Mayor Deaton called the adjourned meeting of the Seal Beach City Council to
order at 5:30 p.m. in the City Hall Conference Room.

There were no speakers.
Councilman Miller stated his concerns that closed session items are appearing in
the press.
CLOSED SESSION
The City Attorney announced that the City Council would meet to discuss the
items identified on the closed session agenda: Item "A" — Conference with Labor
Negotiators — GC §54957.6 (Police Management Association & Police Officers
Association)
The City Attorney reported that the City Council gave direction to the labor
negotiators and no other reportable action was taken.
ADJOURNMENT
It was the order of the Mayor, with consent of the Council to adjourn the meeting
at 6:08 p.m.

COUNCIL COMMENTS
Councilman Miller stated his position in support of extending term limits for the
public since the study session was not televised and in particular, his
disagreement with Mayor Deaton that a 40 year old vote should preclude the
residents of Seal Beach from having the opportunity to vote on the issue when
probably 700% of the electorate today did not vote in 1974; and Mayor Deaton
asked that a policy be placed on a future agenda regarding guidelines and
procedure of public requests for a proclamation, resolution, recognition, and/or
support from the City Council that are outside of the City's issues.

consent calendar as presented. The City Attorney read the title of Ordinance No.
1637 (item D) for the record.

PUBLIC HEARING
ITEM "E" / ORDINANCE NO. 1638 / MUNICIPAL CODE AMENDMENT 14-1 /
TITLE 11 —ZONING CODE / SMOKE SHOPS
Mayor Deaton stated this was the time for consideration of item "E" public
hearing. The Director of Community Development provided the staff report
indicating proposed ordinance would amend the Zoning Ordinance to make it
consistent with the recent changes to Title 5 of the Code regarding smoke shops
(Ordinance No. 1636). Specifically, the ordinance would amend the table of
permitted land uses to specify that smoke shops would be allowed in the Service
Commercial (SC) and General Commercial (GC) zones upon approval of a
conditional use permit. The ordinance would also insert the same definition of
"smoke shop" in the Zoning Code that was recently added to Title 5. On
February 5, 2014, the Planning Commission conducted a public hearing and
reviewed the proposed ordinance and adopted the resolution recommending that
City Council adopt the ordinance.

• ITEM "G" / MID YEAR BUDGET REVIEW/ FISCAL YEAR 2013/2014
The Director of Finance provided a presentation that included: review of the
general fund; the top 5 sources of revenue; property tax summary; utility users
. tax; sales tax summary; property tax in lieu of vehicle license fees; — Mayor
Deaton called for a recess at 8:34 p.m. and reconvened the meeting at 8:45 p.m.
— the Director continued the presentation reviewing: transient occupancy tax;
business license; general fund expense; budget modifications; non general fund
summary; employee pension; and OPEB (Other Post Employment Benefits).
The Director summarized that the City of Seal Beach is in great shape; fiscally
sound, financially responsible, and well-funded reserves. With no objections,
Mayor Deaton so ordered the report be received and filed.
ITEM "H" /WATER SYSTEM UPDATE
The Director of Public Works reported: the City gets their water from the
underground aquifer (Orange County Water District) from 4 local wells and
imported water from the (Municipal Water District of Orange County) State Water
Project — Colorado River Aqueduct, and Owens Valley Aqueduct; Statewide
drought and the Governor's actions; and reviewed previous City Council actions
for water conservation (Ordinance No. 1586). The Director clarified that the City
has not implemented any of the phases at this time, but have started to reduce
the watering of the green areas in the City. With no objections, Mayor Deaton so
ordered the report be received and filed.
Mayor Deaton commented that the City Council owe the tax payers to look into
going out for an RFP (Request For Proposal) for city attorney services and
• requested that staff provide an analysis of the city attorney services for the City,
to include if the services should be contracted or be provided in-house.
Councilman Miller opposed bringing the services in-house stating that the
II contracted services allow a pool of attorneys with expertise in any given area.
The City Manager clarified that staff will bring an analysis of city attorney services
to the City Council for discussion.
ADJOURNMENT
• With no objections, Mayor Deaton adjourned the meeting at 9:45 p.m. to
Monday, March 10, 2014 at 5:30 p.m. to meet in closed session, if deemed
necessary.
The City Council met as the Successor Agency.
