Home My WebLink AboutCC Ord 1410 1996-09-30 ORDINANCE NUMBER ~ AN ORDINANCE OF lHE CITY OF SEAL BEACH, CAliFORNIA AMENDING CHAPTER 16-B OF THE CODE OF THE CITY OF SEAL BEACH RELATING TO PIPELINE FRANCmSES THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: I Section 1. Section 16B-1O(A)(1) of the Code of the City of Seal Beach relating to insurance requirements for franchisees is hereby amended to read as follows (the new text being added is in bold-fact!t:Hype): "1. Be issued to franchisee by an insurer admitted to do business in the State of California with a current rating of A:Vll or better in A.M. Best's insurance guide and name the City, and its officers, agents, and employees as additional insureds. " Section 2. Section l6B-18 of the Code of the City of Seal Beach relating to reimbursable costs is hereby amended in its entirety to read as follows: "Section l6B-18. Processine: Costs. The grantee shall reimburse the City for all the City's costs incurred in preparing, processing, and granting the franchise including, without limitation, staff costs, reasonable attorney's fees, and the cost of publishing any notice, resolution, and/or ordinance required by law to be published. Grantee shall remit payment to the City for such costs not later than thirty (30) days after receiving a statement therefor." Section 3. Section l6B-22 of the Code of the City of Seal Beach is hereby amended in its entirety to read as follows: I "Section l6B-22. Indemnity. The grantee shall indemnify, defend with counsel of City's choosing, and hold hannless the City, its City Council, officers, agents, and employees from any and all claims, actions, damage, liability or injury suffered by any person or entity which arises out of the use, operation or possession of the franchise, or from the use, construction, removal, operation or maintenance thereunder of any of grantee's facilities." Section 4. The adoption of this ordinance is categorically exempt from review under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Sections 15261, and 15300.1. Section 5. The City Clerk shall certify to the passage and adoption of this ordinance, and shall cause the same to be published once in newspaper of general circulation circulated within the City of Seal Beach.
