Mayor Miller called the adjourned meeting of the Seal Beach City Council to
order at 5:00 p.m. in the City Hall Conference Room.

There were no members of the public present to address the City Council.
CLOSED SESSION
The City Attorney announced that the City Council would meet to discuss the
items identified on the closed session agenda: Item "A" — Conference with Legal
Counsel — Initiation of Litigation GC §54956.9(d)(2) — 4 cases; and Item "B"
Conference with Real Property Negotiators — GC §54956.8 — Properties: Electric
Avenue Railroad Right-of-Way (General Services Administration - GSA); 16305
Pacific Coast Highway (Murrey Seidner); 900-A Ocean Avenue (1 - Fessel
International and 2 - MDK); and 201 8th Street (1 - Seal Beach Chamber of
Commerce and 2 - Rosie Ritchie).
(The City Attorney reported at the regular meeting that the City Council gave direction to legal
counsel and property negotiators to the items listed on the agenda and no other action was
taken.)

at 6:45 p.m.

project; Mayor Pro Tern Deaton commented on the passing of Mitzi Morton —
Chamber of Commerce Tree Lighting event — Holiday Parade — lights on Main St.
— wished happy holidays; Councilman Levitt expressed seasonal greetings; and
Mayor Miller stated he attended the Joint Forces Training Base promotion
ceremony for Major General Jones and thanked staff for all their help during his
tenure as Mayor.
COUNCIL ITEMS
ITEM "A" / RESOLUTION NO. 6422 / COUNCIL POLICY 100-03 (COUNCIL
RULES OF PROCEDURE) / Section 10.D
The City Attorney reported that during the goal setting session (held on 11/08/13)
the City Council directed staff to amend Council Policy 100-03 to provide a
provision to address emergent issues by individual City Council Members that
would require unexpected staff and city attorney time. The City Manager
explained that the item before the Council is how to handle the issues that are
brought forward that are not part of the Council agreed goals for the year and
would take a considerable amount of staff and city attorney time. The City
Council discussed the issue and agreed to amend the policy to read as follows:
D. Council Member Requests (revised 12/09/13)
1. All Council Member requests for written reports or research shall be
addressed to the City Manager. The City Manager shall inform all Council
Members that a Council Member has made such a request. Any Council
Member may request a copy of any written material provided to the requesting
Council Member.
2. If the City Manager determines that responding to a Council Member's
request for a report or research: (1) is outside the scope of the Councils
previously stated policies, goals, or objectives; and (2) would require more than 4
hours of staff time for a response, the City Manager may place the item on a
future Council Agenda for further direction from the entire Council.
3. Council Members should contact the City Manager as early as possible if
they desire to have any additional written material prior to a City Council meeting.
If a Council Member has questions, needs clarification, or needs additional
material, he or she shall advise the City Manager as early as possible before a
City Council meeting so the staff can meet his or her needs.
4. Council Members may contact the City Attorney at any time and ask
questions and make inquiries. However, individual Council Members may not
direct the City Attorney to perform research or perform legal services without the
City Council, as a body, first providing that direction at a City Council meeting.
Shanks moved, second by Deaton, to adopt Resolution No. 6422 entitled "A
RESOLUTION OF THE SEAL BEACH CITY COUNCIL AMENDING THE
COUNCIL RULES OF PROCEDURE (COUNCIL POLICY 100-03) REGARDING
ALLOCATION OF STAFF RESOURCES TO ADDRESS EMERGENT ISSUES"
and place on the agenda to review in 4 months.

ITEM "K" / SMOKE SHOPS, ELECTRONIC CIGARETTES, AND DRUG
PARAPHERNALIA
The Director of Community Development provided the staff report stating that
staff would like clear Council direction before drafting the ordinance. The City
Council discussed the issues and the consensus that 500 feet PS zoned
property; 16 sq. ft. of display; CUP requirement; prohibit lounges; and apply the
same State Labor Codes for smoking in public places for electronic cigarettes.
With no objections, Mayor Miller called for a recess at 8:31 p.m. and reconvened
the meeting at 8:42 p.m.
The City Attorney clarified the distance between smoke shops would be 500 feet.
Mayor Pro Deaton would like to review the grandfathering of existing businesses.
ITEM "L" / ORDINANCE NO. 1635 / AMEND MUNICIPAL CODE §7.05.120 /
PROHIBITED ANIMALS
The City Attorney stated that the City Council directed staff to provide an
amendment to the Municipal Code that would allow the keeping of pigs with a
Non-domestic Animal Permit. With no objections, it was directed that the City
Attorney review the permits submitted and to work with the City of Long Beach —
Animal Control to draft the conditions in the permit.
Deaton moved, second by Sloan, to introduce first reading of Ordinance No.
1635 entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING
THE SEAL BEACH MUNICIPAL CODE TO ALLOW THE KEEPING OF PIGS
WITH A NON-DOMESTIC ANIMAL PERMIT". The City Attorney read the title of
the ordinance for the record.
AYES: Deaton, Levitt, Miller, Shanks, Sloan

NEW BUSINESS
ITEM "M" / RE-ORGANIZATION OF CITY COUNCIL / SELECTION OF 2014
MAYOR AND MAYOR PRO TEMPORE
The City Attorney conducted the selection of the 2014 Mayor asking for
nominations: Sloan nominated Ellery Deaton and Miller nominated Michael
Levitt. The City Attorney closed nominations and stated that the Council will vote
on the first nomination of Ellery Deaton.
AYES: Deaton, Levitt, Miller, Shanks, Sloan
NOES: None Motion carried
Mayor-elect Deaton conducted the selection of 2014 Mayor Pro Tempore asking
for nominations: Shanks nominated David Sloan, there were no other
nominations.
AYES: Deaton, Levitt, Miller, Shanks, Sloan
NOES: None Motion carried
111 Mayor-elect Deaton summarized Mayor Miller's tenure and presented him with
the traditional gavel plaque. Mayor Miller thanked the City Council for their
support during his tenure. Mayor-elect Deaton introduced her family.
ADJOURNMENT
Mayor Miller stated that the City Council meeting is adjourned in the memory of
Bruce Monroe (District 3) and Mitzi Morton (District 1) long-time advocates and
residents of Seal Beach and in the memory of retired Seal Beach Police Captain
David Gary Maiten.

With no objections, Mayor Miller cancelled the December 23, 2013 City Council
meeting and adjourned the meeting at 9:06 p.m. to Monday, January 13, 2014 at
5:30 p.m. to meet in closed session, if deemed necessary.
