AN ORDINANCE OF THE CITY OF SEAL
BEACH, CALIFORNIA, APPROVING AND
ADOPTING AN AMENDMENT TO THE
REDEVELOPMENT PLAN FOR THE
RIVERFRONT REDEVELOPMENT PROJECT
OF THE REDEVELOPMENT AGENCY OF
THE CITY OF SEAL BEACH
THE CITY COUNCIL OF THE CITY OF SEAL BEACH,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
Section 1. The Redevelopment Agency of the City of Seal Beach has'
recommended the amendment of the Redevelopment Plan, as amended, (the
"Redevelopment Pjan") for the Riverfront Redevelopment Project, as amended (the
"Project Area") by the City Council by ordinance to change the land use designations of
certain portions of the Project Area. The Amendment changes the land use
designations as set forth in the Redevelopment Plan of those portions of the Project
Area which are affected by the Hellman Ranch Specific Plan.
Section 2. Amendment 97-1 to the Redevelopment Plan for the Project Area
dated October 8, 1997 (the "Amendment"), on file in the office of the City Clerk, is
hereby incorporated herein by this reference. .

Section 3. As established in the Redevelopment Plan, the purposes and
intent of the City Council with respect to the Project Area are to eliminate the
conditions of blight existing in the Project Area and to prevent their reoccurrence by
undertaking all appropriate redevelopment projects pursuant to the Community
Redevelopment Law, California Health and Safety Code Section 33000, et seq. (the
"Community Redevelopment Law"), including but not limited to: acquisition of certain
real property; installation, construction, or reconstruction of streets, utilities, and other
site improvements; and redevelopment of land for uses in accordance with the
Redevelopment Plan.
Section 4. Based upon the record of the joint public hearing on the
Amendment and the various reports and other information provided to the City Council
in accordance with Health and Safety Code Sections 33352 and 33457.1, the City
Council hereby makes the following findings and determinations as warranted by the
Amendment:

A. The Redevelopment Plan, as amended by the Amendment, would
redevelop the Project Area in conformity with the Community Redevelopment Law,
and in the interests of the public peace, health, safety and welfare. The implementation
of the Redevelopment Plan, as amended by the Amendment, will eliminate conditions.
of blight within the Project Area. The decisions by the City Council in connection with
the adoption of Ordinance No. 780, on March 3, 1969 and Ordinance No. 983 on
December 29, 1975 are final and conclusive and, after those dates, it has been, is and
shall be conclusively presumed that the Project Area is a blighted area. The
Redevelopment Plan, as amended by the Amendment, provides for the installation,
construction, or reconstruction of streets, utilities, and other site improvements. The
Redevelopment Plan, as amended by the Amendment, also provides for the
redevelopment of land for uses in accordance with the provisions of the Redevelopment
Plan. These improvements are essential to encouraging private investment and

eliminating the conditions of blight in the Project Area and preventing their
reoccurrence.
B. The carrying out of the Redevelopment Plan, as amended by the
Amendment, would promote the public peace, health, safety and welfare of the City of
Seal Beach and would effectuate the purposes and policy of the Community
Redevelopment Law. The implementation of the Redevelopment Plan, as amended by
the Amendment, will eliminate conditions of blight within the Project Area. The
Redevelopment Plan, as amended by the Amendment, provides for the installation and
construction of site improvements.

C. As set forth in the findings of the Planning Commission in its
Resolution 97-38, the Redevelopment Plan, as amended by the Amendment is
consistent with the General Plan of the City of Seal Beach, including, but not limited to
the General Plan's Housing Element, which substantially complies with the
requirements of Article 10.6 (commencing with Section 65580) of Chapter 3 of
Division 1 of Title 7 of the Government Code. The Redevelopment Plan, as amended
by the Amendment, proposes land uses and site improvements contemplated by the
General Plan and the goals and objectives of such General Plan.
Section 5. The Amendment is hereby approved and adopted and is hereby
designated as an official amendment to the Redevelopment Plan.
Section 6. The Redevelopment Plan, as amended by the Amendment, shall
constitute the official Redevelopment Plan, As Amended, for the Project Area.
Section 7. On March 3, 1969, the City Council of the City of Seal Beach
adopted Ordinance No. 780 entitled, "An Ordinance of the City of Seal Beach,
California, Approving and Adopting the Redevelopment Plan, as Modified, for the
Riverfront Redevelopment Project.' On August 12, 1974, the City Council adopted
Ordinance No. 937 entitled, "An Ordinance of the City Council of the City of Seal
Beach Adopting Amendments to the Redevelopment Plan for the Riverfront
Redevelopment Project." On December 29, 1975, the City Council adopted Ordinance
No. 983. entitled, "An Ordinance. of the City Council of the City of Seal Beach
Adopting Amendments to the Redevelopment Plan for the Riverfront Redevelopment
Project," which added territory to the Project Area. On September 14, 1981, the City
Council adopted Ordinance No. 1103 entitled, "An Ordinance of the City Council of
the City of Seal Beach Amending the Redevelopment Plan for the Riverfront
Redevelopment Project.. On December 8, 1986, the City Council adopted Ordinance
No. 1235. On March 6, 1989, the City Council adopted Ordinance No. 1278 entitled,
"Ordinance of the City of Seal Beach Amending the Redevelopment Plan for the
Riverfront Redevelopment Project." On December 12, 1994, the City Council adopted
Ordinance No. 1392 entitled, "An Ordinance of the City of Seal Beach Amending the
Redevelopment Plan, As Amended, for the Riverfront Redevelopment Project, As
Amended, of the Redevelopment Agency of the City of Seal Beach." Ordinance No.
780, as !lmended by Ordinance No. 937, as amended by Ordinance No. 983, as
amended by Ordinance No. 1103, as amended by Ordinance No. 1235, as amended by
Ordinance No. 1278, and as amended by Ordinance No. 1392, is hereby further
amended to revise the Redevelopment Plan in accordance with the Amendment.

Section 8. If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of the Ordinance. The City Council hereby declares that it would
have passed this Ordinance and each section, subsection, sentence, clause and phrase
thereof, irrespective of the fact that anyone or more sections, subsections, sentences,
clauses or phrases be declared invalid or unconstitutional.
