Home My WebLink AboutCC Ord 1332 1991-02-25 ORDINANCE NO. ~~~~ AN INTERIM ORDINANCE OF THE CITY OF SEAL BEACH AMENDING INTERIM ORDINANCE NUMBER 1321, PROVIDING AN EXCEPTION FOR CERTAIN NON-CONFORMING RESIDENTIAL BUILDING EXPANSION REQUESTS IN ACCORDANCE WITH SECTION 28-2407,A.2Cil OR SECTION 28- 2407.A.2. (i) AND DECLARING THE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS FOLLOWS: Section 1, Section 2. Section 3. Section 4. Section 3 of Ordinance No. 1321, shall be amended to read as follows: I "Notwithstanding the provisions of Section 28- 2407.A.2(i) or Section 28-2407.A.2(j) or any other provisions of the Code of the City of Seal Beach, no building permits or other entitlements of use shall be issued which would permit the expansion or alteratiop of nonconforming residential structures in accordance with Section 28-2407.A.2.Cil or Section 28-2407 .A, 2. ci 1, except as permitted by Ordinance Number 1319 or as permitted in accordance with Section 4 below, shall be issued, Unless the owner of the proposed expansion or alteration applies for and receives a permit from the Planning Commission pursuant to the procedural criteria set forth in Section 28-2503 to 28-2513 of the Code of the Citv of Seal Beach." Ordinance No. 1321 shall be amended by adding thereto section 4 to read as follows: "The expansion or alteration of nonconforming residential structures in accordance with Section 28-2407.A,2. Cil or Section 28-2407.A,2. Cil shall be I permitted for nonconforming existing single family dwellings which are conforming due to density and the provision of required off-street parking, All conditions set forth in sectiOn 28-2407.A,2,Ci) or Section 28-2407.A.2.Cil shall be met as part of any proposed expansion or alteration," Section 4. through Section 6, of Ordinance No, 1321 are hereby renumbered to Section 5. through Section 7., respectively. This ordinance is hereby declared to be an emergency measure for preserving the public peace, health, safety and welfare and shall take effect immediately and shall remain in effect until the expiration date of Ordinance No. 1319, which is May 13, 1991, unless it is extended or repealed by this City Council. The city Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
