Ingram, City Manager FROM: Jim Basham, Director of Community Development SUBJECT: PUBLIC HEARING TO CONSIDER AMENDMENTS TO THE BUILDING DIVISION FEES CONTAINED IN THE CURRENT CITY FEE SCHEDULE RESOLUTION SUMMARY OF REQUEST: That the City Council hold a public hearing regarding proposed changes to the City Fee Resolution for Building Division fees as recommended in the Building Division Fee Study Report. After considering all information presented during the hearing, adopt Resolution No. 6442. BACKGROUND AND DISCUSSION: At the February 10, 2014 City Council meeting, staff presented the results of the Building Division Fee Study including recommended changes to certain Building Division fees in the current 2013-2014 City Council Fee Schedule Resolution. Based upon the data collected, the City's fees for the Building Division fall within the range of the average of the cities reviewed. However, there are fees in the current schedule that could be reduced and/or replaced or supplemented by flat fee rates for items such as residential solar-tube installations, window retrofits, and water heater replacements. The Report recommended several short and long term changes to the Building Division's Fees in the City's 2013-2014 Fee Schedule. The City Council directed staff to schedule a public hearing to consider public comments concerning amendments to the Fee Schedule in accordance with the Report's recommendations. The Resolution No. xxx to implement the Report's recommendations has been included as an attachment. ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. Agenda Item LEGAL ANALYSIS: The City Attorney has reviewed the ordinance and approved as to form. FINANCIAL IMPACT: If the City Council amends the Fee Schedule in accordance with the Report's recommendation and building activity this year, there could be a reduction in the amount of fees generated for the remainder of this fiscal year. The amount of the reduction is unknown at this time. However, when the Budget is completed for FY 2014-15, the fee changes will be used to calculate the anticipated revenue and the impact of the fee changes will be reflected in the Budget. RECOMMENDATION: That the City Council adopt Resolution No. 6442 approving specific fee changes as deemed appropriate by the City Council. The City of Seal Beach is authorized empowered to impose reasonable fees, nates, and charges for municipal services that do not exceed the City's related costs. Section 2. A Building Division Fee Study Report has been prepared by Traw Aoaooiohem Consulting has determined that certain Building Division feea, ratan, and charges for municipal services can be reduced and modified and still reasonably cover the actual costs to conduct such service without exceeding those costs.
