATE CHANGE The Southern California Association of Governments (SCAG) awarded a grant to the City of Seal Beach in October 2013 for the development of a Climate Action Plan /[Ap1. This process will develop a baseline inventory of the City's greenhouse gas emissions, assess potential impacts to the City and recommend programs to mitigate these |nlp8o±s. The project is scheduled to begin in Spring 2014, which corresponds with the planned start date of the Local Coastal Program. The City of Seal Beach b committed 1oaddressing environmental factors that have the potential of negatively affecting the community's residents and visitors. The [|inoatc Action Plan will be one step in that direction. The City is seeking grant funds from the California Coastal Commission L[P Planning grant to assist the City in its commitment to facing these issues head first. The City's proposed work schedule for development of the Local Coastal Program shows a concentrated effort in the analysis of climate change and sea-level rise within the Coastal Zone. The City has a unique opportunity to develop both a Climate Action Plan and a Local Coastal Program concurrently. The City will be able to assess the inter-related nature of climate change and sea-level rise while working with the community to develop practical and affective measures to mitigate these affects. The Climate Action Plan will provide significant amount of data related to climate change and the potential impacts to the City of Seal Beach. The City intends to utilize this information in its analysis nf Climate Change impacts in the Coastal Zone. The Local Coastal Program is expected to provide afocused analysis nfpotential impacts such as sea-level rise, erosion, and severe storms in the Coastal Zone. The Seal Beach bCP will also evaluate potential impacts to people, natural resources, infrastructure and building stock as part ofthe climate change and sea-level rise vulnerability analysis. As part of the City's work plan, the California Coastal Commission and the community at large will be involved throughout the development of the Land Use Plan and the Coastal Implementation Plan, The Community will be informed of potential risks and involved in the development of programs and policies aimed at preserving vital resources in the Coastal Zone. The Coastal Commission will also be involved during the early development stage to ensure the Final Local Coastal Program submitted for CC[approval will be a document approved and accepted by all stakeholders. iv. LIKELIHOOD OF SUCCES8AFFE[TIVENESS The City of Seal Beach initiated preparation of a Local Coastal Program in 2003, and then attempted to complete the project in 2008. The 2008 LCP was prepared in-house 6v City Staff and submitted for CCC review. The document was returned with numerous comments and staff was unable to attain certification of the Local Coastal Program at that time. Resources and staff time were limited uothe City was unable to address all of the concerns raised by the CCCs0the project was not completed. The City has undergone several structural and staff changes since the previous attempt to prepare and adopt a Local Coastal Program. 61Sea| Beach Local Coastal Program � � The City of Seal Beach is now prepared to commence and complete the development and adoption of the Local Coastal Program. The City is fully aware of the time cqOlrnitnnemts required and the need for an experienced consultant to streamline the process. The City will dedicate a minimum of 165 cumulative staff hours for five staff O0cmn6era that will be directly involved in the preparation and adoption of the Local Coastal Program. The City has developed avvork plan that places high importance on community involvement and early consultation with the California Coastal Commission. The City anticipates meeting with the CCC on two separate occasions before submitting the Final LCP for CCC approval and certification. The City will meet with the Coastal Commission within two weeks of the project initiation to ensure the intended scope ofwork |s consistent with the Commission's goals and identify any items the C[Cdes{gnate asa particular concern. ConnH1Unhv involvement will be a part of the project from the beginning. The City's proposed work plan for the Local Coastal Program includes development of m con1n1Unbv outreach program that will include three public workshops, two workshops with the Ad-Hoc Advisory Committee, two study sessions with the Planning Commission and two study sessions with the City Council. The outreach plan may also include stakeholder interviews with various members of the community. A vvebsite will be developed to provide continuous Updates related to the project and highlight important dates or availability of draft documents or goals. The City's proposed work plan identifies key tasks that must be completed as part Vfthe development of the Seal Beach Local Coastal Program. The City is aware of the time commitments and resources required 1V develop and adopt certified Local Coastal Program. The Seal Beach Local Coastal Program is necessary to bring the City into conformance with the Coastal Act of 1976 and will GUovv the City to issue Coastal Development Permits in conformance with the approved LCP, which will reduce review time during the permitting vu WORKLOAD AND PERMIT STREAMLINING The City of Seal Beach does not have a certified Local Coa5tal Program Oranestablished procedure for approval or denial of Coastal Permit. All development proposed within the Coastal Zone is required to obtain s Coastal Development Permit or letter of exemption from the California Coastal [oQM[n|Ssion before local permits can be issued. The permitting process for development within the Coastal Zone can 6o significantly streamlined with the adoption Ofa Coastal Implementation Plan that incorporates a Coastal Development Permit Ordinance. The Coastal Development Permit Ordinance will set parameters and thresholds for projects that can be reviewed by City Staff for nn|mor remodels and additions to structures within the Coastal Zone, The Coastal Implementation Plan and the Coastal Development Permit Ordinance will be part of the early coordination discussions with the Coastal Commission to ensure the goals of the Commission are maintained. The City of Seat Beach is committed to develop and adopt a certified Local Coastal Program that meats the intent ofthe California Coastal Act and streamlines the permitting process within the Coastal Zone. The City's ability to issue Coastal Development Permits will ease the workload of the Coastal Commission staff because they will be relieved of reviewing minor remodels, additions and similar development in the Coastal Zone within the perimeters of Seal Beach. City 7 |Sea| Beach Local Coastal Program _ Staff will expand its standard review of these developments to include compliance with the Local Coastal Program in addition to compliance with the Zoning Code and California Building Codes. The adoption of Coastal Development Permit Ordinance will set review procedures that can be implemented by City Staff. The adoption of this Ordinance will ease the Coastal Commission's workload and set easy to follow parameters for City review of Coastal Development Permit applications. The City's goal is to develop a Local Coastal Program that will streamline the permitting process and significantly improve the efficiency of City Staff review and Coastal Commission Staff review. Through the early participation of the Coastal Commission and various community groups, the adopted Coastal Implementation Plan will be a document that Can be easily understood and implemented. The Seal beach Local Coastal Program will ensure the community is provided with streamlined review for development while preserving existing habitats and maintaining the goals nf the California Coastal Commission, The City of Seal Beach isprepared to move forward with the development of the Local Coastal Program. The City is asking for $150,000 to assist with the cost of an experienced consultant that Can assist in the development of a Local Coastal Program and facilitate continued communication with the Coastal Commission. The City will contribute $GO,0OOto the p 'ect!s total cost of $210\000, The grant funds are requested primarily to cover the cost of an experienced consultant. The City will contribute matching funds to complete a CEQA analysis of the project, enhance the community outreach program and ensure early communication with the Coastal Commission. The City will contribute $13I00of in-kind staff time to oversee the project and ensure all ofthe intended goals are being met throughout the program. The Community Development Director and the PWbUcVV0rks/Engineer|ng Director will be d1n2Ct|y involved in the development and adoption of the Local Coastal Program. RESOLUTION NUMBER A RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE CALIFORNIA COASTAL COMMISSION LCP PLANNING GRANT UNDER THE BUDGET ACT OF 2013 WHEREAS, the Budget Act of 2013 provides an appropriation of $1 million for Coastal Commission grants in FY 13-14 to local governments to support Local Coastal Program (LCP) planning, and WHEREAS, the California Coastal Commission, under the authority of the California Coastal Act, may provide financial assistance to support coastal planning and has approved a competitive grant program to provide such financial assistance for LCP planning; and WHEREAS, the goal of the grant program is to develop new or updated LCPs in conformance with the California Coastal Act and to reflect current circumstances and new scientific information, including new understandings and concern for the effects of climate change, and WHEREAS, grant proposals submitted under this grant program must complete land use plan and/or zoning work to either achieve submittal for certification of a Local Coastal Program (LCP) or an Area of Deferred Certification (ADC) or of an LCP Amendment to significantly update a certified LCP or LCP segments, including with special emphasis on effects of climate change and sea-level rise; WHEREAS, the City of Sea] Beach, does not yet have an effectively certified LCP; and WHEREAS, the City of Seal Beach, desires to pursue a project that would result in the completion and submittal for certification by the California Coastal Commission of an LCP and desires to assume permit issuing authority, WHEREAS, the City of Seal Beach commits to and agrees to fully support a planning effort intended to complete a certified LCP pursuant to the provisions of the California Coastal Act, with full public participation and coordination with the Coastal Commission staff. If funding for any fiscal year is reduced or deleted by the Budget Act for purposes of this program, the State shall have the option to either cancel this Agreement with no liability occurring to the State, or offer an agreement amendment to Contractor to reflect the reduced amount. Payment will be made in accordance with, and within the time specified in, Government Code Chapter 4.5, commencing with Section 927 EXHIBIT C (interagency Agreement) GENERAL TERMS AND CONDITIONS Eel �- I 1. APPROVAL: This Agreement is not valid until signed by both parties and approved by the Department of General Services, if required. 2. AUDIT: The agency performing work under this Agreement agrees that the awarding department, the Department of General Services, the Bureau of State Audits, or their designated representative shall have the right to review and to copy any records and supporting documentation pertaining to the performance of this Agreement if it exceeds $10,000. The agency performing work agrees to maintain such records for possible audit for a minimum of three (3) years after final payment, unless a longer period of record retention is stipulated. 3. PAYMENT: Costs for this Agreement shall be computed in accordance with State Administrative Manual Section 8752 and 8752.1. 4. AMENDMENT: No amendment or variation of the terms of this Agreement shall be valid unless made in writing, signed by the parties, and approved as required. No oral understanding or agreement not incorporated in the Agreement is binding on any of the parties. State Contracting Manual, Section 3.06, 6. ADVANCE PAYMENT: The parties to this interagency agreement may agree to the advancing of funds as provided in Government Code Sections 11257 through 11263. 7. DISPUTES: The agency performing work under this Agreement shall continue with the responsibilities under this Agreement during any dispute. 8. TIMELINESS: Time is of the essence in this Agreement. 9. NON - PAYMENT O1; INVOICES— FUND TRANSACTION REQUEST: In accordance with Government Code Section 11255, the parties agree that when an invoice is not paid by the requested due date to the Contractor (agency providing the service) and the invoice is not disputed by the contracting Department (agency receiving the service), Contractor may send the contracting Department a 30 -day notice that it intends to initiate a transfer of funds through a Transaction Request sent to the State Controller's Office. To facilitate a Transaction Request should one be needed, the contracting Department shall no later than 10 business days following execution of this agreement provide data to the Contractor for the appropriation to be charged including: fund number, organization code, fiscal year, reference, category or program, and, if applicable, element, component, and task. EXHIBIT D (Interagency Agreement) SPECIAL TERMS AND CONDITIONS POTENTIAL SUBCONTRACTORS Nothing contained in this Agreement or otherwise, shall create any contractual relation between the State and any subcontractors, and no subcontract shall relieve the Contractor of his responsibilities and obligations hereunder. The Contractor agrees to be as fully responsible to the State for the acts and omissions of its subcontractors and of persons either directly or indirectly employed by any of them as it is for the acts and omissions of persons directly employed by the Contractor. The Contractor's obligation to pay its subcontractors is an independent obligation from the State's obligation to make payments to the Contractor. As a result, the State shall have no obligation to pay or to enforce the payments of any moneys to any subcontractor. TRAVEL REIMBURSEMENT Travel Reimbursement shall be at the same rates as similarly situated state employees. If any conflicts exist between the Contractor's rates and those applicable to state employees, the state's reimbursement rates shall prevail. Receipts will be required. All travel costs are inclusive within the budgeted amount referenced in this contract. PROPERTYPURCHASED The Contractor agrees to continue using property purchased under this contract for the purposes outlined in this contract or similar activities until it is fully consumed (i.e. is either fully distributed, damaged, worn -out, or becomes obsolete). SETTLEMENT OF DISPUTES In the event of a dispute, the Contractor shall file a "Notice of Dispute" with the California Coastal Commission, Chief Deputy Director within ten (10) calendar days of discovery of the problem. Within ten (10) days, the Chief Deputy Director, or designee, shall meet with the Contractor and Project Manager for purposes of resolving the dispute. The decision of the Chief Deputy Director shall be final. TERMINATION During the term of this Agreement, either party may terminate this Agreement at will by providing thirty (30) days written notice to the other party. In the event of a termination, the Contractor shall take all reasonable measures to prevent further costs attributable to the Commission. The Commission shall then be responsible for any reasonable and non-terminable obligations incurred by the Contractor in the performance of this Agreement up to the date of termination, but not to exceed the balance of the total funds which remains unencumbered under this Agreement at the time of termination.
