Ingram, City Manager FROM: Patrick Gallegos, Administrative Manager SUBJECT: NON-PARTISANSHIP POLICY SUMMARY OF REQUEST: That the City Council adopt Council Policy No. 100-11, a non-partisan policy regarding taking positions on non-city issues such as state or federal legislation, propositions, pending court decisions or proclamations/recognitions of non-city related organizations. BACKGROUND AND ANALYSIS: On occasion, the City Council receives requests to: 1. Adopt resolutions or authorize letters in opposition to or in support of pending California Senate or Assembly bills, state propositions, U.S. congressional bills, or pending court decisions; 2. Adopt a proclamation proclaiming support for non-City related organizations; and 3. Recognize various organizations. Currently, the Council considers taking a position on state or federal matters on a case by case basis. Typically, the Council will not take a position on any matter unless the matter has a direct impact upon the City. Determining whether state or federal legislation, state initiatives, or pending court decisions directly impact the City can sometimes be difficult or subjective. Similarly, proclaiming support for or recognizing organizations is likewise difficult and subjective and can lead to criticism of exclusion. Most importantly, the City's electorate elected the Council to represent the City's residents and devote its time to City business, not necessarily to take positions on items that have no direct impact on the City's residents. Staff recommends that the City Council adopt the proposed policy of non- partisanship. Agenda Item A ENVIRONMENTAL IMPACT: There is no environmental impact related to this item. LEGAL ANALYSIS: The City Attorney has reviewed and approved the amendment as to form. FINANCIAL IMPACT: There is no financial impact related to this item. RECOMMENDATION: That the City Council adopt Council Policy No. 100-11 a non-partisan policy regarding taking positions on non-city issues such as state or federal legislation, propositions, pending court decisions or proclamations/recognitions of non-city related organizations. PURPOSE AND INTENT To establish procedures for handling City Council requests pertaining to non-City related issues. 2. POLICY It shall be the policy of the Seal Beach City Council not to consider items on its agenda in support of, or in opposition to, any matter unless that item has a direct impact on Seal Beach residents or businesses. When there is uncertainty as to whether the request has a direct impact to Seal Beach, the City Council will consult the City Manager and/or City Attorney for guidance. Any exception to this policy shall require the vote of 4 of the 5 City Councilmembers. 3. ISSUANCE Approved by City Council on Date 1 of 1 (100-11)
