An Ordinance of the City Council ofthe City of Seal Beach Authorizing a
Contract Between the City Council of the City of Seal Beach and the Board
of Administration of the California Public Employees' Retirement System
The City Council of the City of Seal Beach does ordain as follows:
Section 1.
That a Contract between the City Council of the City of Seal Beach and the Board
of Administration, California Public Employees' Retirement System is hereby
authorized, a copy of said contract being attached hereto, marked Exhibit, and by
such reference made a part hereof as though herein set out in full

Section 2.
The Mayor of the City Council is hereby authorized, empowered and directed to
execute said contract for and on behalf of said Agency.
Section 3.
This Ordinance shall take effect 30 days after the date. of adoption, and prior to the
expiration of days of passage thereof shall be pub Iished at least once in the "Sun"
Newspaper, a newspaper of general circulation, published and circulated in the
City of Seal Beach and thenceforth and thereafter the same shall be in full force
and effect.

The Board of Administntion, Public Employees' Retirement System, bereinafter referred to as Board,
IIId the aovemlng body of above public agency, bereinafter referred to as Public Agency, baving entered
into a contract effective JUDe 1, 1958, and witnessed April 28, 1958, IIId as amended effective August
I, 1968, July I, 1972, May 16, 1973, October 12, 1977, July 4, 1979, August 13, 1980, September 17,
1986, July 22, 1987 and July 11, 1991, wbich provides for participation of Public Agency in said System,
Board IIId Public Agency bereby agree as follows:
A, Paragraphs 1 through 12 are bereby suicken from said contract as executed effective July II,
1991, IIId bereby replaced by the following paragrapbs numbered 1 through 12 inclusive:
1. All words IIId terms used berein wbich are defined in the Public Employees' Retirement
Law shall bave the meaning as defined therein unless otherwise specifically provided,
'Normal retirement age' shall mean age 60 for local miscellaneous members and age 50
for local safety members.

Public Agency shall participate in the Public Employees' Retirement System from and
after June 1, 1958 making its employees as bereinafter provided, members of said System
aubject to all provisions of the Public Employees' Retirement Law except such as apply
only on election of a contracting agency IIId are DOt provided for berein and to all
amendments to said Law bereafter enacted except those, wbich by express provisions
thereof, apply only on the election of a contracting agency.

3. Employees of Public Agency in the following classes shall become members of said
Retirement System except such in each such class as are excluded by law or this
agreement:
I. Local Fire Fighters (herein referred to as local safety members);
b. Local Police Officers (herein referred to as local safety members).
c. Ocean Beach Ufeguards (included as local safety members);
d. Employees other than local safety members (herein referred to as local
miscellaneous members).
4. In ldditioD to the classes of employees excluded from membership by said Retirement
Law, the following classes of employees sbaIl DOt become members of said Retirement
System:
a. PERSONS COMPENSATED ON AN HOURLY
BASIS lURED AUGUST 1, 1_ OR AFTER.

The percemage of fiDaI CODlpellSMion to be provided for local miscellaneous members for
each year of credited prior and current service shall be determiDed in accordance with
Secticm 21251.13 of said Retirement Law, subject to the reduction provided therein for
urvice prior tn June 30, 1972, termination of SocIal Security, for members wbose
urvice bas been iDcluded in Federal Social Security (2" at age 60 Full and Modified).
6. The percelltage of fiDaI compensation to be provided for each year of credited prior and
current service as a local safety member shall be determined in accordance with Section
21252.01 of aald Retirement Law (2" at age SO Full).

7. Public Agency elec:ted to be subject to the following optional provisions:
a, Sections 21380-21387 (1959 Survivor Benefits) excluding Section 21382.2
(IDcreased 1959 Survivor Benefits) and Section 21382.4 (Third Level of 1959
Survivor Benefits) for ocean beach lifeguards, local miscellaneous and local fire
members only,
b. Sections 21263, 21263.1 and 21263.3 (Post-Retirement Survivor Allowance).
c. Section 21222.1 (Special 5~ Increase - 1970), Legislation repealed said Section I
effective January 1, 1980,
d. Section 20024.2 (One-Year Final Compensation).
e. Section 20862,8 (Credit for Unused Sick Leave) for local miscellaneous and local
police members only,
f. Section 20930.3 (MiliWy Service Credit IS Public Service),
Statutes of 1976.
g. Section 20019.3 ("Local Safety Member" aball include ocean beach lifeguards of
a city IS described in Government Code Section 20019.3). .
h. Sections 21380-21387 (1959 Survivor Benefits) including Section 21382.4 (Third
Level of 1959 Survivor Benefits) for local police members only.
I. Section 20818 (Two-Years Additional Service Credit) for local miscellaneous
members only.
8. Public Agency, in accordance with Government Code Section 20740, ceased to be an
"employer" for purposes of Section 20759 effective on October 12, 1977. Accumulated
contributions of Public Agency shall be fixed and determined IS provlcled in Government I
Code Section 20759, and accumulated contributions thereafter aball be held by the Board
IS provlcled in Government Code Section 20759.
9. Public Agency shall contribute to said Retirement System the contributions determined
by actuarial valuations of prior and future service liability with respect to local
miscellaneous members and local safety members of &lid Retirement System.
10. Public Agency shall also contribute to said Retirement System IS follows:
a. Public Agency shall contribute $2,50 per employee, per month on account of the
liability for the 1959 Survivor Benefits provlcled under Section 21382,4 of &lid
Retirement Law. (Subject to annual change,) In addition, all assets and
liabilities of Public Agency and its employees shall be pooled in a lingle account,
based on term insurance rates, for survivon of all local police members.
b. A reasonable amount, IS fixed by the Board, payable in one installment within
60 days of date of contract to cover the costs of administering &lid System IS it
affects the employees of Public Agency, DOt including the COlts of lpecial
valuations or of the periodic investigation and valuations required by law,

11. Contributions required of Public Agency and its employees shall be subject to adjustment
by Board on account of amendments to the Public Employees' Retirement Law, and on
account of the experience under the Retirement System IS determined by the periodic
investigation and valuation required by &lid Retirement Law.

12. CoDttibutions required of Public Agency and its employees shall be paid by Public
Aiency to the Retirement System within fifteen days after the end of the period to which
said contributions refer or as may be prescribed by Board regulation. If more or less
than the correct amount of contributions is paid for any period, proper adjustment shall

In accordance with Section 20818, Government Code, and the contract between the City of Seal
Beach and Public Employees' Retirement System, the City of Seal Beach hereby certifies that:
I. Because of an impending curtailment of, or change in the manner of performing
service, the best interests of the agency will be served by granting such additional
service credit.
2. It has elected to become subject to Section 20818 because of impending
mandatory transfers, demotions, and layoffs that constitute at least I % of the job
classification, department or organizational unit designated resulting from the
curtailment of or change in the manner of performing its services.
3.
Its intention at the time Section 20818 becomes operative is to keep all vacancies
or at least one vacancy in any position in any department or other organizational
unit created by retirements under this section, permanently unfilled thereby
resulting in an overall reduction in the work force of such department or
organizational unit.

THEREFORE, the City Council of the City of Seal Beach hereby elects to provide the benefits of
Section 20918, Government Code, to all eligible members who retire within the designated
period, September 23, 1994 through December 31, 1994.
