BACKGROUND AND ANALYSIS: This section does not apply to this item. ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. LEGAL ANALYSIS: No legal analysis is required for this item. FINANCIAL IMPACT: There is no financial impact. ROLL CALL Present: Mayor Doaton;Council Members: Levitt, Miller, Shanks, Sloan City Staff: Quinn M. Barrow, City Attorney Jill R. Ingram, City Manager Linda Devine,City Clerk ORAL COMMUNICATIONS There were nospeakers. Councilman Miller stated his concerns that closed session items are appearing in the press. CLOSED SESSION The City Attorney announced that the City Council would meet hodiscuss the items identified on the closed session agenda: Item "4^—Conference with Labor NoQotinUors — GC §54057.6 (Police Management Association & Police Officers Association) The City Attorney reported that the City Council gave direction to the labor negotiators and no other reportable action was taken. Director cf Community Development Patrick Gallegos,Administrative Manager Linda Devine, City Clerk APPROVAL OF AGENDA & WAIVER OF FULL READING OF RESOLUTIONS &ORDINANCES The City Manager stated that the resolution was omitted from the staff report for the Successor Agency item 3. (copies were placed on the dais and available ot the city clerk's desk) With no objections, Mayor Deaton so ordered the approval of the agenda as presented. There were no presentations orrecognitions. ORAL COMMUNICATIONS W1ayorDeatun opened oral communications. Speakers: Craig Dur#y, Gorden Grove,was present to encourage the City Council to support the efforts for state legislation regarding distracted drivers and bicycles and pedestrian safety; Patty Campbell, Ironwood /4vanue, reiterated her opinions on amending the Charter to extend the term limits for city council; JeneUe Gudgmn, So. California Edison (SCE),. namindad the public that there will be a planned power outage on March 1 at1O:OOp.m. tnMam w h � at78:O0a.m.for part of the areas in Old Town, Hill, and Leisure World(notices were mailed to all those residents that will be affected and information is posted on the City's website)—the City Council requested that SCE grant permission 10 extend the Edison gardens in College Park West; Andrew K8anning, o representative for the Ancient Order of Hibemiana in America, requested the City Council support the efforts for a united Ireland; Judy Dipiazza. Electric Avenue, expressed her opposition to tram on the City's pier; Brian Kyle, owner of O'Malley's on Main Street, stated his support for the Ancient Order ofHibernimnm in America; Bruce Bennett, 4mStreet, spoke regarding the budget review item and asked for clarification (the Director of Finance responded during the presentation of this item); and Joyce Panqum. 6 th Street, stated her concerns about the speed limit on the bicycle trail — opposed to extending 0enn limits — potential law suits from pavers on Main Sheet—where the City invests the public's money. There being no other speakers, Mayor Deahzn declared oral communications closed. Quinn CITY ATTORNEY REPORT M. Barrow, Esq., City Attorney The City Attorney explained that by state law(Brown Act) the City Council cannot act on requests or questions from the public on issues not onthe agenda. COUNCIL COMMENTS Councilman Miller stated his position on extending term limits for the public since the study session was not televised; and Mayor Ooakmn asked that policy be placed ona future agenda regarding guidelines and procedure cf public requests fora pnoc|amaUon, remo|utiun, recognition, and/or support from the City Council that are outside of the City's issues. PUBLIC HEARING ITEM "E" if ORDINANCE NO. 1638 / MUNICIPAL CODE AMENDMENT 14-1 TITLE 11 —ZONING CODE/SMOKE SHOPS Mayor [}eahzn stated this was the time for consideration of item ^E^ public hearing. The Director of Community Development provided the staff report indicating proposed ordinance would amend the Zoning Ordinance to make it consistent with the recent changes to Title 5 of the Code regarding smoke shops (Ordinance No. 1636). Specifically, the ordinance would amend the table of permitted land uses to specify that smoke shops would be allowed in the Service Commercial (SC) and General Commercial (GC) zones upon approval of o conditional use permit. The ordinance would also insert the same definition of "smoke shop" in the Zoning Code that was recently added to Tide 5. On February 5. 2014, the Planning Commission conducted m public hearing and reviewed the proposed ordinance and adopted the resolution recommending that City Council adopt the ordinance. MeyorOaahon opened the public hearing for public comments. There being no mpmakers, yNoyorUeohzn closed the public hearing. There were no questions or comments from the City Council. AYES: Deahxn, Levitt, Miller, Shanks, Sloan NOES: None Motion carried The City Attorney announced that the second reading and adoption ofOrdinance No. 1038 will beon the consent calendar for the next City Council meeting. ITEM "F" / FATS, OILS, & GREASE PROGRAM UPDATE I ORDINANCE NO. 1639 — AMEND CHAPTER 9.25 / RESOLUTION NO., 6439 — AGREEMENT WITH ENVIRONMENTAL COMPLIANCE INSPECTION SERVICES RESOLUTION NO.6440—CHANGES TO FEE SCHEDULE Mayor Oaotnn stated this was the time for consideration of item ^F" public hearing. The Director of Public Works gave the background for this item and stated that the City Council is asked to take action on the proposed municipal code amendment, approving a service contract, and approve the changes to the fee schedule. Mayor Qea0on opened the public hearing for public comments. There being nospeakers, yNaynrDao8zn closed the public hearing. The City Council received dodhoaUon on the waiver for those businesses that are unable to comply with the negu|a8onn, the fee changes for inapeoUono, and about those businesses that sale their used oil. Levitt moved, second by Shanks, to introduce Ordinance No. 1639 entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING PROVISIONS OF CHAPTER 9.25 OF THE SEAL BEACH MUNICIPAL CODE REGARDING FATS, O|L8, AND GREASE K8ANAGEMENT, NSC}HARGE, AND CONTROL" (FUG regulations regarding grease inb*roeptoro). The City Attorney announced that the second reading and adoption of Ordinance Nn. 1638 will be on the consent calendar for the next City Council memting.; AYES: Deaton. Levitt, Miller, Shanks, Sloan NOES: None Motion carried Sloan movod, second by Deetnn, to adopt Resolution No. 6439 entitled "4 RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING A PROFESSIONAL SERVICES AGREEMENT WITH ENVIRONMENTAL COMPLIANCE INSPECTION SERVICES (EC|S) FOR FATS. OILS & GREASE INSPECTION SERVICES"(in the amount of$16.G30); and AYES: Deatnn. Levitt, Miller, Shanks, Sloan NOES: None Motion carried Sloan moved, second by Shenke, to adopt Resolution No. 6440 anUUad "A RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING NEW AND AMENDED FEES RELATED TO THE CITY'S FATS, O|LS, AND GREASE REGULATIONS AND INSPECTION PROGRAM". NEW BUSINESS ITEM "G"/MID YEAR BUDGET REVIEW /FISCAL YEAR 2013/2014 The Director of Finance provided a presentation that included: review of the ganane| fund; the top 5 sources of revenue; property tax summary; utility unana tax; na|aa box summary; property tax in lieu of vehicle license hams; — yNoyur Page 4-City Council O2/24/ 4 Deaton called for a recess at 8:34 p.m.and reconvened the meeting at 8:45 p.m. — the Director continued the presentation reviewing: transient occupancy tax; business license; general fund expense; budget modifications; non general fund summary; employee pension; and OPE8 (Other Post Employment Benefits). The Director summarized that the City ofSeal Beach is in great shape; fiooa||y sound, financially rasponaib|o, and well-funded naaemos. With no objections, Mayor DnaUonoo ordered the report be received and filed. ITEM "H"I WATER SYSTEM UPDATE The Director of Public Works reported: the City Qatm their water from the underground aquifer (Orange County Water District) from 4 |000| waUm and imported water from the(Municipal Water District of Orange County)State Water Project — Colorado River Aqueduct, and Owens Valley Aqueduct; Statewide drought and the Governor's actions; and reviewed previous City Council actions for water conservation (Ordinance No. 1580). The Director clarified that the Qb/ has not implemented any of the phmoma at this Umo, but have started 0o reduce the watering uf the green areas in the City. With no objections, Mayor Deotonno ordered the report ba received and filed. YNayorDaabon requested that an item be placed on a future agenda regarding city attorney uorv|oeo, to include on analysis of the city attorney services for the Qh/, and if the services should be contracted or be provided in-house. Councilman K4i||ar opposed bringing the oamioaa in-house stating that the contracted services allow a pool of attorneys with expertise in any given area.
