That the City Council adopt:
(1) Resolution No. 6473 adopting the Fiscal Year 2014-2015 Operating
Budget and 5-Year Capital Improvement Program; approving the
Capital Improvement Program budget for Fiscal Year 2014/2015;
setting the Appropriations Limit for Fiscal Year 2014-2015; and
authorizing appropriations by fund; and
(2) Resolution No. 6474 establishing new fees and charges for goods,
services, and facilities provided by the City and amending and
restating the 2014/2015 Comprehensive Fee Resolution.
The City Council held two (2) budget workshops in late May and early June to
review and Solicit public input on the Proposed Budget and 5-Year Capital
Improvement Program for Fiscal Year 2013-2014.
The proposed budget was prepared based on City Council goals, and state and
federal mandates, with consideration given to preserving core services that the
City provides to the businesses, residents, and visitors of Seal Beach.

In addition to being made available on the City's website, copies of the proposed
budget were made available to the public for purchase at the City Clerk's office
and copies were distributed to the libraries for interested parties to review.
Notice of the public hearing was published as required by law in the Sun
Newspaper.
At the budget study sessions, the City Council directed staff to make
modifications to the Proposed Budget and based upon Council
recommendations. The changes are as follows:
1. Add $102,300 for Community Organization grant requests.
2. Add $45,000 for additional pressure washing on Main Street during the
high visitor serving periods of time.
3. Add $254,100 for the supplemental personnel requests.
a. Finance — Cashier to full time.
b. Police — EOC Coordinator to Corporal.
c. Police — ORCO Task Force detective (new position).
4. Add $80,000 for the Salon Meritage Memorial project.
5. Add $100,000 for Centennial expenses.
Some additional budgetary highlights are as follows:
1. The ORCO Task Force detective position is revenue neutral so State
Asset Seizure (Fund 11) revenue will be increased by $173,600
2. Salaries and benefits were adjusted for the March Consumer Price
Index (CPI) of 1.4% for all employees except Police.
3. Employees, other than Police, will be paying 6.0% of the employees
share of their retirement costs. Police will be paying 12% of their
retirement costs.
4. General Liability and Workers' Compensation premium was $41,700
less than expected.
5. Orange County Fire Authority final costs were $24,500 higher than
initially estimated.
6. Legal Services costs were adjusted downward by $30,000.
7. Revenues were increased by $25,000 for Barrel Tax and $50,000 for
anticipated increases related to the proposed Fee Schedule
adjustments.
In addition, per Ordinance No. 1610 Section 4.50.070 of the City Municipal Code
requires that the rate of Utility Users Tax (UUT) be reviewed annually. Based on
the Fiscal Year 2014-2015 revenue projections, UUT is the second largest
revenue source to the General Fund providing $5.3 million of General Fund
revenue.
The UUT funds several capital improvement projects needed in the City; such as
street improvements, storm drains, and beaches and pier projects. Without the
City's UUT, it would be impossible to continue the aggressive capital
improvement program established by the City and maintain the City's core

services at the current levels. No change has been recommended to the current
rate of 11 %.
The attached resolution approving the City's Operating Budget and 5-Year
Capital Improvement Program:
1. Adopts the Proposed Operating Budget and 5-Year Capital Improvement
Program as modified by the City Council at the budget study sessions held
in May and June;
2. Approves the Capital Improvement Program budget for Fiscal Year
2014/2015;
3. Re-appropriates all encumbrances from Fiscal Year 2013-2014 for
continued use in Fiscal Year 2014-2015;
4. Authorizes the City Manager to make appropriation transfers within
functions and programs as long as such transfers do not increase the
adopted annual budget appropriations; and
5. Establishes the Appropriations Limit for Fiscal Year 2014-2015 required
under Article XI I I B of the State Constitution.
In addition, attached is an amended and restated Comprehensive Fee Resolution
which: adopts new fees and further incorporates into the Comprehensive Fee
Resolution: (1) adjustments to and clarification of fees previously approved by
the City (e.g., building permit fees (Resolution No. 6442), filming fees (Resolution
No. 6447), FOG fees (Resolution No.6440)); (2) fees mandated by the State,
which the City collects on behalf of the State; and (3) the automatic CPI increase
delegated to the staff by the City Council pursuant to Resolution 6249. A red-
lined version of the Comprehensive Fee Schedule incorporating all of the above
revisions is attached as Exhibit A.
There is no environmental impact related to this item.
LEGAL ANALYSIS:
There is no legal analysis required for this item.
For Fiscal Year 2014-2015, the General Fund estimated revenues are projected
to be $28,718,300 compared to operating appropriations and transfers out of
$31,892,100 resulting in an estimated fund balance decrease of $3,173,800.
Included in the appropriations of $31,892,100 is $3,195,000 for Capital
Improvement projects. As a result of the changes highlighted in the staff report,
General Fund revenues exceed operating expenditures and operating transfers
by $21,200.

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
ADOPTING THE FISCAL YEAR 2014-2015 OPERATING
BUDGET AND 5-YEAR CAPITAL IMPROVEMENT PROGRAM,
APPROVING THE CAPITAL IMPROVEMENT PROGRAM
BUDGET FOR FISCAL YEAR 2014-2015, SETTING THE
APPROPRIATION LIMIT FOR FISCAL YEAR 2014-2016, AND
AUTHORIZING APPROPRIATIONS BY FUND
RECITALS
a. On May 29, 2014 and June 2, 2014, the City Council conducted budget
workshops to provide an opportunity to the public to comment on the
proposed budget for Fiscal Year 2014-2015, the 5-Year Capital
Improvement Program, and the Capital Improvement Program Budget for
Fiscal Year 2014-2015.
b. Pursuant to Seal Beach City Charter Article X, the City Council held a duly
noticed public hearing on June 9, 2014 to consider adopting the budget for
Fiscal Year 2014-15. Copies of the proposed budget have been available
for inspection by the public in the City Clerk's Office and on the City's
website at least 10 days prior to the public hearing.
c. On November 6, 1979, the voters of California added Article X111 B to the
State Constitution placing various limitations on the appropriations of the
State and local governments. Article X111 B provides that the
appropriations limit for the Fiscal Year 2014-2015 shall not exceed the
appropriations limit for the prior year adjusted for the change in the cost of
living and the change in population. The proposed appropriations limit of
$25,505,824 does not exceed the appropriations limit for Fiscal Year
2014-2015 adjusted for the change in the cost of living and the change in
population.
d. At the duly noticed workshops and the public hearing held on June 9,
2014, the City Council provided an opportunity for the public to comment
on the proposed budget for Fiscal Year 2014-2015, the 5-Year Capital
Improvement Program, the Capital Improvement Program Budget for
Fiscal Year 2014-2015, and the appropriations limit.
NOW THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY
RESOLVE:
SECTION 1. That certain document entitled "City of Seal Beach Fiscal Year
2014/2015 Operating Budget", a copy of which is on file in the office of the City
Clerk and on the City's website, which may hereafter be amended by the
Council, is hereby approved as the operating budget for the City of Seal Beach
for the Fiscal Year 2014/2015, beginning July 1, 2014 and ending June 30, 2015.

SECTION 2. Appropriations in the amount not to exceed $64,975,800 are
authorized for the purpose of carrying on the business of the City. The City
;NonoQer is hereby authorized to make appropriation transfers within and
between functions and programs, in accordance with Fiouo| PoUcy, as long as
such transfers do not increase the adopted annual budget appropriations.
SECTION 3. All encumbrances from FY 2013-2014 are re-appropriated for
continued use inFY2O14-2O15.
SECTION 4. The City Council hereby adopts the 5-Year Capital Improvement
Program for the City of 8aa| Baoch, and approves the Capital Improvement
Program Budget for the fiann| year commencing July 1. 2014 and ending June
30. 2015� All capital project appropriation balances from FY2O13-2O14shall be
carried forward for use inFY2014-2015.
SECTION 5. The City Council hereby establishes an appropriations limit of
$25.5U5.824 for fiscal year 2O14-2O15.in full compliance with Article X|||Bofthe
State Constitution.

ESTABLISHING NEW FEES AND CHARGES FOR GOODS,
SERVICES AND FACILITIES PROVIDED BY THE CITY OF SEAL
BEACH AND AMENDING AND RESTATING THE CITY'S
COMPREHENSIVE FEE SCHEDULE
RECITALS
1. The Seal Beach City Council is empowered to impose reasonable fees,
rates, and charges for municipal services.
2. Periodically, the City Council determines that fees, rates, and charges
should cover the costs reasonably borne or a substantial portion of the actual
costs of the goods and services provided by the City.
3. In 2012, the City Council established certain fees, rates, and charges
using the recommendations stated in the 2012 Full Cost Allocation Plan and Cost
of Services Study provided by Matrix Consulting Group; and restated other
previously established fees, rates, charges, and taxes.
4. Since 2012, the City Council has adopted resolutions establishing or
adjusting certain fees, rates, and charges after finding that fees for such
municipal services charges do not cover the actual costs incurred by the City,
and would like to direct the City Clerk to incorporate such changes into Section 1
of this resolution.
5. Resolution No. 6249 authorized an annual adjustment in accordance
with the increase in the Consumer Price Index (CPI) for the period from
December 2010 to December 2011 and every period thereafter. The City
Council hereby directs the City Clerk to incorporate such annual adjustments into
Section 1 of this resolution, and every year hereafter.
6. The State of California requires cities to charge state - established fees,
rates, and charges, which are paid to the State. The City Council hereby directs
the City Clerk to incorporate such State - imposed fees, rates and charges into
Section 1 of this resolution, and every year hereafter.
7. Additional study and analysis has determined that certain fees, rates,
and charges do not cover the actual costs incurred by the City. After conducting
a duly noticed public hearing on June 9, 2014 and satisfying all applicable
provisions of California Government Code Sections 66016 and 66018, the City
Council hereby finds that such fees, rates, and charges do not cover the actual
costs incurred by the City. Based upon the foregoing, the City Council hereby
establishes, adjusts and increases the fees, rates, and charges for the following
items:

The City Council hereby finds that, where appicable, the fees, rates, and
charges will not exceed the cost to the City of providing the service to which such
fees apply, and directs the City Clerk Un incorporate the fees, rabes, and charges

8. The adoption of this Resolution determines fees for the purpose of
meeting the operating expenses of City departments and is therefore exempt
from the California Environmental Quality Act,

The following per space in-lieu parking fee is hereby established for uama on
commercially zoned parcels located within the Main Street Specific Plan
Zone.
1. $3,500 fee per deficient space for all such u000 established onorafter
September 1, 1906. Such fee shall be calculated by multiplying the
number of parking spaces required, for the use that in not provided either
on-site or within 300 feet of the parcel on which the use is situated, by

2. An annual fee of $100 per deficient space for all such uses established
prior to September 1. 1896 which are currently operating under an
existing land-use entitlement wherein, as a condition of approval, the

The City of Seal Beach shall establish fees for the various recreation
programs. These fees shall be based on type of program; number of
participants and instrmctom, officials, etc. required in the program; and shall
be based on full cost recovery where feasible, including administrative costs.

The following rates shall be in effect for all reservations made through the
Recreation Office. Youth Resident Groups are defined as group having
60% of its membership residing in Seal Beach or having a student attending a

SECTION 9. UNSPECIFIED FEES
Whenever fees are charged for services provided by the City and no method for
the calculation is specified through this Resolution, other City Council resolutions,
the Municipal Code of the City of Seal Beach, or other state or federal statutes,
the fees shall be the actual cost (fully burdened), including the proportionate part
of the salaries, wages, or other compensation of any deputy or employee,
material and equipment costs and the cost, of overhead at 33.12% of the total.
SECTION 10. FINGERPRINT FEES
The charge for taking fingerprints is $79. This fee covers the cost of what the
Department of Justice charges for processing the fingerprints.

NOTE. • Per the City Municipal Code section 5.10.030, the business license tax amount for all
businesses other than those based on gross receipt taxes shall be adjusted annually on July 15,
of each year in accordance with the increase in the Consumer Price Index.

WHEREAS, the City Council is empowered to impose reasonable fees, rates, and
charges for municipal services; and
WHEREAS, the City Council has determined that the fees, rates, and charges should
cover the costs reasonably borne or a substantial portion of the actual costs of the goods
and services provided by the City; and

E. Main Street Specific Plan Zone In -lieu Parking Fees
The following per space in -lieu parking fee is hereby established for uses on
commercially zoned parcels located within the Main Street Specific Plan
Zone.
1. $3,500 fee per deficient space for all such uses established on or after
September 1, 1996. Such fee shall be calculated by multiplying the
number of parking spaces required, for the use that is not provided either
on -site or within 300 feet of the parcel on which the use is situated, by
$3,500.
2. An annual fee of $100 per deficient space for all such uses established
prior to September 1, 1996 which are currently operating under an
existing land -use entitlement wherein, as a condition of approval, the
applicant agreed to participate in the City's in -lieu parking program,
except for those uses governed by Section 3 hereinafter. Such annual
fee shall be calculated by multiplying the number of parking spaces
required, for the use that is not provided either on -site or within 300 feet
of the parcel on which the use is situated, by $100.
3. For all such uses established prior to September 1, 1996 pursuant to a
development agreement wherein the applicant agreed to participate in

F. Edison Community Garden Fees
To qualify for the use of a plot in the Edison Garden a gardener must be able
to prove that they are a resident in the City of Seal Beach. If a gardener
moves out of the City of Seal Beach, they must relinquish their plot by
February 161h. Rental of a garden plot is for one calendar year. Applications
must be returned with payment to the Community Services /Recreation
Department prior to January 16`h of each year in order to be renewed. After
the renewal deadline, any remaining plots will be assigned to those on the
waiting list.
