ORAL COMMUNICATIONS: Anyone wishing to address the Recreation & Parks Commission, only on items not on tonight's agenda, may do so during this time period. No action can be taken by the Recreation & Parks Commission on these communications on this date, unless agendized. CONSENT CALENDAR: Consent Calendar items are considered routine items that normally do not require separate consideration. The Recreation & Parks Commission may make one motion for approval of all the items listed on the Consent Calendar. SCHEDULED MATTERS: These items are considered by the Recreation & Parks Commission separately and require separate motions. These transactions are considered administrative and public testimony is not heard. STAFF CONCERNS: Updates and reports from the Assistant to the City Manager (Community Services Department) are presented for information to the Recreation & Parks Commission and the public. COMMISSION CONCERNS: Items of concern are presented by the Recreation & Parks Commissioners and discussed with staff. AGENDA APPROVAL By Motion of the Recreation & Parks Commission, this is the time to: (a) Notify the public of any changes to the Agenda; (b) Re-arrange the order of the Agenda; and/or (c) Provide an opportunity for any member of the Recreation & Parks Commission, staff, or public to request an item be removed from the Consent Calendar for separate action. IV. Dolphin Market Conditions This is NOT A PERMIT but rather a bench beach encroachment application. The City will review your application and a permit will be issued if all conditions are met and if there is space available. The City will only authorize a maximum of 15 benches on the beach. Beach benches will be acquired through an open lottery system to ensure fair and equitable distribution of bench space to eligible applicants. The lottery will take place every three years on a designated day in January. Seal Beach residents will be given ample time to submit an application prior to the lottery. Applicants must also show proof of residency (water/electric bill, rental agreement, or another form deemed valid by the City). In addition, the applicant will need to sign a legal contract agreement between the City and the applicant which shall pay all permit fees and list the City as additionally insured before a permit is approved. The permit is only valid for three years. Please review the next page and initial each condition. Please initial each section indicating that you have read and understood the Beach Bench Encroachment Application and shall meet the conditions of the permit in its entirety. A serial number will be assigned to the permittee which shall be permanently affixed to the bench and will identify the owner of the bench. All benches on the public beach are for public use and no user will be discriminated against for any reason. Benches shall have signage affixed to the bench identifying the bench for public use. Bench seating area must be permanently affixed to the table. Benches must not be chained, cemented into the ground, affixed to a wall or any other permanent feature on the beach. It is the responsibility of the permittee to maintain the bench and the area immediately surrounding the bench. The City shall have the right to determine the proper care of the bench and area surrounding the bench. Permittee shall be notified by the City if this condition is not met and shall have 2 days to meet this condition. All benches must be a standard size of 6 to 8 feet Applicant must submit a picture of the bench with this application before an agreement can be executed. The City reserves the right to have any bench removed with written notice to the permittee. Reasons for removal of a bench shall include inability of permittee to meet conditions, public safety concerns, and/or any other reasons that violate the policies of the City. If a permittee is not in compliance, the bench will be removed at the sole cost of the permittee. I agree to defend, indemnify and hold harmless the City of Seal Beach and its officers, employees, and agents harmless and free from any liability of any nature, including but not limited to liability for damage or injury to any persons or property costs and attorney's fees arising out of or in connection with the use of City recreational facilities regardless of whether the City was actively or passively negligent, either solely or contributory in connection with such liability. 1, the undersigned, do hereby agree that we will abide by the policies governing the use of this facility and I will be responsible for any damages to the facility or equipment caused by the occupancy to the premises.
