Chair Massa-Lavitt called the regular meeting of the Planning Commission to
order at 7:00 p.m. in the City Council Chambers and Commissioner Sloan led the
Salute to the Flag.
ROLL CALL
Present: Chair Massa-Lavitt;
Commissioners: Campbell, Cummings, Goldberg, Sloan

APPROVAL OF AGENDA
With no objections, Chair Massa-Lavitt so ordered the approval of the agenda as
presented.
ORAL COMMUNICATIONS
Chair Massa-Lavitt opened oral communications. There being no speakers,
Chair Massa-Lavitt declared oral communications closed.
CONSENT CALENDAR
Commissioner Cummings indicated a clerical error in the minutes on page 2
under Director's Report — the word "be" is missing between the words "will" and
"business". Campbell moved, second by Goldberg, to approve the
recommended action(s) on the consent calendar as corrected.
AYES: Campbell, Cummings, Goldberg, Massa-Lavitt, Sloan
NOES: None Motion Carried

PUBLIC HEARINGS
2. Municipal Code Amendment (MCA) 14-1 — Citywide Resolution No. 14-1
Subject. Municipal Code Amendment 14-1 regarding Smoke Shops
Recommendation: That the Planning Commission hold a public hearing regarding
Municipal Code Amendment 14-1 and after considering all
evidence and testimony presented adopt the draft resolution
recommending approval of Municipal Code Amendment 14-1 to
the City Council.

The Director of Community Development provided the staff report indicating the
City Council introduced an ordinance to add Chapter 5.75 to the Municipal Code
requiring a Conditional Use Permit for smoke shops, prohibiting smoking
lounges, and defining smoke shops. Adopting Resolution No. 14-1 would
recommend that the City Council adopt Municipal Code Amendment (MCA) 14-1
that would amend Municipal Code Chapters 11.2.10 (Table 11.2.10.010 adding
"Smoke Shops") and 11.6.05.010 (adding the definitions of "Smoke Shops" and
"Smoke Lounge"). Commission received clarification that the only action
required by the Commission would be with regards to zoning, not the provisions
in Chapter 5.75.
Chair Massa-Lavitt opened the public hearing. There were no speakers. Chair
Massa-Lavitt closed the public hearing.
Goldberg moved, second by Cummings, to adopt Resolution No. 14-1
recommending adoption of MCA 14-1 regarding smoke shops.
AYES: Campbell, Cummings, Goldberg, Massa-Lavitt, Sloan
NOES: None Motion Carried
DIRECTOR'S REPORT
The Director of Community Development pointed out that, at this time, the next
Planning Commission meeting will be March 5, 2014.
COMMISSION CONCERNS
There were no Commission concerns.
ADJOURNMENT
With no objections, Chair Massa-Lavitt adjourned the Planning Commission
meeting at 7:10 p.m.
