HomeMy WebLinkAboutPC Res 13-17 - 2014-01-15 RESOLUTION NO. 13-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR USE PERMIT 13- 12, TO PERMIT A HOME OCCUPATION FOR A HOME BAKERY BUSINESS LOCATED IN THE RESIDENTIAL LOW DENSITY — 9 (RLD-9) ZONE AT 4200 BANYAN AVENUE. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. On November 27, 2013, Kim and Alan Otani, filed an application with the Community Development Department for Minor Use Permit 13-12, to permit a Home Occupation for a home bakery business at 4200 Banyan Avenue, located in Residential Low Density— 9 (RLD-9) zone. Section 2. Pursuant to Title 14 Calif. Code of Regs. § 15025(a) and § II.A of the City's Local CEQA Guidelines, this project is determined to be a Class 1 (Existing Facilities) Categorical Exemption pursuant to Section 15301 of the Guidelines for the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) for operation or permitting involving negligible or no expansion of use beyond the existing use. Section 3. A duly noticed Planning Commission meeting was held on January 15, 2014 to consider Minor Use Permit 13-12. At the meeting, the Planning Commission received into the record all evidence and testimony provided on this matter. Section 4. Based on the record of that meeting, the Planning Commission hereby finds the following fact to be true: (a) On November 27, 2013, the applicant submitted an application to the Community Development Department for Minor Use Permit 13-12. (b) The applicant is requesting to establish a Home Occupation for a home bakery business at 4200 Banyan Avenue in the Residential Low Density— 9 (RLD — 9) zone. (c) The subject parcel is rectangular in shape with a lot area of approximately 5,151 square-feet (.12 ac.). (d) The residence on the subject site is approximately 2,542 sq. ft. in size. (e) The surrounding land uses and zoning are as follows: NORTH: Residential properties in the RLD - 9 (Residential Low Density— 9) zone. The character of the single family residence will remain and will not result in adverse effects to properties in the surrounding neighborhood. (e) The establishment, maintenance, or operation of the home bakery business at the subject site will not be detrimental to the health, safety, or welfare of persons residing or working in the vicinity of the home bakery business. The proposed home bakery business will operate as an accessory use within the existing kitchen of the residence. The subject site will continue to serve as the primary residence for the applicants and will not be altered as part of the home bakery business. The business operations will not generate additional traffic to the subject site. The home bakery business will consist of preparing baked goods in a residential kitchen. All customer orders will be delivered by the applicant in a personal vehicle. The establishment, maintenance and operation of a home bakery business will not change the use of the single family residence and will not be detrimental to the health, safety, or welfare or persons within the vicinity. Section 6. Based on the foregoing, the Planning Commission hereby approves Minor Use Permit 13-12, subject to the following conditions: 1. Minor Use Permit 13-12 is approved for the operation of a Home Occupation for a home bakery business. 2. The subject site must be the applicants' main residence and the business must be clearly incidental and secondary to the use of the property for residential purposes. 3. Storage is prohibited out-of-doors, within a carport, or within an accessory structure. 4. Any required garage parking area must not be converted into a work area or storage area for the home occupation. 5. The exterior appearance of the single family residence must not be altered. Exterior indication of the home occupation activity from adjoining public rights-of-way or from surrounding properties is prohibited. 6. The home occupation must not display window or advertising sign(s), merchandise, products, or stock in trade, or other identification of the home occupation on the premises. 7. Mechanical or electrical equipment, other than that which is compatible with domestic residential use, is prohibited. 8. Articles offered for sale must be limited to those produced on the premises. 9. Only one personal vehicle may be kept on the premises in connection with the home occupation. Applicant's obligation to indemnify, defend and hold harmless the City as stated herein shall include, but not be limited to, paying all fees and costs incurred by legal counsel of the City's choice in representing the City in connection with any such claims, losses, lawsuits or actions, expert witness fees, and any award of damages, judgments, verdicts, court costs or attorneys' fees in any such lawsuit or action.
