SUBJECT: 2013 ENVIRONMENTAL CLEANUP PROGRAM
PROJECT NO. SD1402
SUMMARY OF REQUEST:
That the City Council adopt Resolution No. 6437:
1. Authorizing the City Manager to execute a purchase order to
United Storm Water, Inc. in the amount of $51,000 for the
2013 Environmental Cleanup Program Project No. SD1402;
and
2. Approving Budget Amendment No. BA14-08-01 approving
$13,000 in additional funds for the required local grant match
using Storm Drain Assign Fund Balance.
BACKGROUND AND ANALYSIS:
The Orange County Transportation Authority's (OCTA) Environmental Cleanup
Program was approved under Orange County Measure M2 to help protect
Orange County beaches and waterways.
The Environmental Cleanup Program ECP Tier 1 (Grant) provides grant funds to
local agencies used to improve overall water quality in Orange County from
transportation-generated pollution. Projects eligible for the Grant include
equipment purchases and upgrades to existing catch basins and related best
management practices such as screens, filters, inserts and other street-scale low
flow diversion projects.
On June 10, 2013, the City Council approved a resolution authorizing a Grant
application, which included a commitment of $13,000 in matching funds if the
application were approved.
On September 16, 2013, OCTA sent a letter stating the City was successful in
securing grants funds for$38,000.
Agenda Item G
The 2013 Environmental Cleanup Program Project No. SD1402 consists of
installing 54 filter inserts (DrainPacs) and 13 automatic retractable screens at
various citywide catch basin locations. These locations have been identified as
being potential contributors of litter, debris, and other pollutants which could enter
into the City's storm drain system and drain to the ocean. Installing the
DrainPacs and the automatic retractable screens capture and treat urban runoff
before entering the municipal storm drain system.
The Grant allows local agencies to supplement the County of Orange's Vendor
Master Agreements, inclusive and competitive pricing for equipment and
installation. The vendors that were selected through the County's request
include Bio Clean Environmental Services, Inc., and United Storm Water, Inc.
Pursuant to Section 3.20.025.D of the Municipal Code, purchases made in
cooperation with another government entity, such as -the County, for the purpose
of obtaining a lower price upon the same terms, conditions and specifications are
exempt from bidding requirements. The City may therefore select either Bio
Clean Environmental Services or United Storm Water without requiring further
bidding.
Staff recommends selecting United Storm Water, Inc. because of its competitive
pricing, extensive experience and serving the City for over five years installing
the City's existing DrainPacs.
United Storm Water, Inc. will be required to provide insurance and the proper
contractor license to perform the work.
ENVIRONMENTAL IMPACT:
This project complies with all requirements of the California Environmental
Quality Act (CEQA) and is categorically exempt under section 15301 because it
entails only the minor alteration of existing facilities.
LEGAL ANALYSIS:
The City Attorney has reviewed the proposed resolution and it as to form.
FINANCIAL IMPACT:
The Grant requires a matching contribution from the local agency. A breakdown
of the financing for the project is as follows:

Budget Amendment No. BA14-08-01 in the amount of $13,000 is recommended
to provide the matching contribution required by the grant.
RECOMMENDATION:
That the City Council adopt Resolution No. 6437:
1. Authorizing the City Manager to execute a purchase order to
United Storm Water, Inc. in the amount of $51,000 for the
2013 Environmental Cleanup Program Project No. SD11402;
and
2. Approving Budget Amendment No. BA14-08-01 approving
$13,000 in additional funds for the required local grant match

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
AUTHORIZING A PURCHASE ORDER AND BUDGET
AMENDMENT IN THE AMOUNT OF $13,000 FOR THE 2013
ENVIRONMENTAL CLEANUP PROGRAM PROJECT NO.

WHEREAS, the City of Seal Beach was successful in securing grant funds of
$38,000 from the Environmental Cleanup Program, Tier 1 (Grant); and
WHEREAS, the City of Seal Beach is proposing the 2013 Environmental
Cleanup Program Project No. SD1402; and
WHEREAS, the Grant allows local agencies to supplement the County of
Orange's Vendor Master Agreements, inclusive and competitive pricing for
equipment and installation., and United Storm Waters, Inc. was among the
vendors selected through the County's request; and
WHEREAS, purchases made in cooperation with another government entity for
the purpose of obtaining a lower price upon the same terms, conditions and
specifications are exempt from bidding requirements; and
WHEREAS, staff recommends selecting United Storm Water, Inc. due to its
competitive pricing, extensive experience and serving the City for over five years.
NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY
RESOLVE:
SECTION 1. The Council hereby authorizes the City Manager to execute the
purchase order to United Storm Water, Inc. in the amount of $51,000 for the
2013 Environmental Cleanup Program Project No. SD1402.
SECTION 2. The Council hereby approves Budget Amendment No. BA14-08-01
in the amount of $13,000 in additional funds for the required local grant match
using Storm Drain Assign Fund Balance.
