HomeMy WebLinkAboutCC Res 5402 2005-11-14 RESOLUTION NUMBER 5402 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH ADOPTING GENERAL PLAN AMENDMENT 05-2, AMENDING THE OPEN SPACE/ RECREATION/CONSERVATION ELEMENT OF THE GENERAL PLAN AND CONFORMING AMENDMENTS TO THE LAND USE ELEMENT OF THE GENERAL PLAN (BIDS SPECIFIC PLAN) I THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. The City is initiating this General Plan Amendment to amend the Open SpacelRecreationlConservation Element of the General Plan to reflect the final location and size of the "Perimeter buffer areas/retention areas" as set forth within the approved Boeing Integrated Defense Systems ("BIDS") Specific Plan and to make other conforming amendments to the Land Use Element of the General Plan. Section 2. At the time of City Council approval of the BIDS Specific Plan in July 2003 this project component was not established in the Open SpacelRecreationlConservation Element of the General Plan, as it was uncertain as to what the final approvals of the California Coastal Commission might establish for these proposed areas. The Coastal Commission approvals were consistent with the delineated areas location and size of the "Perimeter buffer areas/retention areas" as set forth within the approved BIDS Specific Plan. Section 3. The requested amendment to the Open SpacelRecreationlConservation Element of the General Plan is to now include these areas within the General Plan document and to make other conforming amendments to the Land Use Element of the General Plan. Section-;.. ~ duly noticed public hearing was held before the Planning Commission"on October 26(2005 to consider the subject amendments to the General Plan. At the p~lic-;h~afiilg, the Planning Commission invited and considered any and all testimony offered in favor or opposition to said project. At the conclusion of said Planning Commission public hearing the Planning Commission determined to recommend to the City Council approval of General Plan Amendment 05-2 on a 4-0-1 vote, with Commissioner Deaton being absent. Section 6. A duly noticed public hearing was held before the City Council on November 14, 2005 to consider the subject amendments to the General Plan. At the public hearing, the City Council invited and considered any and all testimony offered in favor or opposition to said project. Section 7. The record of the hearings indicates the following: I (a) The City is initiating this General Plan Amendment to amend the Open SpacelRecreationlConservation Element of the General Plan to reflect the' final location and size of the "Perimeter buffer areas/retention areas" as set forth within the approved Boeing Integrated Defense Systems ("BIDS") Specific Plan and to make other conforming amendments to the Land Use Element of the General Plan. The subject project components of the BIDS Specific Plan were fully evaluated in the certified Environmental Impact Report and no additional environmental review is required. (f) The subject property is identified as Lot B, Tract No. 16375, and is an irregular parcel, located along the western edge of the Being Integrated Defense Systems property adjacent to the Los Alamitos Retention Basin and along the northern side of Adolfo Lopez Drive, comprising approximately 194,433 square feet or 4.5 acres. I (g) The surrounding land uses and zoning are as follows: NORTH: The Leisure World Retirement community, located in the Residential High Density, Planned Development (RHD-PD) Zone. Based upon substantial evidence in the record of the City Council hearing regarding the application, including the facts stated in ~ 1 through ~ 7 of this resolution, and in the previously certified environmental documentation prepared in conjunction with this project, and pursuant to ~~ 28-2600 and 28-2602 of the City's Code, the City Council hereby finds that General Plan Amendment 05-2, consisting of an amendments to the Open SpacelRecreationlConservation Element of the General Plan and other conforming amendments to the Land Use Element of the General Plan, will be beneficial to the short term and long term land use goals of the City of Seal Beach. The City Council further finds that approval of the subject amendments to the General Plan will promote the public health, safety and welfare. Therefore, the City Council finds that the requested amendments to the Open SpacelRecreationlConservation Element of the General Plan and other conforming amendments to the Land Use Element of the General Plan of the City of Seal Beach will be in the public interest, and makes the following findings of fact: (a) The proposed General Plan Amendment to amend the Open SpacelRecreationlConservation Element of the General Plan and other conforming amendments to the Land Use Element of the General Plan will conform land uses to those set forth within the Land Use Element and the Open SpacelRecreationlConservation Element for the subject area. (b) The proposed project will conform the Land Use Element and the Open SpacelRecreationlConservation Element of the General Plan to the adopted Boeing Resolution Number 5402 Integrated Defense Systems Specific Plan and the approved California Coastal Commission Coastal Development Permit. (c) The proposed General Plan Amendment will not be detrimental to the short term or long term goals or objectives of the City of Seal Beach and are in the interest of the public health, safety and welfare. The proposed amendments are consistent with the General Plan, as amended. Section 9. Based on the foregoing Sections 1 through 8, the City I Council hereby approves General Plan Amendment 05-2 as set forth on Exhibit A. attached hereto and made a part hereof. Perimeter buffer areas/retention areas, BIDS Specific Plan (4.5 acres) Resolution Number 5402 Gum Grove Park contains a dense grove of over 800 eucalyptus trees. This park, which will be extended to Seal Beach Boulevard as part of the Hellman Ranch project, has been dedicated to the City for the enjoyment of the residents of the community. The BIDS Specific Plan includes a 4.5-acre area adjacent to the Los Alamitos Retention Basin and Adolfo Lopez Drive that is restricted for use as a storm water quality treatment basin area in accordance with City and Coastal Commission permit conditions. The water quality concept is to introduce bio-filtration, treatment areas, and best management practices (BMPs) to capture low water flows and provide storm water retention capacity to meet the stormwater runoff and water quality objectives ofthe City and other state agencies. I The Hellman Ranch Specific Plan provides for potential additional recreation/open space areas that may be developed as part of the total planned community. These areas/uses include: . Los Alamitos Retarding Basin - 34.7 acres retarding basin/open space . Hellman Ranch Lowlands - 100 acres on Hellman Ranch for future restoration, open space, and environmental education purposes. . Oil Production Acreage - approximately 50 acres on the Hellman Ranch that is currently used for oil production operations for future restoration, open space, and environmental education purposes upon the cessation of all mineral production activities. A pedestrian trail is planned to link to the Class I San Gabriel River Trail through the Los Angeles Department of Water and Power property adjacent to the west boundary ofthe Specific Plan site." C. The "City of Seal Beach ParkslRecreation/Open Space Map" on Page OS-IS is amended to indicate the inclusion of the "Water Quality & Flood Retention Basins" of the BIDS Specific Plan as shown graphically on Figure 3-3, Storm Drain and Water Quality Concept Plan, Boeing Specific Plan as "Open Space" on said Open Space Map. I Related Conforming Amendments to the Land Use Element of the General Plan: A. The "Seal Beach Planning Area 2 Land Use Map" on Page LU-17 is amended to indicate the inclusion of the "Water Quality & Flood Retention Basins" of the BIDS Specific Plan as shown graphically on Figure 3-3, Storm Drain and Water Quality Concept Plan, Boeing Specific Plan as "Open Space" on said Land Use Map. B. The "City of Seal Beach Land Use Map" on Page LU-47 is amended to indicate the inclusion of the "Water Quality & Flood Retention Basins" of the BIDS Specific Plan as shown graphically on Figure 3-3, Storm Drain and Water Quality Concept Plan, Boeing Specific Plan as "Open Space" on said Land Use Map.
