Approve the minutes for the adjourned and regular City Council meeting of
March 10, 2014.

Mayor Deaton called the adjourned meeting of the Seal Beach City Council to
order at 5:30 p.m. in the City Hall Conference Room.
ROLL CALL
Present: Mayor Deaton; Council Members: Levitt, Miller, Shanks, Sloan

ORAL COMMUNICATIONS
Mayor Deaton opened oral communications. The representatives from MDK and
Off the Hook, the two proposed applicants for the pier restaurant,were present to
make final comments regarding their proposals. There were no other speakers,
Mayor Deaton closed oral communication. The City Council went into closed
session at 5:45 p.m.
CLOSED SESSION
The City Attorney announced that the City Council would meet to discuss the
items identified on the closed session agenda: Item "A" — GC §54956.8
Conference with Real Property negotiators: 900-A Ocean Avenue — pier
restaurant — MDK and Off the Hook; item "B" — GC §54956.8 Conference with
Real Property negotiators: 3101 North Gate Road — Clean Energy; item "C" —
GC §54956.8 Conference with Real Property negotiators: 4161 Ironwood
Avenue — ; item "D" — GC §54957.6 Conference with Labor negotiators: Mid-
Management (unrepresented); and item "E" — GC §54957 Public Employee
Performance Evaluation—City Manager.
The City Attorney reported that the City Council gave directions regarding the
items on the agenda and no other reportable action was taken.
ADJOURNMENT
It was the order of the Mayor, with consent of the Council to adjourn the meeting
at 7:00 p.m.

The City Manager indicated that there was a revision ho consent item ''E. exhibit
A to the agreement with Clear Channel added 4 more bus shelters to the list
making the total of 26 shelters. Levitt moved, second by Shanks to approve the
agenda aacorrected.

ORAL COMMUNICATIONS
Mayor Daa0unopened oral communications. Speakers: Elizabeth Kona, Run
Seal Beach, reminded everyone that the Run is Saturday,April 5'h and there is a
limited number for the children's 1K Run and inquired about the status of the
exercise stations on the green belt; and David Powell, St. Andrews Drive, stated
his opposition to allowing private benches on the beach. There being no other
speakers, Mayor Dea0on declared oral communications closed.

COUNCIL COMMENTS
Councilman Miller discussed the request to have an analysis of the legal services
for the City stating that an in-depth staff report was done in 2005 comparing
having the legal services by contract verses in-house attorney and felt it is not
cost effective to have staff do this analysis-if there is a need for an analysis that
staff should compare coastal cities and that this should be discussed during the
budget process. There was no consensus to have an analysis done. Mayor
Dee1un stated that she does not believe that the Council in doing its due
diligence and not taking care of its fiduciary responsibility to the taxpayers unless
the Council periodically reviews the attorney semicomYeoo.

PUBLIC HEARING
ITEM"F"/RESOLUTION NO.6442/BUILDING DIVISION FEE REVISIONS
Mayor Deah)n stated this was the time for consideration of item ^F^ public
hearing. Jon Traw, Building Dffioia|, provided a brief presentation to the change
in building fees: Goal — evaluate the Building Division fees; Purpose to offset
cost ofservices; Five recommendations are to reduce the permit issuance fee,
naduoa general plan update fee, revise construction waste recycling scope (no
fen |ase than 1.000 sq. ft.), valuation table updates, and flat fee items (water
heater replacement, retrofit windows, and solar tuba type installations). The
changes in the fees will be coot neutral, Mayor Daaton opened the public
hearing for public comments. There being no speakers, Mayor Deoton closed
the public hearing. The City Council commended the Community Development
staff for their work on reducing the fees.
Levitt moved, second by Shanks, to adopt Resolution No. 6442 entitled 'Y\
RESOLUTION OF THE SEAL BEACH CITY COUNCIL AMENDING THE 2013-
2014 FEE RESOLUTION TO INCORPORATE THE BUILDING DIVISION FEE
