Approve the minutes for the adjourned and regular City Council meeting of

Mayor Deaton called the adjourned meeting of the Seal Beach City Council to
order at 5:30 p.m. in the City Hall Conference Room.

ORAL COMMUNICATIONS
There were no speakers.
CLOSED SESSION
The City Attorney announced that the City Council would meet to discuss the
items identified on the closed session agenda: Item "A" — GC §54957.6
Conference with Labor Negotiator (PMA/POA); Item `B" GC §54956.8
Conference with Real Property negotiators: 900-A Ocean Avenue — pier
restaurant(MDK& Off the Hook)and 4161 Ironwood Avenue (David Haub); and
Item "C" — GC §549556.9(d)(2) Conference with Legal Counsel — Initiation of
Litigation.
Councilman Miller arrived at 6:08 p.m.
The City Attorney reported that the City Council gave direction regarding the two
properties on item"B"and no other reportable action was taken.
ADJOURNMENT
It was the order of the Mayor, with consent of the Council to adjourn the meeting
at 6:54 p.m.

The City Council met in regular session at 7:00 p.m. with Mayor Deaton calling
the meeting to order in the City Council Chambers and Councilman Miller led the
Salute to the Flag.

ORAL COMMUNICATIONS
Mayor Deaton opened oral communications. Speakers: Six community
members spoke in support of returning the two Long Beach Transit routes back
to Seal Beach; Shirley Broussard, Senior Consultant SWARM, provided the
history of her efforts to get housing of the homeless in Seal Beach; Marc
Loopesko, 7th Street/Run Seal Beach Director, inquired about the illegal vacation
rentals in Seal Beach and stated the Run Seal Beach committee has given
$35,000 to the City towards workout stations in Seal Beach park areas and would
like to know the status of this project; and Seth Eaker, Run Seal Beach
Committee/Seal Beach Chamber of Commerce, report the April 5th Run is almost
sold out, the Chamber Car Show is April 26th, and expressed support for the Seal
Beach police department. There being no other speakers, Mayor Deaton
declared oral communications closed.
CITY ATTORNEY REPORT Quinn M. Barrow, Esq., City Attorney

CITY MANAGER REPORT Jill R. Ingram, City Manager
The City Manager reported that the City staff and Long Beach Transit have been
working to restore the Long Beach bus service in Seal Beach and Routes 131
and 171 will restored in June 2014.
COUNCIL COMMENTS
Mayor Pro Tern Sloan reported that he attended the City/Chamber of Commerce
Health Expo; Councilman Miller requested a status report or agenda item

regarding the DWP project, including the open space park and the State Lands
Use Commission property; and Mayor Deaton responded to the concern
expressed about the vacation rentals, indicated she attended the Health Expo,
and asked staff when the policy will be brought for Council consideration
regarding requests for proclamations/recognitions and Council/city support of
non-city issues—City Attorney responded it will be the second meeting in April.

Miller moved, second by Levitt, to approve the recommended actions on the
consent calendar as presented, except for items "D" and "F" pulled for separate
consideration.

citation system to facilitate the electronic submission of citation data to

amount to Integrated Law and Justice Agency for Orange County
(ILJAOC);and approving Budget Amendment No.14-09-01.

The City Manager stated that she pulled this item in order to provide further
transparency to the public — meets a significant goal of the Council to have
pension reform and containing health benefit costs long term. The Administrative
Manager provided the highlights of the MOUs. Levitt moved, second by Shanks
to adopt Resolution No. 6443 entitled "A RESOLUTION OF THE SEAL BEACH
CITY COUNCIL APPROVING THE MEMORANDA OF UNDERSTANDING
(MOUs) BETWEEN THE CITY OF SEAL BEACH AND THE SEAL BEACH

POLICE MANAGEMENT ASSOCIATION (PMA) AND THE SEAL BEACH
POLICE OFFICERS ASSOCIATION (POA), AND ENUMERATING

ITEM "F" / RESOLUTION NO. 6445 / ELECTRONIC CITATION MACHINES /
BUDGET AMENDMENT NO. 14-09-01 (Sloan)
Mayor Pro Tern Sloan pulled the item to inquire about the revenue from the
citations issued — the Police Chief responded that the revenue is approximately
$200,000 per year and explained that the Orange County Courts will no longer
manually enter citations after July 1, 2014 and citation issuing agencies may see
long delays thereby impacting the adjudication of those matters.
Sloan moved, second by Shanks to adopt Resolution No. 6445 entitled "A
RESOLUTION OF THE SEAL BEACH CITY COUNCIL AUTHORIZING BUDGET
AMENDMENT, NO. 14-09-01 FOR THE PROCUREMENT OF ELECTRONIC
CITATION MACHINES AND RELATED EQUIPMENT AND SERVICES". Budget
amendment in the amount of $47,310.68 — pay to Integrated Law and Justice
Agency for Orange County(ILJAOC).

PUBLIC HEARING
ITEM "G" / RESOLUTION NO. 6446 / ENERGY TUBULARS, INC. (ETI) /
BUSINESS FINANCIAL ASSISTANCE AGREEMENT/AMENDMENT NO. 3
Mayor Deaton stated this was the time for consideration of item "G" public
hearing. The City Manager provided a brief staff report stating that to preserve
the business contribution to the City's economy and to retain jobs within the
community, the City entered into a financial assistance agreement with ETI in
2007. Pursuant to the Agreement, ETI agrees to maintain its operations in the
City, and receives in exchange financial assistance from the City through
quarterly payments equal to 20% of the sales and use taxes generated by ETI.
Assembly Bill 562 added Section 53083 to the Government Code, which requires
among other things, that prior to approving an economic development subsidy,
the City must post certain information about the subsidy on its website and hold a
public hearing. In compliance with the new law, the City posted the required
information about the City's Agreement with ETI on its website. Mayor Deaton
opened the public hearing for public comments. Speaker(s): Seth Eaker, Seal
Beach Chamber of Commerce, spoke in support of this item. There being no
other speakers, Mayor Deaton closed the public hearing. Councilman Miller
thanked the City Manager for maintaining the relationship with Energy Tubulars.
Levitt moved, second by Shanks, to adopt Resolution No. 6446 entitled "A
RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING
AMENDMENT NO. 3 TO THE AGREEMENT BETWEEN THE CITY OF SEAL
BEACH AND ENERGY TUBULARS, INC."—extending the agreement to October
31, 2019. (City assistance would average approximately$200,000 per year.)

ITEM "G" / RESOLUTION NO. 6447 / AMENDING FEE SCHEDULE /
INCORPORATE FILMING CHARGES FOR USE OF THE CITY JAIL (continued
from 03/10/14 City Council meeting)
Mayor Deaton stated this was the time for consideration of item "H" public
hearing. The Police Chief stated that the new proposed fee is one way to help

offset the cost to run the jail without interfering with the daily operation of the
facility. Mayor Deaton stated this is the time for the continued public hearing for
public comments. Speaker(s): Seth Eaker, Seal Beach Chamber of Commerce,
spoke in support of this item. There being no other speakers at this time, Mayor
Deaton closed the public hearing.
Levitt moved, second by Shanks, to adopt Resolution No. 6447 entitled "A
RESOLUTION OF THE SEAL BEACH CITY COUNCIL AMENDING THE 2013-
2014 FEE RESOLUTION TO INCORPORATE THE FILMING CHARGES AND
FEES REVISION". (Adding to the use of city property a supplemental fee of
$500 per day for permitted photography, television, and filming in the city jail.)

ADJOURNMENT
With no objections, Mayor Deaton adjourned the meeting at 8:18 p.m. to
Monday, April 14, 2014 at 5:30 p.m. to meet in closed session, if deemed
necessary.
Councilman Shanks stated he would like the meeting be adjourned in the
memory of Nancy Grgas and there will be a memorial service and barbeque in
Eisenhower Park on Saturday at 11:00 a.m.
