Home My WebLink AboutCC Res 5233 2004-05-18 RESOLUTION NUMBER X29~ I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE GENERAL (RUN-OFF) ELECTION HELD IN THE CITY OF SEAL BEACH ON THE 11th DAY OF MAY, 2004, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS PROVIDED BY LAW. WHEREAS, A General Municipal Election was held and conducted in the City of Seal Beach, County of Orange, State of California, on TueSday, the 11th day of May, 2004, as requJred by Ordinance Number 1522 of the City of Seal Beach,-California, adopted March 31st, 2004; and I WHEREAS, Notice of said election was duly and regularly given in time, form, and manner as provided by law; that voting precincts were properly established; that election officers were appointed and in all respects said election was held and conducted and the votes were cast, received and canvassed, and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law and charter cities; and WHEREAS, pursuant to Resolution Number 5225, adopted the 31st day of March, 2004, the City Clerk canvassed the returns and has certified the results of said election, the results are received, attached, and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That the whole number of ballots cast in the precincts except Absent Voter Ballots and Provisional Ballots was 1,702, the number of Provisional Ballots added to'the precinct totals was 27 for a precinct total of 1,729; the number of absentee ballots cast, including 78 Permanent Absentee Ballots turned in at a polling place, was 3,529, for a total of 5,258 ballots cast in the City. I Section 2. That the names of the persons voted for at the General Municipal Election for City Clerk, citywide, are as follows: Patricia E. Campbell Linda Devine Section 3. That the number of votes given at each precinct and the number of votes given in the City to Resolution Number ~33 Section 4. Section 5. Section 6. Section 7. each of such persons above named for the office for which said persons were candidates is attached hereto as Exhibit A. The City Council does declare and determine that: I Linda Devine was elected as City Clerk of the city of Seal Beach for the full ter~ of four years; The City Clerk shall enter in the records of the City Council of said City, a statement of the results of said election showing: (1) The..whole number of ballots cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person; and (5) The total number of votes given to eac~ person. I That pursuant to the City Charter, on the seventh day following the date for the General Municipal Election the City Clerk shall make and deliver to each of such persons so elected, a Certificate of Election signed by the city' Clerk and duly authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California, shall have those persons subscribe thereto and file same in the office of the City Clerk. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted.
