Home My WebLink AboutCC Ord 1320 1990-12-10 I I I ORDINANCE NUMBER ;I~~ AN INTERIM ORDINANCE OF THE CITY OF SEAL BEACH EXTENDING INTERIM ORDINANCE NUMBER 1318, PROVIDING FOR APPEALS TO THE CITY COUNCIL FROM CERTAIN DECISIONS OF THE PLANNING COMMISSION AND THE DIRECTOR OF DEVELOPMENT SERVICES AND DECLARING THE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS FOLLOWS: section 1. Ordinance Number 1318 is hereby extended to and inCluding October 29, 1991. The Findings set forth in Ordinance Number 1318 are hereby incorporated by this reference, section 2, with the exception of Interim Ordinance Number 1318 which, if not extended hereby, would expire on December 27, 1990, there is at the present time no ordinance which sufficiently provides for an appeal process to the city Council from certain decisions of the Planning Commission and the Director of Development Services The zoning ordinance presently lacks adequate provisions for appeals in these situations. A revision of the applicable sections of the zoning ordinance concerning appeals to the City Council is now being prepared. It would defeat the purpose of Ordinance Number 1318 to permit the Ordinance to expire until such time as the studies are completed and a permanent ordinance is prepared and adopted. Expiration of the regulations in Ordinance Number 1318 would deprive certain applicants of the privilege of appealing certain decisions to the City Council. The public peace, health, safety and welfare require that an appeal process be in effect until the City adopts adequate procedures regarding appeals to the City Council from decisions of the Planning commission and the Director of Development Services. Section 3. Therefore, there is a current and immediate threat to public health, safety and welfare and the lack of an adequate appeals process as described in Ordinance Number 1318 would result in a threat to pUblic health, safety and welfare. Notwithstanding the prov~s1ons of Section 28- 2407.A.2. or any other provisions of the Code of the city of Seal Beach, decisions of the Planning Commission concerning minor plan reviews pursuant to section 28-2407.A.2. and any determinations by the Director of Development Services as to which there is no existing appeal procedure in the Code, shall be appealable if within ten (10) days of the date of the decision an appeal in writing is filed with the City council by either an applicant or an interested party. The filing of such an appeal within such time limit shall stay the effective date of the order of the Planning commission and/or the Director of Development Services until such time as the City Council has acted on the appeal as hereafter set forth in Chapter 28 of the Code of the citv of Seal Beach. This ordinance is hereby declared to be an emergency measure for preserving the public peace, health, safety and welfare and shall take effect immediately and shall remain in effect until October 29, 1991, unless it is extended or repealed by this City Council. .
